About lotteries

This Law establishes rules of the organization and carrying out lotteries in the Azerbaijan Republic, the rights and obligations of organizers and participants of lotteries.

Article 1. Legislation on lotteries

1.1. The legislation on lotteries consists of the Constitution of the Azerbaijan Republic, the Civil code of the Azerbaijan Republic, this Law, other legal acts of the Azerbaijan Republic, and also international treaties which the Azerbaijan Republic joined.

1.2. The relations in the sphere of lotteries in the Alyatsky free economic zone are governed according to requirements of the Law of the Azerbaijan Republic "About the Alyatsky free economic zone".

Article 2. The basic concepts used in this Law

2.0. In this Law the following basic concepts are used:

2.0.1. lottery - the mass game which is held by distribution by the organizer of lottery of lottery tickets, draw of prize fund (except for virtual lottery) between participants of lottery and issue (payment) of prizes to owners of advantageous lottery tickets (other data carriers equated to them);

2.0.2. the stimulating lottery - the lottery which is carried out for the purpose of sales promotion of goods (work, service) between persons which purchased the specified goods (work, service);

2.0.3. production lottery - form of carrying out the lottery which is played in case of predefined prize fund;

2.0.4. instant lottery - form of carrying out lottery which prize is determined irrespective of other participants of lottery right after acquisition by the participant of lottery of the lottery ticket affirming the right of participation in lottery;

2.0.5. target lottery - the lottery form which is carried out for the purpose of financing of cultural, social, improving, sports, educational and other projects of the state value according to the decision of the body (structure) determined by relevant organ of the executive authority;

2.0.6. advantageous fund - set (cost) of the money played in lottery and intended for payment in the form of prize, or other property (thing) which is subject to transfer or the services (works) which are subject to rendering including the additional resources made and withdrawn by the organizer of lottery in accordance with the terms of lottery, except for virtual lottery;

2.0.7. draw of prize fund - the process establishing vyigryshnost, or nevyigryshnost of the lottery ticket on the basis of the principle of accident and emergence of the property right to certain part of prize;

2.0.8. prize - the money which is subject to payment to the owner of the lottery ticket which is considered advantageous under the terms of lottery, either other property (thing) or subject to rendering service (work);

2.0.9. the lottery ticket - the document, other data carrier equated to it or the electronic code granting the right of participation in lottery, confirming the property right to certain part and (or) in prize of prize fund if it was advantageous;

2.0.10. the organizer of lottery - the legal entity who is organizing and carrying out lottery on its own behalf or at the request of the other person;

2.0.11. the participant of lottery - the owner of the lottery ticket participating the reached 18 years, voluntarily in lottery;

2.0.12. object of the stimulating lottery - goods (work, service) which sale is followed by the stimulating lottery;

2.0.13. the production commission - the group of physical persons which is exercising control of holding draw of prize fund in production lottery according to conditions and drawing up its results;
