1. Approve Regulations on creation and functioning of single window on issue of allowing documents in the field of road transport as a part of the National agency of road transport it (is applied).

2. Appoint the National agency of road transport subordinated to the Ministry of Economy and Infrastructure as the administrative authority responsible for implementation of single window for issue of allowing documents in the field of road transport.

3. To perform financial provision of functioning of single window for the account and within the assignments approved for the budget of the National agency of the road transport subordinated to the Ministry of Economy and Infrastructure.

4. To impose control over the implementation of this Resolution on the Ministry of Economy and Infrastructure.

Regulations on creation and functioning of single window on issue of allowing documents in the field of road transport as a part of the National agency of road transport

I. General provisions

1. The regulations on creation and functioning of single window on issue of allowing documents in the field of road transport as a part of the National agency of road transport (further – single window) are developed according to provisions of the Law on implementation of single window in implementation of business activity No. 161 of July 22, 2011 for the purpose of increase in efficiency and rationalization of the procedure of reception of applications about issue of allowing documents.

2. The national agency of road transport (further – the Agency) provides consideration of the applications about issue of the allowing documents entering competence of the Agency, provided by the List of the allowing documents issued by state bodies - issuers to physical persons and legal entities for implementation of business activity (appendix to the Law on regulation of business activity by permission No. 160 of July 22, 2011), and also the Code of road transport No. 150 of July 17, 2014.

3. Requirements of this provision extend to all applicants who submit applications for issue of the allowing documents entering competence of the Agency.

II. Principles of activities of single window

4. The principles of activities of single window are:

a) ensuring necessary activities for issue of allowing documents according to the regulatory base on single window;

b) respect for equal rights and justice in the course of protection of interests of all physical persons and legal entities performing activities in the field of road transport;

c) ensuring transparency and predictability of the allowing documents necessary for initiation, implementation and/or terminations of business activity;

d) collection of payment for issue of allowing documents only in cases when the amount of payment is directly provided by the law or can be calculated based on the existing normative provisions. In all other cases allowing documents are issued free of charge.

III. Organization of activities of single window

5. Activities of single window will be organized within the Agency which answers for:

a) reception of applications about issue of the allowing documents provided by the List of the allowing documents issued by the state bodies issuers to physical persons and legal entities for implementation of business activity and the Code of road transport No. 150 of July 17, 2014.;

b) check of correctness and completeness of the data containing in statements for issue of allowing documents, including appendices in case of impossibility of use of these other information systems;

c) processing and transfer to other divisions of the Agency of statements for issue of allowing documents according to their duties;

d) issue of allowing documents within the functional competence.

6. Activities of single window are performed according to the working schedule of the Agency.

7. The staff of the Agency - workers of single window carries out the following obligations:

a) advise and inform the applicant on the procedure of giving and consideration of the applications about issue of allowing documents, about documents which shall be provided, on procedure for their approval through single window, and also about the procedure of issue of allowing documents;

b) check compliance of the statement for issue of the allowing document to the requirements provided this by the Provision;

c) establish within the powers assigned to them authenticity and legality of the documents submitted together with the statement for issue of the allowing document;

d) accept or, if necessary, return the application for issue of the allowing document and inform the applicant on cause of failure;

e) process and transfer to other divisions of the Agency of the statement for issue of allowing documents according to duties;

f) provide correctness, integrity and protection of information processed and transmitted through single window, and also bear the personal responsibility according to the current legislation.

IV. Giving and consideration of the application about issue of allowing documents

Section 1. Filing of application

8. The application for issue of allowing documents is submitted as in electronic form, and on paper basis is direct in single window of the Agency and is accepted for consideration only if it is signed by the digital signature or the sign manual of the applicant.

9. The statement for issue of allowing documents is not taken cognizance in the following cases:

a) the statement does not conform to requirements of Item 8 of this provision;

b) the documents attached to it do not correspond to the current legislation;

c) the provided document package is incomplete;
