About approval of Rules of carrying out certification of candidates for power accountants

1. Approve the enclosed Rules of carrying out certification of candidates for power accountants.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (to Erzhanov A. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising Vice-Minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of carrying out certification of candidates for power accountants

Chapter 1. General provisions

1. These rules of carrying out certification of candidates for power accountants (further - Rules) are developed according to subitem 13-3) of article 5 of the Law of the Republic of Kazakhstan of January 13, 2012 "About energy saving and increase in energy efficiency", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" (further - the Law) and determine procedure for carrying out certification of candidates for power accountants and rendering the state service "Certification of Candidates for Power Accountants" (further – the state service).

2. In Rules the following concepts are used:

1) certification – the procedure of check of compliance of candidates by authorized body to the Allowing Requirements imposed to power accountants;

2) the certificate on passing of rates of retraining and (or) advanced training of personnel (further – the certificate on passing of rates in the field of energy saving and increase in energy efficiency) - the official document issued by training center, certifying passing of rates of retraining and (or) advanced training of the personnel performing activities in the field of energy saving and increase in energy efficiency;

3) the candidate for power accountants (further – the candidate) – the physical person having the higher technical education and necessary length of service which submitted the application for certification passing;

4) the register of power accountants (further – the Register) – the single list of the power accountants having the right to carrying out energy audit;

5) training center – the subject of entrepreneurship performing activities in the field of retraining and (or) advanced trainings of personnel in the field of energy saving and increase in energy efficiency;

6) authorized body in the field of energy saving and increase in energy efficiency (further – authorized body) – the central executive body performing management in the field of energy saving and increase in energy efficiency;

7) the certificate of the power accountant in the field of energy saving and increase in energy efficiency (further – the certificate of the power accountant) – the document issued by authorized body, and confirming the power accountant's compliance to the imposed allowing requirements (further – Allowing Requirements) approved according to subitem 13-1) of article 5 of the Law of the Republic of Kazakhstan "About energy saving and increases in energy efficiency".

3. The state service appears Committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further – the service provider) according to these rules.

The service provider within three working days from Date of Introduction in action of changes and (or) amendments in these rules sends information on the made changes and (or) additions to Single contact center.".

Chapter 2. Procedure for rendering the state service

4. For receipt of the state service physical persons (further – uslugopoluchatel) direct through the web portal of "the electronic government" (further – the portal) documents, according to the List of the main requirements to rendering the state service according to appendix 2 to these rules (further – the List of the main requirements to rendering the state service).

5. When giving the uslugopoluchatel of all necessary documents by means of the portal – in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service, with indication of the date of receipt of result of the state service.

6. The list of the main requirements to rendering the state service including the characteristic of process, form, content and result of rendering, and also other data taking into account features of rendering the state service are stated in the List of the main requirements to rendering the state service.

7. The employee of office of the service provider performs document registration, in day of their receipt and sends to the head of the service provider which appoints the executive in charge.
