According to subitems 7) and 8) of Item 2 of article 102 of the Entrepreneurial code of the Republic of Kazakhstan I ORDER:

1. Approve:

1) Rules of compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods, and also information and communication services according to appendix 1 to this order;

2) the list of the domestic processed goods on which costs on their promotion, according to appendix 2 to this order are partially compensated;

3) the list of domestic information and communication services on which costs on their promotion, according to appendix 3 to this order are partially compensated.

2. To provide to committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective, after ten calendar days after day of its first official publication and extends to the relations which arose since January 1, 2016.

Rules of compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods, and also information and communication services on the foreign markets

Chapter 1. General provisions

1. These rules of compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods, and also information and communication services on the foreign markets (further - Rules) are developed according to subitems 7) and 8) of Item 2 of article 102 of the Entrepreneurial code of the Republic of Kazakhstan (further - the Code) and determine procedure for compensation of part of costs to subjects of industrial and innovative activities for promotion of the domestic processed goods, and also information and communication services on the foreign markets.

2. Compensation of part of costs is provided to the subject of industrial and innovative activities making the domestic processed goods, (or to its subsidiary company, the official representative (distributor)/trader selling the made products) either to agricultural production cooperative, or rendering information and communication services (further - the applicant) based on the list of the domestic processed goods and information and communication services on which costs on their promotion and within the means provided on these purposes by the republican budget for the current financial year are partially compensated.

3. Applicants do not use measures of the state support, fifty and more percent of shares (share in the authorized capital) which directly or indirectly belong to the state, national managing holding, national holding, the national company (except for social business corporation, domestic manufacturers of goods (products) of military and space appointment, goods (products) of dual purpose (application), and also the entrepreneurs founded within the agreement on public-private partnership), and also applicants concerning whom liquidation procedures, rehabilitations or bankruptcies, and also activities which it is suspended according to the legislation of the Republic of Kazakhstan in the field of state - private partnership are begun.

4. The applicant submits the application for receipt of compensation of part of costs of subjects of the industrial and innovative activities constituted in form according to appendix 1 to these rules (further - the request) and attaches to it documents, information, basic data, calculations, reasons. The request is submitted to National institute of development in the field of development and promotion of export (further - the Operator) in electronic form through the åxport.gov.kz web portal (further - the web portal) makes sure the digital signature of the first head of the applicant or person fulfilling its duties (in the presence of the supporting document about fulfillment of duties of the first head) of the electronic format "PDF (Portable Document Format)" (Porteybl the Document Format)".

Chapter 2. Procedure for compensation of part of costs of subjects of industrial and innovative activities for promotion of the domestic processed goods, and also information and communication services on the foreign markets

5. Compensation of part of costs of the applicant on promotion of the domestic processed goods is made by the following types:

1) the costs connected with advertizing of goods abroad:

on advertizing abroad through mass media (printing, television, radio, Internet resources), specialized and advertizing magazines and catalogs;

on advertizing abroad in public places (banners, extensions, lightboxes, broadcast of audio-videos, advertizing on the outside surfaces of vehicles), advertizing in salons of public transport;

on production of the audio-videos intended on these purposes and promotional materials, lease of the advertizing structures and surfaces;

2) costs for direct participation in foreign exhibitions, forums, fairs, tenders, the congresses (including in format online):

on payment of the registration fee and additional contributions for participation in the separate closed sessions within the action;

on lease of the stand spaces;

on production (lease), installation, dismantle of exhibition stands, the additional equipment;

on development, design and registration of the stand spaces;

on development, design, transfer and production of advertizing and distributing materials;

on flight by economy class of 2 (two) employees of the applicant participating in exhibitions, forums, fairs, tenders, the congresses;

on accommodation for the term of no more than five days of 2 (two) employees of the applicant participating in exhibitions, forums, fairs, tenders, the congresses in sizes, to the applicant's employees participating in the foreign exhibitions, forums, fairs, tenders, the congresses in US dollars and euro which are not exceeding limiting compensation amounts of expenses on hiring of hotel rooms (in days on one employee) according to Rules of expense recovery for official journeys at the expense of budgetary funds, including in foreign states, approved by the Order of the Government of the Republic of Kazakhstan of May 11, 2018 No. 256;

3) the costs connected with development, transfer into foreign languages and the edition of the specialized catalog for distribution abroad;

