About approval of Licensed conditions of implementation of educational activities 

According to Item 7, parts two of article 9 of the Law of Ukraine "About licensing of types of economic activity" the Cabinet of Ministers of Ukraine decides 6 parts one of Article:

1. Approve Licensed conditions of implementation of educational activities which are applied.

2. Determine that:

The paragraph two is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 10.05.2018 No. 347;

training of specialists of educational and qualification level of the junior specialist according to programs of the higher education - according to requirements for training of job seekers of degree of the junior bachelor, and specialists of educational and qualification level of the specialist - requirements for training of job seekers of degree of the master.

to educational institutions which have the license for implementation of educational activities in the field of the higher education according to their statement the license with installation of the increased licensed amount taking into account training terms on condition of observance of requirements of the Licensed conditions approved by Item 1 of this resolution without supply of additional materials can be renewed;

personnel requirements for ensuring implementation of educational activities for the institutions of higher education having the license for educational activities become effective since September 1, 2018. To the specified term staffing of educational activities is performed according to the Licensed conditions of implementation of educational activities approved by the resolution of the Cabinet of Ministers of Ukraine of December 30, 2015 No. 1187, in edition of December 30, 2015;

requirements to the head of project team about availability at him at least one Article in the periodical which is included in one of scientometric bases in particular of Scopus or Web of Science Core Collection, become effective in three years after entry into force of this resolution;

personnel requirements for the number of members of group of providing which is sufficient if no more than 30 job seekers of the higher education of all levels, rates and forms of education on the corresponding specialty are the share of one her member, become effective since September 1, 2019;

educational institutions which perform training of foreigners and stateless persons and intend to stop further implementation of such preparation complete educational activities for training of foreigners and persons without citizenship before completion of cycle of preparation;

requirements for ownership of English at the B2 level according to the all-European recommendations about language education or the qualification documents (the diploma about the higher education, scientific degree) connected with use of the specified language by one of members of project team when implementing training of foreigners and stateless persons become effective since January 1, 2020;

educational institutions which perform training of foreigners and stateless persons and intend to continue to perform such preparation shall undergo till December 31, 2019 the procedure of licensing in the procedure established by the legislation and according to requirements of the Licensed conditions approved by Item 1 of this resolution;

requirements for availability of training rooms to persons with disability and other handicapped national groups become effective when implementing educational activities in three years after entry into force of this resolution for educational institutions which already have the license for implementation of educational activities. The status report of preparation for accomplishment of the Licensed conditions approved by Item 1 of this resolution on availability of training rooms to persons with disability and other handicapped national groups moves in body of licensing in six months after entry into force of this resolution;

the bases for provision to organizations of preschool and general secondary education of property rights on real estate on the conditions provided for educational institutions are the constituent documents registered in accordance with the established procedure in which the purpose of activities of such institutions specifies implementation of educational activities.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Licensed conditions of implementation of educational activities

General provisions

1. These Licensed conditions are developed according to the Laws of Ukraine "About education", "About the higher education", "About vocational training", "About general secondary education", "About preschool education" and "About licensing of types of economic activity".

2. In these Licensed conditions terms are used in such value:

1) group of ensuring specialty - group pedagogical, scientific and pedagogical and/or scientists for whom the educational institution is principle place of employment and which are responsible for accomplishment of educational programs in the specialty at the certain levels of the higher and professional prehigher education, post-qualifying education for persons with the higher education and persons with the educational and qualification level of the junior specialist, personally participate in educational process and conforming to the qualification requirements determined by these Licensed conditions;

2) treat organizations of education:

institution of higher education;

the scientific institution performing training of job seekers of the higher education at the second (master) and/or third (образовательно-научном/образовательно-творческом) the level of the higher education;

post-qualifying education institution;

institution of professional prehigher education;

institution of professional (professional) education;

institution of general secondary education;

institution of preschool education;

3) dual training - system of the organization of educational process in which essential part of process is performed on workplaces with compensation to person who studies;

4) qualification according to specialty - the qualification of person supported by the education document or academic degree on the corresponding specialty or confirmed with scientific, scientific and pedagogical, pedagogical or other professional activity on the corresponding specialty by at least than seven types or the results listed in Item 30 of these licensed conditions;

5) licensed amount in the field of the highest or post-qualifying education for persons with the higher education - the maximum number of persons determined by the license which the educational institution can provide at the same time the higher education on the corresponding specialty of certain level of the higher education or on the corresponding specialty (the program, industry of knowledge) in the field of post-qualifying education for persons with the higher education;

6) licensed amount in the field of complete general secondary education - the maximum number of persons determined by the license to which the institution of general secondary education or structural division of educational institution can provide at the same time education at the certain level of complete general secondary education;

7) licensed amount in the field of professional education (vocational training) - the maximum number of persons determined by the license which the educational institution can provide at the same time professional (professional) education by certain profession on each training course or group of the related professions carried to one class (subclass, group) of classification group of the National qualifier of professions of group of companies 003: 2010 (in case of licensing of the educational activities performed on production), or post-qualifying education;

8) licensed amount in the field of professional prehigher education – the maximum number of persons determined by the license which the educational institution can provide at the same time professional prehigher education on the corresponding specialty at the level of professional prehigher education or post-qualifying education;

