ORDER OF THE MINISTER OF INTERNAL AFFAIRS OF THE REPUBLIC OF KAZAKHSTAN

About approval of the List of executive positions of the law-enforcement bodies of the Republic of Kazakhstan which are subject rotation and Rules of carrying out their movement

(as amended of the Order of the Minister of Internal Affairs of the Republic of Kazakhstan of 28.03.2017 No. 224)

According to item 4 of article 31 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service", PRIKAZYVAYU:

1. Approve enclosed:

1) the List of executive positions of law-enforcement bodies of the Republic of Kazakhstan of subjects of rotation according to appendix 1 to this order;

2) Rules of carrying out rotation of executive positions of law-enforcement bodies of the Republic of Kazakhstan their movement according to appendix 2 to this order.

2. To department of personnel work (Abdigaliyev A. U.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication of the copy of this order in periodic printing editions and in information system of law of Ad_let;

3) the direction of the copy of this order within ten calendar days from the date of its obtaining in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan;

4) placement of this order on official Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the First Deputy Minister of Internal Affairs of the Republic of Kazakhstan the police lieutenant general Demeuov M. G., Department of personnel work of the Ministry of Internal Affairs of the Republic of Kazakhstan (Abdigaliyev A. U.).

4. This order becomes effective after ten calendar days after day of its first official publication.

The list of executive positions of the law-enforcement bodies of the Republic of Kazakhstan which are subject to rotation

on the Ministry of Internal Affairs of the Republic of Kazakhstan

chief of regional military investigation department;

on Departments of internal affairs of the cities of Astana, Almaty, areas and on transport

department head; first deputy department head; deputy chief of department; chief city, district, linear, managements (department) of internal affairs; head of department of own safety;

on Departments of criminal executive system of the cities of Astana, Almaty and areas

department head;

on Departments on emergency situations of the cities of Astana, Almaty and areas

department head;

On educational institutions

chief of Academy of the Ministry of Internal Affairs; chief of training center.

Appendix 2

to the Order of the Minister of Internal Affairs of the Republic of Kazakhstan of November 26, 2015 No. 966

Rules of carrying out rotation of executive positions of law-enforcement bodies of the Republic of Kazakhstan

1. These rules of carrying out rotation of executive positions of law-enforcement bodies of the Republic of Kazakhstan (further - Rules) are developed for the purpose of implementation of article 31 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service".

2. Annually in the fourth quarter the Department of personnel work creates the list of heads according to appendix of 1 subjects of rotation forthcoming year and affirms the Minister of Internal Affairs.

3. Planned rotation of heads is carried out by the authorized person based on recommendations of Department of personnel work, taking into account compliance to qualification requirements, results of medical examination by the military-medical commission and supporting documents lack of the bases interfering rotation.

4. Rotation of the head appointed to position and dismissed by the authorized person is performed on representation of personnel service.

5. Rotation is carried out in the following purposes:

1) increases in efficiency of activities of law-enforcement bodies, development of the cities of regional value, districts of areas and areas in the cities;

2) prevention of corruption offenses;

3) effective use of working and managerial experience of heads;

4) professional development and enhancement of managerial competences of heads.

6. Rotation is carried out on one of the following schemes:

1) inter-level ("the center - the region", "the region - the center");

2) interregional ("the region - the region");

3) intersectoral ("the center - the center").

7. Rotation of heads of territorial authorities and organizations is performed according to the decision of the Minister of Internal Affairs once in five years. The made decision is drawn up by the order. Rotation of heads of territorial authorities and organizations on service to other area is allowed from written consent of the employee, and for the benefit of service - irrespective of stay term to positions and without the consent of the employee.

8. Rotation of the head is performed by person (body) having the right of appointment to executive position and releases from it (further - the authorized person).

9. The officials having (who are guardians) of the handicapped children including adopted (adopted) or dependent on which there are aged parents or family members who are constantly living with them and having disability 1 and 2 groups are not subject to the rotation connected with moving to other area. The specified circumstances are documented.

10. Office housing without the privatization right is provided to the Rotiruyemy employees holding executive positions of law enforcement agency for execution of job responsibilities.

11. The new start allowance is paid to Rotiruyemy employees, costs for journey on transport and for transportation of own property according to the Law of the Republic of Kazakhstan of April 23, 2014 No. 199-V ZRK "About Law-enforcement Bodies of the Republic of Kazakhstan" are compensated.

12. The division of personnel work notifies the head who is subject to rotation no later than one month before its carrying out.
