1. Approve the enclosed Rules of cost determination of construction of facilities due to the state investments and means of subjects of the quasi-public sector.

2. To provide to committee on cases of construction of housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of national economy.

4. This order becomes effective on the expiration of ten calendar days after day of its first official publication.

Rules of cost determination of construction of facilities due to the state investments and means of subjects of the quasi-public sector

Chapter 1. General provisions

1. These rules of cost determination of construction of facilities due to the state investments and means of subjects of the quasi-public sector (further - Rules) are developed according to subitem 6-3) of article 20 of the Law of the Republic of Kazakhstan "About architectural, town-planning and construction activities in the Republic of Kazakhstan" (further - the Law) and establish procedure for cost determination of construction of facilities due to the state investments into construction and means of subjects of the quasi-public sector (further - construction of facilities), except for objects I (increased) level of responsibility which construction cost is determined according to the advanced universal standards, the foreign investments realized by subjects of the quasi-public sector with attraction in the amount of 50 (fifty) and more percent from construction cost.

2. These rules are intended for the subjects performing architectural, town-planning and construction activities in the Republic of Kazakhstan in case of development and implementation of investment projects on construction of facilities due to the state investments into construction and means of subjects of the quasi-public sector.

3. In these rules the following basic concepts are used:

1) project management - activities for the organization, planning, coordination, control of designing, construction and commissioning of objects according to the signed contracts with the customer or the investor for goal achievement of the investment project within the set budget and terms;

2) the summary estimate on preparation (development) of the territory of construction and commissioning of the facility - the document determining amount of the means, necessary for allotment of land, preparation of the territory of construction and operational personnel, carrying out the commissioning and complex approbation of the equipment providing commissioning of the facility;

3) construction activities (further - construction) - activities for creation of fixed assets of production and non-productive assignment by construction new and (or) changes (expansions, upgrades, modernization, reconstruction, restoration, major repair) the existing objects (buildings, constructions and their complexes, communications), mounting (dismantle), the related processing and plumbing system, production (production) of construction materials, products and designs, and also implementation of works on preservation of construction of incomplete objects and post-utilization of the objects which developed the resource;

4) construction object - the separate building or construction with all arrangements relating to it, the equipment, furniture, stock, subsidiary and auxiliary devices, with the engineering networks and all-areal materials adjoining to it, or set of the buildings and constructions having general technological or other purpose;

5) the state investments into construction (further - the state investments) - investments into construction of new buildings and constructions, their complexes, engineering and transport communications, and also reconstruction (expansion, upgrade, modernization) or major repair of the existing objects which source are:

means republican and (or) local budgets, including the target funds allocated for budget investments and budget crediting of subjects of the quasi-public sector;

target means of non-state loans under the state guarantee or the guarantee of the state;

means of National fund of the Republic of Kazakhstan;

6) pricing in construction - the mechanism of formation of cost of construction products;
