About approval of Standard rules of payment of lump-sum allowances to kandasa and the members of their families who moved to the Republic of Kazakhstan out of regional quota of acceptance of kandas

1. Approve the enclosed Standard rules of payment of lump-sum allowances to kandasa and the members of their families who moved to the Republic of Kazakhstan out of regional quota of acceptance of kandas.
2. To provide to committee of work, social protection and migration of the Ministry of health and social development of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order its direction for publication in periodic printing editions and information system of law of Ad_let, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.
3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These Standard rules of payment of lump-sum allowances to kandasa and the members of their families who moved to the Republic of Kazakhstan out of regional quota of acceptance of kandas (further – Standard rules) determine standard payment procedure of lump-sum allowances to kandasa and the members of their families who moved to the Republic of Kazakhstan out of regional quota of acceptance of kandas.
2. Based on these Standard rules akimats of areas, cities of republican value, the capital (further – MIO) develop rules and payment terms of lump-sum allowances to kandasa and the members of their families who moved to the Republic of Kazakhstan out of regional quota of acceptance of kandas.
3. The main terms and concepts which are used in these Standard rules:
1) kandas – the ethnic Kazakh and (or) members of his family of the Kazakh nationality who were earlier not consisting in the nationality of the Republic of Kazakhstan, arrived to the historical homeland and received the corresponding status according to the procedure established by the Law;
2) the applicant – the ethnic Kazakh who received the status of kandas;
3) authorized organization for payment – the banks of the second level or the organization having licenses of authorized body on regulation and supervision of the financial market and the financial organizations and National Bank of the Republic of Kazakhstan on implementation of separate types of banking activities;
4) authorized body concerning population shift – the structural division of MIO performing within the corresponding administrative and territorial unit of function of authorized body concerning migration.
4. For the purposes of these Standard rules the benefit is provided to MIO in cash to kandasa and members of their families (further – receivers) in case of resettlement of kandas to the Republic of Kazakhstan out of regional quota of acceptance of kandas.
5. The benefit is provided one-timely and includes compensations of costs for journey to the permanent residence and transportation of property.
6. The request for appointment and allowance payment is performed after assignment of the status of kandas.
7. For appointment and allowance payment by the head of the family of kandas in the place of his residence the application in form according to appendix to these Standard rules, with indication of the personal account which is previously opened in authorized organization for payment is submitted to MIO on behalf of family.
To the application it is enclosed the following documents:
1) copies of identity documents of kandas and members of his family;
2) copy of the certificate of kandas;
3) the document confirming registration at the place of residence on each family member.
8. The documents specified in subitems 1) and 2) of Item 7 of these Standard rules are represented in originals and copies for reconciliation then originals of documents return to the applicant.
9. MIO within five working days from the date of the address, in the presence of these Standard rules of documents specified in Item 7 passes the decision on appointment or on refusal in allowance payment, with indication of causes of failure.
The decision on appointment or on refusal in allowance payment is signed by the head of authorized body concerning population shift or person fulfilling its duties.
In case of decision making within three working days notifies the applicant on purpose of allowance payment of MIO.
In case of refusal in allowance payment of MIO within three working days notifies the applicant with indication of causes of failure.
10. In the decision on purpose of benefit the family composition of kandas, the amount of the payments corresponding to them and number of the personal account opened by the head of the family of kandas in authorized organization for payment are specified.
11. MIO no later than three working days after decision about purpose of benefit transfers the corresponding payments into personal account of the kandas opened in authorized organization for payments.
12. The refusal in establishment of benefit is performed in the following cases:
1) the termination of the status of kandas in case of the address;
2) provision of the doubtful documents specified in Item 7 of these Standard rules.
13. Financing of expenses on provision of benefits is performed within the means provided by the budget of areas, the cities of republican value, the capital the current financial year.
