About approval of the Regulations on Advisory council under the State agency on regulation of fuel and energy complex under the Government of the Kyrgyz Republic

Based on the Law of the Kyrgyz Republic "About natural monopolies in the Kyrgyz Republic", Regulations on the State agency on regulation of the fuel and energy complex under the Government of the Kyrgyz Republic approved by the order of the Government of the Kyrgyz Republic of November 14, 2014 No. 650, for the purpose of increase in justification and ensuring transparency of the made decisions on fuel and energy complex regulation I order:

1. Approve Regulations on Advisory council under the State agency on regulation of fuel and energy complex under the Government of the Kyrgyz Republic (further - Advisory council) according to appendix.

2. To department of licensing and control of the State agency on regulation of fuel and energy complex under the Government of the Kyrgyz Republic:

- in the 10th day time to prepare offers on candidates of members of Advisory council;

- in the 20th day time to prepare the draft of the order on structure of Advisory council for the subsequent approval.

3. To confer responsibility for holding meetings with alternate members of Advisory council on the head of department of licensing and control T. Orozaliyev.

4. To the press secretary to publish this order and Regulations on Advisory council on the official site of the State agency on regulation of fuel and energy complex under the Government of the Kyrgyz Republic for general acquaintance.

6. I reserve control of execution of this order.

Regulations on Advisory council under the State agency on regulation of fuel and energy complex under the Government of the Kyrgyz Republic

1. General provisions

1.1. The advisory council under the State agency on regulation of fuel and energy complex under the Government of the Kyrgyz Republic (further - Advisory council) is formed as permanent advisory advisory body for the purpose of consideration of questions and preparation of offers on fuel and energy complex regulation.

1.2. The advisory council in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, decrees and orders of the President of the Kyrgyz Republic and resolutions of Jogorku Kenesh of the Kyrgyz Republic, resolutions and orders of the Government of the Kyrgyz Republic, orders of the State agency, and also this Provision.

2. Main objectives and functions

2.1. The main objectives and functions of Advisory council are:

- preparation of recommendations about enhancement of state regulation and control of compliance with law in the sphere of the fuel and energy complex (FEC);

- preparation of offers on development of the competition in the energy industry sphere;

- consideration and examination of projects of legislative and other regulatory legal acts in the energy industry sphere;

- efficiency analysis of implementation of the laws and other regulatory legal acts governing the relations in the energy industry sphere;

- preparation of materials concerning development and regulation of the sphere of energy industry for meetings of the Government of the Kyrgyz Republic, parliamentary hearings, conferences, seminars, meetings and other actions;

- preparation of recommendations to executive bodies of the Kyrgyz Republic and local self-government, and also subjects of entrepreneurship on holding the actions aimed at the development by energy industry;

- preparation of recommendations about coordination of actions of other authorized bodies of the executive authority performing separate functions on regulation of energy industry;

- preparation of methodical, analytical and information materials concerning energy industry;

- preparation of materials for the publication in mass media on topical issues of energy industry.

3. Membership and structure

3.1. The advisory council is created of representatives of authorized body on regulation of fuel and energy complex, the energy companies and organizations, infrastructure organizations of power, the scientific and project organizations, independent experts and consultants, professional community of participants of energy market.

3.2. The staff of Advisory council affirms the director of the State agency.

3.3. Members of Advisory council are appointed for a period of two years, at the same time the number of terms of stay in Advisory council is not limited.

3.4. The numerical structure of Advisory council is recommended in number of 11 people, but is not limited.

3.5. The representative of the infrastructure or expert organization, or the independent expert is appointed the chairman of Advisory council.

3.6. One of heads of departments of the State agency is appointed the vice-chairman.

3.7. The responsible secretary of Advisory council is appointed from number of persons employed of the State agency.

4. Organization of work

4.1. As a part of Advisory council according to the decision of Council sections on activities of Council can be formed.

4.2. The advisory council is convoked as required, but at least once in two months.

4.3. Meetings of Advisory council are conducted by the chairman or in case of its absence the deputy. The chairman determines time and the venue, and also approves agendas of meetings of Advisory council, signs protocols and decisions of Advisory council.

4.4. Agendas of meeting of Advisory council are created by the chairman independently and on the basis of proposals of members of Advisory council.

Members of Advisory council also have the right to make offers on inclusion of additional questions in the agenda of meeting directly after opening of meeting of Advisory council.

4.5. Convocation of meeting is provided by the responsible secretary of Advisory council based on the notification signed by the chairman or the deputy.

Information on date and the venue of meeting of Advisory council, and also the agenda of meeting are represented to members of Advisory council not later than the 5th day before date of meeting. If necessary to members of Advisory council materials for meeting of Advisory council are presented in the paper or electronic form in 3 days prior to date of meeting.

4.6. If the member of Advisory council cannot personally be present at meeting of Advisory council, then he has the right to provide to Advisory council of the offer in writing.

4.7. In case of absence of the member of Advisory council in a row on more, than three meetings of Advisory council without reasonable excuse, the chairman or the deputy can raise question of exception of this member of Advisory council of its structure. The decision on exception of the member of Advisory council of its structure and appointment of the new member is accepted by a simple majority vote members of council and affirms the director of the State agency.
