About approval of Rules of provision of data on the activities by non-governmental organizations and forming of the Database about them

According to subitem 6-1) of article 4-1 of the Law of the Republic of Kazakhstan of April 12, 2005 "About the state social order, grants and awards for non-governmental organizations in the Republic of Kazakhstan" I ORDER:

1. Approve the enclosed Rules of provision of data on the activities by non-governmental organizations and forming of the Database about them (further - the Procedure for provision of data on the activities by non-governmental organizations and forming of the Database about them).

2. To provide to committee on development of languages and social and political work of the Ministry of Culture and sport of the Republic of Kazakhstan:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction of copies of this order for official publication in information system of law of Ad_let and the periodic printing edition on the electronic medium with appendix of the paper copy certified by official stamp for entering into reference control bank of the regulatory legal acts of the Republic of Kazakhstan in electronic form certified by the digital signature of person, representative to sign this order, with appendix of the paper copy certified by official stamp;

3) placement of this order on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister for Culture and Sports of the Republic of Kazakhstan.

4. This order becomes effective since March 1, 2017, except for Items 6, of 7, 12 Procedures for provision of data on the activities by non-governmental organizations and the forming of the Database about them approved by this order which become effective since January 1, 2016.

Rules of provision of data on the activities by non-governmental organizations and forming of the Database about them

1. General provisions

1. These rules of provision of data on the activities by non-governmental organizations and forming of the Database about them (further - Rules) determine procedure for provision of data on the activities by non-governmental organizations and forming of the Database of non-governmental organizations.

2. In these rules the following basic concepts are used:

1) the Database of non-governmental organizations (further - the Database) - the information database created for the purpose of ensuring transparency of activities of non-governmental organizations and informing the public on them and also for use within placement of the state social order, provision of grants and award of awards;

2) non-governmental organization - the non-profit organization (except for political parties, labor unions and religious associations) created by citizens and (or) non-state legal entities on voluntary basis for achievement of common goals by them according to the legislation of the Republic of Kazakhstan.

3. The database is created by authorized body in the field of interaction with non-governmental organizations (further - authorized body) by introduction of data on the non-governmental organizations specified in appendix to these rules in electronic form by means of the web portal.

4. In the Database data on non-governmental organizations through the web portal in the Kazakh and Russian languages are entered:

1) authorized body;

2) non-governmental organizations independently.

5. The entrance on the web portal is performed by means of receipt of login and the password by introduction of data on the instructing specified on the web portal.

6. For entering by authorized body of data on non-governmental organizations into the Database:

1) non-governmental organizations represent data on the activities according to the form specified in appendix to these rules. The information is provided annually till March 31 in authorized body in the Kazakh and Russian languages, through mail on paper and electronic carriers (CD disks or USB flash drives in the Word format);

2) local executive bodies of areas, the cities of republican value, the capital (further - local executive bodies) represent annually till April 10 to authorized body the generalized data on non-governmental organizations (date of registration/re-registration, legal address, founders, heads and their contact information, the registered non-governmental organizations, provision of tax statements for the last accounting period) the corresponding administrative and territorial unit. Data are represented in the Kazakh and Russian languages, through mail on paper and electronic carriers.

7. When obtaining through mail of data on non-governmental organizations the authorized body considers them regarding timeliness, completeness, reliability.

In case of timeliness, completeness, reliability of data on non-governmental organizations the authorized body brings them in the Database, and in case of identification of untimely provision, not completeness and unauthenticity of data on non-governmental organizations - takes the measures specified in Item 12 of these rules.

8. Non-governmental organizations enter in the Database the data specified in appendix to these rules, independently through the web portal. After entering of data into the Database registration of non-governmental organization on the web portal by assignment of registration number of the Database is performed.

9. In case of change of data on non-governmental organizations, non-governmental organizations, no later than ten working days from the date of their change:

1) enter in the Database new data by means of the web portal;

2) inform authorized body through mail on paper and electronic carriers (CD disks or USB flash drives in the Word format).
