About settlement of the relations connected with the status of the state registrar

According to Item of 1 part one and the paragraph to the second part four of article 10 of the Law of Ukraine "About state registration of the rights to real estate both their encumbrances" and parts one of article 6 of the Law of Ukraine "About state registration of legal entities, physical persons entrepreneurs and public forming" PRIKAZYVAYU:

1. Approve enclosed:

1) Qualification requirements to the state registrar;

2) Sample of seal of the state registrar;

3) Description of seal of the state registrar.

2. Recognize invalid:

the order of the Ministry of Justice of Ukraine of November 22, 2011 No. 3360/5 "About approval of samples and descriptions of seals of the state registrar of the rights to real estate", registered in the Ministry of Justice of Ukraine on November 22, 2011 for No. 1332/20070 (with changes);

the order of the Ministry of Justice of Ukraine of January 20, 2012 No. 113/5 "About approval of the description of official stamp of the state registrar and descriptions and samples of stamps for putting down by the state registrar of marks in constituent documents when carrying out registration actions", registered in the Ministry of Justice of Ukraine on January 23, 2012 on No. 89/20402 (with changes);

the order of the Ministry of Justice of Ukraine of May 28, 2014 No. 845/5 "About measures for state registration of the rights to lands of agricultural purpose", registered in the Ministry of Justice of Ukraine on May 29, 2014 for No. 568/25345 (with changes).

3. Determine that:

seals with the sample and the description approved by this order are used by the state registrars of the rights to real estate (except cases when such state registrars are notaries), the state registrars of legal entities, physical persons entrepreneurs and public forming;

the seals and stamps made on the samples and descriptions approved by the order of the Ministry of Justice of Ukraine of November 22, 2011 No. 3360/5 "About approval of samples and descriptions of seals of the state registrar of the rights to real estate", registered in the Ministry of Justice of Ukraine on November 22, 2011 for No. 1332/20070, and the order of the Ministry of Justice of Ukraine of January 20, 2012 No. 113/5 "About approval of the description of official stamp of the state registrar and descriptions and samples of stamps for putting down by the state registrar of marks in constituent documents when carrying out registration actions" registered in the Ministry of Justice of Ukraine on January 23, 2012 at No. 89/20402, are used by the bodies of state registration formed by the Ministry of Justice of Ukraine before entry into force of the decision of the Cabinet of Ministers of Ukraine on the termination of provision by such bodies of services in spheres of state registration of the rights to real estate and their encumbrances, legal entities and physical persons entrepreneurs and public forming in the territory of the corresponding administrative and territorial unit, but no later than April 30, 2016, are also liable to destruction according to requirements of the legislation;

the personalized seals of the state registrar of the rights to real estate made by the state and private notaries on the sample and descriptions approved by the order of the Ministry of Justice of Ukraine of November 22, 2011 No. 3360/5 "About approval of samples and descriptions of seals of the state registrar of the rights to real estate" registered in the Ministry of Justice of Ukraine on November 22, 2011 for No. 1332/20070, are liable to destruction according to the procedure, provided for destruction of seals of the private notary.

4. To department of the civil, financial legislation and legislation concerning land relations () submit A.N. Ferens this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

5. This order becomes effective from the date of its official publication.

6. To impose control over the implementation of this order on the First Deputy Minister Sevostyanov N. I.

Qualification requirements to the state registrar

These Qualification requirements developed according to the Laws of Ukraine "About state registration of the corporeal rights to real estate and their encumbrances" and "About state registration of legal entities, physical persons - entrepreneurs and public forming", extend to the state registrars of the rights to real estate and the state registrars of the legal entities, physical persons entrepreneurs and public forming consisting in employment relationships with the subject of state registration (further - the state registrars).

For the state registrars, except the requirements provided by the Laws of Ukraine "About service in local government bodies" "About public service" and other laws of Ukraine, the following requirements are established:

length of service in the sphere of the right at least three years either as the state registrar or on other position which provides accomplishment of functions of the state registrar (further - position of the state registrar), at least one year;

successful passing of special check of activities of the state registrar in the State register of the corporeal rights to real estate and the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (for the state registrars concerning which according to the legislation the corresponding special inspection was carried out);
