1. Approve:

1) criteria for evaluation of risk degree in the field of control of production of separate types of oil products according to appendix 1 to this joint order;

2) checking leaf in the field of control of production of separate types of oil products concerning producers of oil products (except for producers of oil products of low power) according to appendix 2 to this joint order;

3) checking leaf in the field of control of production of separate types of oil products concerning producers of oil products of low power according to appendix 3 to this joint order.

2. Declare invalid the joint order of the Minister of Energy of the Republic of Kazakhstan of June 22, 2015 No. 420 and the Acting Minister of national economy of the Republic of Kazakhstan of June 30, 2015 No. 479 "About approval of criteria for evaluation of risk degree and forms of checking sheets in the field of production of separate types of oil products" (registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 11822, published on September 7, 2015 in information system of law of Ad_let).

3. To provide to committee of ecological regulation, control and state inspection in oil and gas complex of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication periodic printing editions and information system of law of Ad_let;

3) the direction of the copy of this order within ten calendar days from the date of its obtaining in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan;

4) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and the intranet portal of state bodies;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

4. To impose control of execution of this joint order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This joint order becomes effective since January 1, 2016 and is subject to official publication.

Criteria for evaluation of risk degree in the field of control of production of separate types of oil products

Chapter 1. General provisions

1. These Criteria for evaluation of risk degree in the field of control of production of separate types of oil products (further – Criteria) are developed according to Item 5 of article 141 of the Entrepreneurial code of the Republic of Kazakhstan (further – the Code), the Law of the Republic of Kazakhstan "About state regulation of production and turnover of separate types of oil products" (further – the Law) and Rules of forming by the regulatory state agencies of system of assessment and risk management approved by the order of the acting minister of national economy of the Republic of Kazakhstan of June 22, 2022 No. 48 (it is registered in the Register of state registration of regulatory legal acts for No. 28577) for the purpose of reference of subjects (objects) of control in the field of control of production of separate types of oil products on risk degrees.

2. In Criteria the following concepts are used:

1) the subject of control – producers of oil products, productions being legal entities, performing production of separate types of oil products and having the passport;

2) point – quantitative measure of calculation of risk;

3) insignificant violations – the violations connected with non-presentation of the report on monthly information on acceptance of oil and gas condensate in the established form;

4) normalization of data – the statistical procedure providing reduction of the values measured in different scales to conditionally general scale;

5) considerable violations – the established violations by results of the previous checks and preventive control with visit of subject (object) of control expressed as not provision of primary statistical data or primary administrative data, non-compliance with prohibition on use of the same equipment for production of oil products by two and more producers of oil products;

6) producer of oil products of low power – the producer of oil products performing production of oil products on technology installations which design capacity provides amount of conversion of crude oil and (or) gas condensate less than eight hundred thousand tons per year;

7) oil products – separate types of oil products: gasoline, aviation and diesel fuel, fuel oil, road bitumen;

8) producer of oil products – the legal entity having oil refinery on the property right and (or) other legal causes and performing production of oil products according to the passport of production, and also realization of the made own oil products and (or) transfer of the oil products which are raw materials supplied by the customer conversion product;