4) charges of branches, representations, floor spaces, warehouse and trade shelves abroad:

on payment of lease, the sublease of office rooms;

on payment of lease, the sublease of floor spaces and warehouse;

on payment of lease of trade shelves;

5) costs for holding the procedures connected with registration:

trademarks (brand) abroad;

on electronic trading floors;

6) the costs connected with holding procedures of receipt of permission for use of objects of exclusive rights (franchizing) abroad;

7) the costs connected with passing of foreign certification, accreditation, inspection of the applicant (in case of positive passing of the procedure of certification, accreditation, inspection and availability of the certificate or supporting document);

8) costs for holding the actions connected with procedures of confirmation of conformity of goods to the requirements established by technical regulations, standards including standards of the organization, either to conditions of agreements or confirmation of the right to implementation of sales activity of goods abroad (certificates, permissions, registration certificates), and also the costs incurred on delivery to Item of testing and back trial product samples for passing of the procedure of certification (in the presence of the certificate or the supporting document);

9) the costs connected with the goods delivery and fee on transportation by road, railway, air, sea transport and on the organization of transportations.

6. Compensation of part of costs of exporters on promotion of domestic information and communication services (further - IKU) is made by the following types:

1) the costs connected with advertizing of information and communication services abroad:

on advertizing abroad through social networks, mass media (printing, television, radio, Internet resources), specialized and advertizing magazines and catalogs;

on advertizing abroad in public places (banners, extensions, lightboxes, broadcast of audio-videos, advertizing on the outside surfaces of vehicles), advertizing in salons of public transport;

on production of the audio-videos intended on these purposes and promotional materials, lease of the advertizing structures and surfaces;

2) costs for direct participation in foreign exhibitions, forums, fairs, tenders, congresses:

on payment of the registration fee;

on lease of the stand spaces;

on production (lease), installation, dismantle of exhibition stands, the additional equipment;

on development, design and registration of the stand spaces;

on development, design, transfer and production of advertizing and distributing materials;

on flight by economy class of 2 (two) employees of the subject of industrial and innovative activities participating in exhibitions, forums, fairs, tenders, the congresses;

on accommodation of 2 (two) employees of the subject of industrial and innovative activities participating in exhibitions, forums, fairs, tenders, the congresses in sizes, not exceeding the limiting compensation amounts of expenses on hiring of hotel rooms to the employees of subjects of industrial and innovative activities participating in foreign exhibitions, forums, fairs, tenders, the congresses in US dollars and euro (in days on one employee) specified in appendix 2 to these rules for the term of no more than five days;

3) costs for participation in foreign exhibitions, forums, fairs, tenders, the congresses in format online:

on payment of the registration fee and additional contributions for participation in the separate closed sessions within the action;

on receipt of access to the list of contacts of the main participants at the event;

4) the costs connected with development, transfer into foreign languages and the edition of the specialized catalog for distribution abroad;

5) charges of branches, representations, floor spaces, warehouse and trade shelves abroad:

on payment of lease, the sublease of office rooms;

on payment of lease, the sublease of floor spaces and warehouse;

on payment of lease of trade shelves;

6) the costs connected with passing of foreign certification, accreditation, inspections, and also connected with receipt of copyright of the software, patents of subjects of industrial and innovative activities (in case of positive passing of the procedure of certification, accreditation, inspection and availability of the certificate or supporting document);

7) the costs connected with the organization and carrying out abroad demonstration of domestic information and communication services and developments in the field of information and communication technologies for potential buyers.

7. To the applicant based on the decision of the Interdepartmental commission on compensation of part of costs of the applicant (further - the Commission) which part representatives of authorized body, the interested state bodies and the organizations, National institute of development in the field of development and promotion of export are, and also National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken documentary confirmed costs specified in subitems 1) - 7) Item 5, and also in subitems 1) - 7) Item 6 of these rules, in the following procedure are compensated:

1) to subjects of big business in the amount of 30% of the amount shown to compensation;

2) to subjects of medium business in the amount of 50% of the amount shown to compensation;

3) to small business entities in the amount of 60% of the amount shown to compensation.

Documentary confirmed applicant's costs specified in subitems 8) - 9) Item 5 of these rules, are compensated based on the decision of the Commission, in the following procedure:

1) goods of the upper repartition in the amount of 80% of the amount shown to compensation;
