ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of carrying out energy audit

(as amended on 29-11-2023)

According to subitem 6-10) of article 5 of the Law of the Republic of Kazakhstan of January 13, 2012 "About energy saving and increase in energy efficiency" PRIKAZYVAYU:

1. Approve the enclosed Rules of carrying out energy audit.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of carrying out energy audit

Chapter 1. General provisions

1. These rules of carrying out energy audit (further – Rules) are developed according to subitem 6-10) of article 5 of the Law of the Republic of Kazakhstan "About energy saving and increase in energy efficiency" (further – the Law) and determine procedure for carrying out energy audit.

2. In these rules the following basic concepts are used:

1) tool inspection – measurement and registration of characteristics of energy consumption by means of stationary and portable devices;

2) management in the field of energy saving and increase in energy efficiency (further – power management) - the complex of the administrative actions aimed at providing rational consumption of energy resources and increase in energy efficiency of object, including development and realization of policy of energy saving and the increase in energy efficiency, actions plans, procedures and techniques of monitoring, assessment of energy consumption and other actions directed to increase in energy efficiency;

3) target energy audit – the energy audit which is carried out on voluntary basis, having special-purpose character and restriction on carrying out amount;

4) class of energy efficiency of the building, structure, construction – the level of profitability of energy consumption of the building, structure, construction characterizing its energy efficiency at operation stage;

5) express energy audit – the energy audit which is carried out according to the reduced program and for the purpose of confirmation of results of the energy analysis performed within system of management in the field of energy saving and increase in energy efficiency and the previous conclusion on energy saving and increase in energy efficiency;

5-1) energy auditor (further - the power accountant) - the physical person having the certificate of conformity in the field of energy saving and increase in energy efficiency;

6) energy audit – collection, processing and data analysis about use of energy resources for the purpose of assessment of opportunity and energy saving potential and preparation of the conclusion on energy saving and increase in energy efficiency;

7) power auditing organization – the legal entity performing energy audit;

8) energy saving – realization of the organizational, technical, technological, economic and other measures directed to reduction of amount of the used energy resources;

9) energy efficiency (further – energy efficiency) – the quantitative relation of amount of the provided services, works, the turned-out products (goods) or the made energy resources to the initial energy resources spent for it;

10) energy resources – set of the natural and made energy carriers which stored energy is used now or can be used in the long term in economic and other types of activity, and also energy types (atomic, electric, chemical, electromagnetic, thermal and other types of energy);

11) the certificate of conformity in the field of energy saving and increase in energy efficiency - the document issued by body for confirmation of conformity, certifying competence of the power accountant to perform works in the field of energy saving and increase in energy efficiency.

3. The energy audit is performed at the expense of means of the addressed person based on the agreement signed according to the Civil code of the Republic of Kazakhstan and the Law.

4. The energy audit is carried out for the purpose of assessment of opportunity and energy saving potential, determination of opportunities of increase in energy efficiency, cost estimation on implementation of actions on energy saving and increase in energy efficiency, preparation of the conclusion on energy saving and increase in energy efficiency or the technical report on energy saving and increase in energy efficiency.

The energy audit is subdivided into the following types: statutory energy audit, ekpress-energy audit and target energy audit.

5. Aggregate term of carrying out statutory energy audit constitutes at least two months, but no more than twelve months from the date of the conclusion of the agreement, the term of carrying out express energy audit at least two months, but no more than six months from the date of the conclusion of the agreement, the term of carrying out target energy audit is determined by power auditing organization and the addressed person based on the agreement signed according to the Civil Code of the Republic of Kazakhstan.

6. The energy audit is carried out taking into account seasonal characteristics of the surveyed object (objects). At the same time the measuring (test) stage, stipulated in Item 8 these rules, is carried out both in winter, and in summer the periods concerning the industrial enterprises having buildings, structures and constructions.
