About approval of Rules of development and approval of the job description of the administrative government employee

According to the subitem 13) Item 2 of article 5 of the Law of the Republic of Kazakhstan of November 23, 2015 "About public service of the Republic of Kazakhstan", PRIKAZYVAYU:

1. Approve the enclosed Rules of development and approval of the job description of the administrative government employee.

2. Declare invalid the order of the Chairman of the Agency of the Republic of Kazakhstan for public service of August 12, 2011 No. 02-01-02/164 "About approval of Rules on development and approval of the job description of the administrative government employee" (No. registered in the Register of state registration of regulatory legal acts 7157, No. 302-303 (26693-26694)) published in the Kazakhstanskaya Pravda newspaper of September 20, 2011.

3. To provide to department of public service of the Ministry of cases of public service of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) official publication according to the procedure, established by the legislation of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan.

4. To impose control of execution of this order on the deputy minister for public service of the Republic of Kazakhstan supervising questions of public service.

5. This order becomes effective from the date of its first official publication and extends to the relations which arose since January 1, 2016.

Rules of development and approval of the job description of the administrative government employee

1. General provisions

1. These rules of development and approval of the job description of the administrative government employee (further - Rules) determine procedure for development, approval of the job description.

2. The job description reflects following from ex-officio full powers and responsibility of the administrative government employees determined on the basis of the qualification requirements established by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan of November 23, 2015 "About public service of the Republic of Kazakhstan" and other legislation of the Republic of Kazakhstan and contains specific list of functions which execution is assigned to the state position.

3. The job description includes the provisions directed to implementation of the strategic plan of state body by the administrative government employee and achievement of the objects set in it, tasks and indicators directly related to structural division in which the administrative government employee consists.

2. Procedure for development and approval of the job description

4. The job description is developed by structural division of state body in which the administrative government employee performs activities.

5. The draft of the job description is polistno initialed by the direct head of the administrative government employee. The service of personnel management (personnel service) - provides general coordination on development of the job description, and also submits it for approval to the official having the right of appointment to the state position and releases from the state position.

6. The service of personnel management (personnel service) informs the administrative government employee of its job description under list within three working days after holding the post by the administrative government employee, and also within three working days after approval of the job description in the new edition or approvals of the changes and additions made to the job description with provision to the administrative government employee of the copy of the job description, act of modification and amendments in the job description.

7. The job description is regularly considered by structural division regarding need of introduction of the relevant amendments.

8. Amendments to the job description prepare structural division at the request of management of state body or at the initiative of structural division and affirm person having the right of appointment to the state position and releases from the state position.

9. In case of assignment of execution of job responsibilities of the administrative government employee on other person, including for leave of the main administrative government employee, this person studies service of personnel management (personnel service) the job description of the administrative government employee under list within three working days from the date of assignment of fulfillment of duties on it the administrative government employee.

3. Contents of the job description

10. The job description is drawn up in form according to appendix to these rules.

In the job description names of state body, structural division, position, details of the document on approval of this instruction are specified.

11. In the Section "General provisions" are specified:

1) fundamental organization-legal documents based on which the administrative government employee performs the activities and realizes the powers;

2) the list of the structural divisions and positions which are directly subordinated to this administrative government employee (in the presence);

3) interchangeability in case of temporary absence of the main worker.

12. In the Section of "Right" opportunity to make the administrative government employee certain actions, to demand certain behavior (actions or abstention from making of actions) from other persons in the course of the activities for accomplishment of the tasks and obligations assigned to it is specified.

In the Section the rights of the administrative government employee which he has in case of execution of the obligations assigned to it, including on implementation of the actions directed to realization of the following functions are reflected:

1) organizational and administrative;
