emphasizing the commitment to rules of international law, first of all, to the purposes and the principles of Articles of organization of the United Nations, and following obligations assumed within Organization for Security and Cooperation in Europe

according to the Contract on friendship and cooperation between the Republic of Kazakhstan and Turkmenistan of May 19, 1993, the Memorandum of delimitation of frontier between the Republic of Kazakhstan and Turkmenistan of April 9, 1999, confirming lack of territorial questions to each other,

in view of need of refining and legal registration of passing of the line of frontier between the Republic of Kazakhstan and Turkmenistan for the purpose of ensuring its immunity and inviolability,

emphasizing that the frontier between the Republic of Kazakhstan and Turkmenistan will always be limit of peace and harmony between the states of two fraternal peoples, agreed as follows:

Article 1

High contracting parties determined passing of the line of the Kazakhstan-Turkmen frontier (daleegosudarstvenny border) on the basis of administrative-territorial differentiation of the being Kazakh SSR and the Turkmen SSR.

Article 2

High contracting parties agreed that the line of frontier between the Republic of Kazakhstan and Turkmenistan passes in full accordance with the Description of passing of the line of frontier between the Republic of Kazakhstan and Turkmenistan which is integral part of this Agreement (Appendix 1).

Article 3

The line of frontier is applied on sheets of cards of scale 1:100 000, which are integral part of this Agreement (Appendix 2).

Article 4

Any natural changes of the area do not involve changes in passing of the line of frontier if High contracting parties do not agree about other.

Article 5

The border on the Caspian Sea will be defined by the separate agreement between the Republic of Kazakhstan and Turkmenistan.

Article 6

The point of joint of frontiers of the Republic of Kazakhstan, Turkmenistan and the Republic of Uzbekistan will be defined by the separate international treaty between these states.

Article 7

High contracting parties agreed to start process of demarcation of the Kazakhstan-Turkmen frontier.

Article 8

Any questions concerning interpretation and application of provisions of this agreement will be regulated by negotiations and consultations.

Article 9

This Agreement is termless and is not subject to denouncement. This Agreement is subject to ratification and becomes effective from the date of exchange of instruments of ratification. It is made in the city of Astana, on July 5, 2001 in two authentic copies, everyone in the Kazakh, Turkmen and Russian languages, at the same time all texts are equally authoritative. The description of passing of the line of frontier between the Republic of Kazakhstan and Turkmenistan

The initial point of the Kazakhstan-Turkmen frontier (further - the line of frontier) is the point of joint of frontiers of the Republic of Kazakhstan, Turkmenistan and the Republic of Uzbekistan. This point will be defined by the separate international treaty between the Republic of Kazakhstan, Turkmenistan and the Republic of Uzbekistan.

From the initial point the line of frontier goes on straight line in the western direction to border point of N1.

The border point of N1 is on leaf of the K-40-100 card (area condition for 1974, the edition of 1984) with coordinates X =4 576 660, of U=10 416 000 and is located in 10:40 km to the northeast of geodetic Item with mark 13.2, of 8.97 km to the North from soil reference point with mark minus 30.7.

From border point of N1 the line of frontier goes on straight line in the western direction to border point of N2. Extent of the line of frontier between border points of N1 and N2 constitutes 10.46 km.

The border point of N2 with coordinates X =4 577 605, Y=10 405 608 is located on crossing of the line of frontier with the field road, in 9:31 km to the North North West from geodetic Item with mark 13.2, of 8:12 km to the East from soil reference point with mark 209.9. From border point of N2 the line of frontier goes along the field road in the general southwest direction to border point of N3. Extent of the line of frontier between border points of N2 and N3 constitutes 8.20 km.

The border point N 3 with coordinates X =4 572 405, Y=10 400 410 is located on crossing of the line of frontier with the field road, in 9:30 km to западо - I North will sink down from geodetic Item with mark 13.2, of 8:24 km to the North from geodetic Item with mark 37.2, of 4.69 km to the southeast from soil reference point with mark 209.9.

From border point of N3 the line of frontier goes generally западо - the North western direction through height with mark 177.6 to border point of N4. Extent of the line of frontier between border points of N3 and N4 constitutes 3.40 km. The border point of N4 with coordinates X =4 573 114, Y=10 397 090 is located on the upper edge of break chinka Kaplankyr, in 9:32 km to the North North West from geodetic Item with mark 37.2, of 9.73 km to the northeast of geodetic Item with mark 34.6, of 3:17 km to the South from soil reference point with mark 209.9.

From border point of N4 the line of frontier goes on the upper edge of break chinka Kaplankyr in the general western direction, then passes to leaf of the K-40-99 card (area condition for 1974, the edition of 1984) and further goes in the general northwest direction, passes to leaf of the K-40-87 card (area condition for 1990, the edition of 1991) and goes in the general northwest direction to border point N 5. Total length of the line of frontier between border points of N4 and N5 constitutes 81.00 km.
