According to subitem 41-20) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and the subitem 1) article 10 of the Law of the Republic of Kazakhstan "About the state services", PRIKAZYVAYU:

1. Approve the enclosed Rules of certification and issue of the certificate of type.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of certification and issue of the certificate of type

Chapter 1. General provisions

1. These rules of certification and issue of the certificate of type (further – Rules) are developed according to subitem 41-20) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for certification and issue of the certificate of type and rendering the state service "Issue of the Certificate like the Civil Aircraft, the Engine and the Air Screw".

2. The terms and determinations used in these rules:

1) developer – the physical person or legal entity responsible for type design;

2) factory tests – finishing sample of the aircraft, the engine and air screw, its characteristics and operational documentation to compliance to requirements of certified basis;

3) the state testing – demonstration of compliance of sample of the civil aircraft, the engine and air screw to airworthiness standards;

4) modification – change of standard design of the aircraft, the engine and air screw;

5) the contractor (manufacturer) – the organization responsible for final assembly of the aircraft, the engine and air screw;

6) the request – the appeal of the applicant to authorized organization for receipt of the certificate of type on sample of the civil aircraft, the engine and air screw;

7) the operator – the physical person or legal entity which is engaged in operation of civil aircrafts or offering the services in this area;

8) operational documentation – documentation regulating flight and technical operation of the aircraft, the engine and air screw, including maintenance, and containing operational restrictions, procedures and recommendations;

9) operating tests – testing of sample of the aircraft, the engine and the air screw in the course of its operation on the earth and in air in various climatic (physical) conditions;
