About approval of Rules of consideration and assurance of invitations of citizens of the Republic of Kazakhstan for resettlement to the Republic of Kazakhstan relatives from among the ethnic Kazakhs living abroad for the purpose of reunion of family

According to subitem 13-1) of Item 1 of article 15 of the Law of the Republic of Kazakhstan of July 22, 2011 "About population shift" PRIKAZYVAYU:

1. Approve the enclosed Rules of consideration and assurance of invitations of citizens of the Republic of Kazakhstan for resettlement to the Republic of Kazakhstan of relatives from among the ethnic Kazakhs living abroad for the purpose of reunion of family.

2. To provide to committee of work, social protection and migration of the Ministry of health and social development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction for publication in periodic printing editions and information system of law of Ad_let, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of consideration and assurance of invitations of citizens of the Republic of Kazakhstan for resettlement to the Republic of Kazakhstan relatives from among the ethnic Kazakhs living abroad for the purpose of reunion of family

Chapter 1. General provisions

1. These rules of consideration and assurance of invitations of citizens of the Republic of Kazakhstan for resettlement to the Republic of Kazakhstan of relatives, from among the ethnic Kazakhs living abroad for the purpose of reunion of family (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 22, 2011 "About population shift" (further - the Law) and determine procedure for consideration and assurance of invitations of citizens of the Republic of Kazakhstan for resettlement to the Republic of Kazakhstan of relatives from among the ethnic Kazakhs living abroad for the purpose of reunion of family".

2. According to these rules local executive bodies of areas, cities of republican value, the capital (further - local executive bodies) consider and certify invitations of citizens of the Republic of Kazakhstan for resettlement to the Republic of Kazakhstan of relatives from among the ethnic Kazakhs living abroad for the purpose of reunion of family.

3. The main terms and concepts which are used in these rules:

1) the applicant – the citizen of the Republic of Kazakhstan petitioning for resettlement to the Republic of Kazakhstan of relatives from among the ethnic Kazakhs living abroad for the purpose of reunion of family;

2) relatives – the persons who are in family relation, having general ancestors to the great-grandfather and the great-grandmother;

3) the ethnic Kazakh – the foreigner or the stateless person of the Kazakh nationality.

Chapter 2. Procedure and terms of consideration and assurance of invitations of citizens of the Republic of Kazakhstan for resettlement to the Republic of Kazakhstan relatives from among the ethnic Kazakhs living abroad for the purpose of reunion of family

4. The applicant for resettlement to the Republic of Kazakhstan of relatives from among the ethnic Kazakhs living abroad for the purpose of reunion of family submits the application to local executive body in form according to appendix 1 to these rules.

At the same time, local executive bodies of areas, cities of regional value also for the purpose of reunion of family accept invitations of citizens of the Republic of Kazakhstan for resettlement to the Republic of Kazakhstan of relatives from among the ethnic Kazakhs living abroad and send these invitations to local executive bodies of areas, cities of republican value, the capital.

Are enclosed to the application:

1) the invitation in form according to appendix 2 to these rules;

2) the copy of the identity document, the inviting person.

6. In case of representation in incomplete amount and (or) not fillings according to the established document form, stipulated in Item 4 these rules, the local executive body within 3 working days directs to the applicant written reasons (with indication of not provided and (or) not filled according to the established document form).
