About approval of the Regulations on method of maintaining the state register of resolutions and decisions of European court on human rights on cases against the Republic of Moldova

Based on part provisions (1) article 20 of the Law No. 151 of July 30, 2015 on the Government representative (The official monitor of the Republic of Moldova, 2015, 455) I ORDER to Art. No. 224-233,:

1. Create the Register of resolutions and decisions of the European Court of Human Rights on cases against the Republic of Moldova.

2. Approve Regulations on method of maintaining the state register of resolutions and decisions of European court on human rights on cases against the Republic of Moldova it (is applied).

3. To perform creation and functioning of the State register of resolutions and decisions of the European Court of Human Rights on cases against the Republic of Moldova for the account and within the assignments approved to the Ministry of Justice in the Law on the government budget.

4. Publish this order in the Official monitor of the Republic of Moldova.

Regulations on method of maintaining the state register of resolutions and decisions of European court on human rights on cases against the Republic of Moldova

I. General provisions

1. The regulations on method of maintaining the State register of resolutions and decisions of the European Court of Human Rights on cases against the Republic of Moldova (further - the Register) regulate method of maintaining the register, the procedure of registration and provision of information from the Register, information access from the Register, safety and integrity of information from the Register.

2. The register is the public database which represents set of information on resolutions and decisions of the European Court of Human Rights on cases against the Republic of Moldova. The register is part of the agent.gov.md web page.

3. The register is organized so that to provide that processes of registration and access simple, effective, available and transparent for the public.

II. Subjects of legal relationship on maintaining the Register

4. The state is owner of the Register which performs the property right, managements and uses of data from this register.

5. The owner of the Register is the Ministry of Justice with the right of management and use of data from the Register and resources in the limits set by the owner.

6. As owner of the Register Ministry of Justice:

1) provides organizational and financial conditions for creation and maintaining the Register;

2) ensures safety and data protection from the Register;

3) is controlled by process of data recording in the Register;

4) establishes conditions of access to data from the Register;

5) establishes technical and organizational measures of protection and safety of the Register.

7. Holder of the Register is the Center of legal information which is administrative authority in subordination of the Ministry of Justice.

8. As the holder of the Register Center of Legal Information has the following functions:

1) administers the database of the Register;

2) is provided by proper functioning of the Register;

3) is controlled by functioning of the Register for the purpose of ensuring compliance with the legislation;

4) considers the complaints received in connection with technical shortcomings of the Register;

5) is provided by access to any interested physical person or legal entity to information entered in the Register;

6) ensures safety of data from the Register and determines risks which can affect their integrity.

9. Registrar of the Register is the Government representative.

10. As the registrar the Government representative has the following functions:

1) is provided by forming and amendment of the database of the Register;

2) registers data on resolutions and decisions of the European Court of Human Rights on cases against the Republic of Moldova;

3) provides authenticity and completeness of data from the Register;

4) monitors processing of data.

11. The government representative registers the following data:

1) according to decisions of the European Court of Human Rights on cases against the Republic of Moldova:

a) name of the applicant of physical person or name of the applicant of the legal entity;

b) number of the application submitted by the applicant;

c) date of announcement or notification on the decision;

d) date of the introduction of the decision in force;

e) subject of the decision;

f) transfer of the text of the decision into state language;

g) the scanned image of the original of the decision;

2) under resolutions of the European Court of Human Rights on cases against the Republic of Moldova:

a) name of the applicant of physical person or name of the applicant of the legal entity;

b) number of the application submitted by the applicant;

c) date of announcement or notification on the resolution;

d) date of the introduction of the resolution in force;

e) subject of the resolution;

f) transfer of the text of the resolution into state language;

g) the scanned image of the original of the resolution.

12. Supplier of the data provided to the item 11 of this provision is the European Court of Human Rights.

13. Receivers of data of the Register are state bodies and other legal entities, physical persons.

III. The subjects of the Register and data relating to these objects

14. In the Register the following objects are registered:

1) decisions of the European Court of Human Rights on cases against the Republic of Moldova;

2) resolutions of the European Court of Human Rights on cases against the Republic of Moldova.

15. On the objects registered the Register contains the following information:

1) according to decisions of the European Court of Human Rights on cases against the Republic of Moldova:

a) name of the applicant of physical person or name of the applicant of the legal entity;

b) number of the application submitted by the applicant;

c) date of announcement or notification on the decision;

d) date of the introduction of the decision in force;

e) subject of the decision;

f) transfer of the text of the decision into state language;

g) the scanned image of the original of the decision;

2) under resolutions of the European Court of Human Rights on cases against the Republic of Moldova:

a) name of the applicant of physical person or name of the applicant of the legal entity;

b) number of the application submitted by the applicant;

c) date of announcement or notification on the resolution;

d) date of the introduction of the resolution in force;
