ORDER OF THE MINISTER OF FINANCE OF THE REPUBLIC OF KAZAKHSTAN

About approval of the List of executive positions of operational investigative divisions of bodies for financial monitoring (service of the economic investigations) which are subject to rotation and Rules of their movement

According to item 4 of article 31 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service" PRIKAZYVAYU:

1. Approve:

1) the List of executive positions of operational investigative divisions of bodies for financial monitoring (service of the economic investigations) which are subject to rotation according to appendix 1 to this order;

2) Rules of movement of staff of operational investigative divisions of bodies for financial monitoring (service of the economic investigations) holding executive positions, which are subject to rotation according to appendix 2 to this order.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Ergozhin of E.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

3. This order becomes effective after ten calendar days after day of its first official publication.

The list of executive positions of operational investigative divisions of bodies of state revenues (service of the economic investigations) which are subject to rotation

In central office of Committee on financial monitoring of the Ministry of Finance of the Republic of Kazakhstan (further - Committee) the chief of the department;

In territorial authorities of Committee:

the deputy manager of Departments of economic investigations on areas, the cities of republican value and the capital supervising law-enforcement activities;

chief of the department.

 

Appendix 2

to the Order of the Minister of Finance of the Republic of Kazakhstan of December 29, 2015 No. 724

Rules of movement of staff of operational investigative divisions of bodies for financial monitoring (service of the economic investigations) holding executive positions, which are subject to rotation

1. These rules of movement of the employees holding executive positions, who are subject to rotation (further - Rules) are developed according to item 4 of article 31 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service".

2. Rotation - the planned movement of the employees holding executive positions, performed for the purpose of optimum use of personnel potential for the benefit of service.

Procedure for movement of staff of operational investigative divisions of bodies for financial monitoring (service of economic investigations)

3. For the purpose of ensuring effective use of professional potential in case of service in operational investigative divisions of bodies for financial monitoring (service of economic investigations) (further - SER) performs rotation of the employees holding executive positions (further - employees).

4. Rotation are subject employees SIR Komiteta and his territorial authorities.

5. Rotation of staff of SER is performed on planned basis according to the decision of the Chairman of Committee once in five years.

6. Rotation of staff of SER is carried out on system basis according to the following schemes:

1) inter-level ("center region", "region center");

2) interregional ("region region");

3) intersectoral ("center center").

7. Organization of events on carrying out rotation of staff of SER, including on designing of the plan for rotation of employees is assigned to personnel service of Committee for five years at least.

8. In the draft of the plan of rotation the following information about the staff of SER is reflected:

1) surname, name, middle name (in case of its availability) the employee of SER;

2) position of the employee of SER, qualification class;

3) the planned rotation term in this executive position;

4) marital status and number of family members;

5) information on need of providing the employee of SER with office premises.

9. The plan of carrying out rotation is approved with the vice-chairman of the Committee supervising law-enforcement activities heads of territorial authorities on financial monitoring of staff of SER and affirms the chairman of Committee.

10. Approval of the plan is performed at least in three months before the period of carrying out rotation of staff of SER.

11. In case of decision making on rotation of staff of SER the result of assessment of their activities (work experience, professional achievements, level of professional competence, advanced training) is considered.

12. The staff of SER included in the plan of rotation studies the plan in three-day time after its approval.

The made decision on rotation is drawn up by the order of the chairman of Committee on staff.

13. In case of the solution of question of appointment of the employee of SER according to the procedure of rotation to other area, the personnel service of relevant organ on financial monitoring not later than 10 calendar days before appointment of the employee of SER sends to relevant organ on financial monitoring (in Committee or territorial authority) in which it is planned appointment of the employee, motivated information on the need for housing.

14. Appointments of the employee of SER to the executive positions of SER performed over and above the plan rotation are not.

15. Rotation of the employee of SER on service to other area is allowed from written consent of the employee, and for the benefit of service - irrespective of stay term to positions and without written consent the employee.

16. The rotation connected with moving to other area are not subject the staff of SER having (who are guardians) children of the disabled people including adopted (adopted) or dependent on which there are aged parents, or the family members who are constantly living with them and having disability 1 and 2 groups.
