Agreement between the Government of the Republic of Kazakhstan and Government of the Republic of Belarus on military and technical cooperation

of September 3, 1998

The government of the Republic of Kazakhstan and the Government of the Republic of Belarus which are hereinafter referred to as with the Parties

being guided and developing provisions of the Treaty of friendship and cooperation between the Republic of Kazakhstan and the Republic of Belarus of January 17, 1996,

considering the agreements signed within the Commonwealth of Independent States in the field of military and technical cooperation and also the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Belarus on military control of product quality delivered for Armed Forces of the Republic of Kazakhstan and Armed Forces of the Republic of Belarus of September 23, 1997

considering it expedient to keep the developed cooperation bonds on development, production and mutual deliveries of arms, military equipment, military and technical property, their components and spare parts for the benefit of defense of the states, recognizing importance of development of mutually advantageous bilateral ties on permanent basis in military and technical area,

aiming at cooperation increase on the basis of mutual advantage and economic feasibility,

agreed with following.

Article 1

The parties perform cooperation in the following areas:

1. Production, delivery, upgrade; servicing and repair:

- aircraft equipment and arms;

- technicians and arms for troops of air defense;

- technicians and arms for land forces;

- automated control systems for troops, weapon, investigation and radio-electronic fight, systems and complexes of data transmission, means of communication and optical means.

2. Research and development works for the benefit of enhancement of arms and military equipment.

3. Reconstruction, upgrade and conversion of the companies making military products.

Article 2

For implementation of provisions of this agreement of the Party appoint Authorized bodies:

from the Kazakhstan Side - the Ministry of Defence of the Republic of Kazakhstan; from the Belarusian Side - the Ministry of Defence of the Republic of Belarus and the Industry ministry of the Republic of Belarus.

Article 3

Purchases of arms, military equipment, appliances and provision of services are performed based on contracts between manufacturers and customers according to the current legislation of the Parties.

The nomenclature and amounts of mutual deliveries of arms, military equipment, special property, rendering services of military and scientific and military and technical appointment, condition of deliveries, procedure and forms of settlement are determined by the Parties and their business entities in contractual documents.

Article 4

This agreement does not infringe on interests of the third parties and does not interfere with cooperation of the Parties with other countries in military and technical area.

The parties shall abstain from the actions interfering accomplishment of the contractual commitments by other Party according to earlier signed international treaties. Transfer and sale (re-export) to the third party of military equipment, products and information on them is allowed from written consent and on the conditions approved with the Party from which this equipment, products and information is received.

Article 5

Research and development works are performed on the basis of arrangements of the Parties on upgrade and development of samples of arms and military equipment. The parties perform permanent exchange of scientific and technical information on the samples of arms and military equipment which are in joint development and operation. The procedure for financing of the specified research and development works, and also copyright protection and patents is determined by the Parties supplementary agreements,

Article 6

The parties shall ensure safety of information obtained within military and technical cooperation and observe the approved confidentiality level. The parties respect the principles of approval and trade secrets relating to the sphere of cooperation.

Article 7

Matters of argument which can arise in the course of cooperation will be permitted by negotiations and consultations.

If the Parties will not be able to reach agreement, consideration of disputes over compensation of the material damage connected with violation of provisions of this agreement by the Parties or their business entities will be performed in Economic court of the Commonwealth of Independent States.

Article 8

Changes and additions to this agreement can be made by the conclusion of additional protocols which will be its integral part.

Article 9

This agreement becomes effective from the date of exchange of notifications on accomplishment of the interstate procedures by the Parties necessary for its entry into force. This agreement is signed for a period of five years and will be prolonged automatically for the subsequent five-year periods if one of the Parties in writing does not declare the intention to stop its action at least in six months prior to the expiration of the corresponding period.

It is made in the city of Astrakhan on September 3, 1998 in two authentic copies, everyone in the Kazakh, Belarusian and Russian languages, and all texts are equally authoritative. In case of interpretation of provisions of this agreement of the Party will be guided by the text in Russian.
