The law of the Republic of Tajikistan "About the state fee" establishes and regulates procedure for collection of the state fee from physical persons and legal entities.

Article 1. Basic concepts

In this Law the following concepts are applied:

- the state fee - the obligatory payment levied for making of legally significant actions or issue of documents by representatives on that bodies in the Republic of Tajikistan;

- payers of the state fee - the physical persons and legal entities addressing to the authorized bodies collecting the state fee for making of legally significant actions or issue of documents;

- authorized state body - the central executive body of the government, authorized to exercise control of receipt of taxes and other obligatory payments according to the procedure, established by the legislation of the Republic of Tajikistan;

- the authorized bodies collecting the state fee - bodies which according to this Law, other laws and regulatory legal acts of the Republic of Tajikistan collect the state fee.

Article 2. Legislation of the Republic of Tajikistan on the state fee

The legislation of the Republic of Tajikistan on the state fee is based on the Constitution of the Republic of Tajikistan, consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by the Republic of Tajikistan.

Article 3. Subjects of collection of the state fee

The state fee is collected:

from actions for declaration, statements (claims, cassation and supervising complaints), made in courts of the Republic of Tajikistan;

for making of legally significant actions by judicial authorities, the state authorized body for religion;

for making of notarial actions according to the legislation of the Republic of Tajikistan;

for state registration of acts of civil status according to the legislation of the Republic of Tajikistan;

for consideration and issue of the documents connected with acquisition of citizenship of the Republic of Tajikistan or getting out of citizenship of the Republic of Tajikistan;

for making of other legally significant actions determined by this Law.

Article 4. Amount of the state tax

1. On the cases considered by the Constitutional court of the Republic of Tajikistan, the state fee is collected in the following sizes:

1) from the petition of physical person - in the amount of single indicator for calculations;

2) from representation of state bodies, officials and legal entities - in the amount of tenfold indicator for calculations.

2. On the cases considered in courts of the Republic of Tajikistan, the state fee is collected in the following sizes:

1) from actions for declaration of property nature in case of the claim price:

to 50 indicators for calculations - 3% of the claim price;

over 50 to 100 indicators for calculations - 2% of the claim price;

over 100 to 500 indicators for calculations - 0,7 of % of the claim price;

over 500 indicators for calculations - 0,5 of % of the claim price;

2) from actions for declaration of non-property nature which subject is not subject to assessment:

for physical persons - 5% of indicator for calculations;

for legal entities - in the amount of double indicator for calculations;

3) from actions for declaration about release of property from arrest the duty is determined by the claim price according to Item 1 of this part;

4) from actions for declaration on precontractual disputes - in the amount of single indicator for calculations.
