1. Approve the enclosed Standard regulations on the commission on inclusion in regional quota of acceptance of kandas.

2. To provide to committee of work, social protection and migration of the Ministry of health and social development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.

4. This order becomes effective after ten calendar days after day of its first official publication.

Standard provision of the commission on inclusion in regional quota of acceptance of kandas

Chapter 1. General provisions

1. This Standard provision of the commission on inclusion in regional quota of acceptance of kandas is developed according to Item 9-1 of article 11 of the Law of the Republic of Kazakhstan of July 22, 2011 "About population shift" and determines tasks and functions of the commission on inclusion in regional quota of acceptance of kandas (further - the Commission).

2. The commission is permanent collegiate organ in the territory of the corresponding administrative and territorial units.

3. The commission in the activities is guided by the Constitution, the laws and other regulatory legal acts of the Republic of Kazakhstan.

4. The commission consists of the chairman, the vice-chairman, members of the commission and the secretary of the Commission which general structure constitutes at least 5 people. The secretary is not member of the commission.

5. The commission is headed by the chairman elected members of the commission.

The structure of the Commission affirms the akim of area, city of republican value, the capital.

Deputies of maslikhats, representatives of state bodies and public organizations are part of the Commission.

6. Chapter 2. Task and functions of the commission

10. Task of the Commission is ensuring timely and high-quality consideration of the applications of ethnic Kazakhs and members of their families which received the status of kandas about inclusion in regional quota of acceptance of kandas.

11. The commission according to the task assigned to it performs the following functions:

1) approves lists of the kandas provided by local executive bodies of areas, cities of republican value and the capital;

2) considers applications of the kandas petitioning for their inclusion in regional quota of acceptance of kandas;

3) makes the decision:

about prior consent to inclusion of ethnic Kazakhs and members of their families in regional quota of acceptance of kandas;

about inclusion in regional quota of acceptance of kandas, ethnic Kazakhs and members of their families which received the status of kandas;

about refusal in inclusion in regional quota of acceptance of kandas with motivated reasons for causes of failure;

4) interacts with state bodies and other organizations;

5) makes the offer to local executive body about document transfer of the applicant in case of the choice of other region by it for resettlement of kandas.

12. Commission session is convoked by its chairman, within three working days from the date of receipt of lists of the kandas provided by local executive bodies of areas, cities of republican value and the capital.

13. Decisions of the Commission are made by open voting by a majority vote from total number of the members of the commission who are present at its meeting.

Decisions of the Commission are competent in the presence of two thirds of total number of its structure.

14. Decisions of the commission are drawn up in the form of the conclusion and signed by the chairman, the secretary, the present members of the commission.
