About approval of the Regulations on procedure for trade in oil products in the conditions of emergence of emergency situations of natural and technogenic nature

According to the Presidential decree of the Republic of Belarus of November 26, 2015 "About modification and amendments in presidential decrees of the Republic of Belarus" and for the purpose of determination of procedure for trade in oil products in the conditions of emergence of emergency situations of natural and technogenic nature the Council of Ministers of the Republic of Belarus DECIDES: No. 475

1. Approve the enclosed Regulations on procedure for trade in oil products in the conditions of emergence of emergency situations of natural and technogenic nature.

2. To the republican state bodies and other state organizations subordinated to the Government of the Republic of Belarus, regional executive committees and the Minsk Gorispolkom to bring the regulatory legal acts into accord with this resolution and to take other measures for its realization.

3. This resolution becomes effective since March 1, 2016, except for Item 2, of the official publication of this resolution which is becoming effective later.

Regulations on procedure for trade in oil products in the conditions of emergence of emergency situations of natural and technogenic nature

1. This Provision is developed for the purpose of determination of procedure for trade in oil products in the conditions of emergence of emergency situations of natural and technogenic nature (further - emergency situations).

In case of trade in oil products in the conditions of emergence of emergency situations delivery and trade in oil products for refill of the vehicles which appeared in transport jams are performed (further - jams).

2. Forecasting of possibility of formation of jams as a result of emergency situations, planning of actions and coordination of activities for refill of the vehicles which are in jams is performed by the relevant commissions on emergency situations in case of regional (The Minsk city), city, district executive committees (further - the commissions on emergency situations).

3. The Belarusian state concern on oil and chemistry provides permanent availability of necessary inventory of oil products in the organizations of oil product supply of the national production association "Belorusneft" * (further - the organizations of oil product supply) for trade with them in the conditions of emergence of emergency situations.

4. In case of emergency situations and need of refill of the vehicles which are in jams, the relevant commissions on emergency situations:

4.1. specify places of formation of jams, the number of the vehicles which are there, necessary amount of oil products (by types) for refill, determine terms and routes of their transportation;

4.2. make decisions:

about need of delivery and realization of oil products to the consumers who are in places of formation of jams, by use of the available mobile gas stations or by delivery of oil products in metal canisters and the organization of peddling trade. The specified decision happens for execution to the organizations of oil product supply servicing the corresponding administrative and territorial units. Taking into account opportunities of the specified organizations in case of need the commissions on emergency situations involve in delivery of oil products in metal canisters and to carrying out handling works with these canisters the bodies of military management of Armed Forces and the organizations having available the equipment of high passability;

about need of maintenance by vehicles of operational appointment of law-enforcement bodies of the equipment attracted to delivery of oil products and refill of vehicles in places of formation of jams, and also implementation of adjusting and administrative actions on traffic routes of this equipment. The specified decision happens for execution to territorial authorities of internal affairs;

about organization of events on liquidation of possible emergency situations on traffic routes of the equipment attracted to delivery of oil products and in places of refill of vehicles. The specified decision happens for execution to territorial authorities on emergency situations and (or) divisions on emergency situations;

about need of implementation of clearing of traffic routes of the equipment attracted to delivery of oil products to places of formation of jams and for places of refill of vehicles. The specified decision happens for execution to bodies of military management of Armed Forces (if necessary) and to the organizations located in the territory of the corresponding administrative and territorial unit.

5. The realization of oil products to legal entities and physical persons during emergency situation in places of formation of jams is enabled:

in the presence at them cash and bank payment cards - according to the procedure, established by the legislation;

in case of lack at them of cash and bank payment cards - based on the purchase and sale agreements signed in writing between the physical (legal) persons and the organizations of oil product supply enabling the realization of oil products.