9) the place of implementation of educational activities - object (the room, the building, the parcel of land and/or the territory, and/or their set) located at certain address within which educational activities for the corresponding specialty (profession) or group of the related professions carried to one class (subclass, group) of classification group of the National qualifier of professions of group of companies 003:2010 at the certain level (levels) of the higher professional prehigher or professional (professional) education (except venues of practical preparation are performed, including during dual training) and in the field of post-qualifying education (except advanced training of the worker in the place of its work), complete cycle of educational process at the certain level (levels) of complete general secondary education, activities at the level of preschool education (except implementation of educational activities for the residence of the child);

10) educational activities in the field of the higher education - activities of higher educational institutions and scientific institutions which is performed for the purpose of ensuring receipt of the higher education on corresponding at the certain levels of the higher education (initial level (short cycle) of the higher education, the first (baccalaureate) level, the second (master) level, third (образовательно-научном/образовательно-творческом) level) higher educational institutions of foreign states or their structural divisions (branches), formed and functioning in the territory of Ukraine, irrespective of type of such activities;

11) educational activities in the field of preschool education - activities of organizations of preschool education irrespective of subordination, type and pattern of ownership, physical person entrepreneur or structural division of the legal entity of the private or public law which core activity are the educational activities for the level of preschool education directed to the organizations of providing and realization of educational process;

12) educational activities in the field of post-qualifying education - activities higher educational, professional the prehigher, post-qualifying, professional (professional) education which is performed at the certain levels of the higher, professional prehigher and professional (professional) education and include specialization, retraining, advanced training, training, internship, medical residency; educational activities in the field of post-qualifying education which obligation is provided by the laws are subject to licensing;

13) educational activities in the field of complete general secondary education - the activities of organizations of general secondary education irrespective of type and pattern of ownership or structural division of other educational institution directed to the organization of providing and realization of educational process for levels of complete general secondary education (primary education, basic secondary education, profile secondary education);

14) educational activities in the field of professional (professional) education - activities of organizations of professional (professional) education irrespective of type and pattern of ownership which is performed for the purpose of preparation (including primary professional training and professional training) job seekers of professional (professional) education, retraining and/or increase in their qualification by professions which are included in the National qualifier of professions of group of companies 003: 2010, at the levels of professional (professional) education (the first (initial) level, the second (basic) level, at the third (highest) level) organizations of professional (professional) education of foreign states or their structural divisions (branches), formed and functioning in the territory of Ukraine, irrespective of type of such activities;

15) educational activities in the field of professional prehigher education - activities of organizations of professional prehigher education which are carried out for the purpose of training of job seekers of professional prehigher education on the corresponding specialties at the level of professional prehigher education; institutions of professional prehigher education of foreign states or their structural divisions (branches), formed and functioning in the territory of Ukraine, irrespective of type of such activities;

16) project team - the group determined by the order of the head of organization of education pedagogical, scientific and pedagogical and/or the scientists responsible for the beginning of educational activities in the specialty at the certain level of the higher education, professional prehigher education and in the field of post-qualifying education for persons with the higher education and meeting the qualification requirements determined by these Licensed conditions.

Other terms are used in the value determined by the Laws of Ukraine "About education", "About the higher education", "About vocational training", "About general secondary education", "About preschool education", "About licensing of types of economic activity".

3. When licensing the capability of educational institution is established to perform educational activities according to the requirements established by these Licensed conditions:

in the field of the higher education - at the certain level of the higher education on the corresponding specialty;

in the field of post-qualifying education - on the corresponding specialty within industry of knowledge, programs, industries of knowledge, professions, groups of the related professions carried to one class (subclass, group) of classification group;

in the field of professional prehigher education - on the corresponding specialty at the level of professional prehigher education;

in the field of professional (professional) education - by separate professions or group of the related professions carried to one class (subclass, group) of classification group of the National qualifier of professions of group of companies 003: 2010, at the certain level of professional (professional) education;

in the field of complete general secondary education - on levels of complete general secondary education;

in the field of preschool education - on the level of preschool education.

4. By results of financial and economic activities of educational institution educational activities shall be main type of economic activity. For scientific institutions and organizations of the highest and post-qualifying education for persons with the higher education activities in the field of research and development can be core activity. The specified regulation does not extend to the company which division performs professional training of skilled workers.

5. Requirements of these Licensed conditions concern each place of implementation of educational activities.

6. In the field of complete general secondary education educational activities in organizations of professional (professional) education in which acceptance arriving on the basis of basic secondary education provides the subsequent receipt of profile secondary education and receipt of the relevant document on complete general secondary education are subject to licensing.

In the field of complete general secondary education educational activities in the organizations of education performing preparation on the level of professional prehigher education in which acceptance arriving on the basis of basic secondary education provides the subsequent receipt of complete general secondary education and receipt of the relevant document on complete general secondary education are subject to licensing.

7. The licensee performs educational activities in spheres of the higher education, post-qualifying education, professional (professional) education, professional prehigher education, complete general secondary education within licensed amount.

Exceeding of licensed amount is allowed in case of continuation of training of persons who did break in study on certain legislation to the reasons, and also in cases, stipulated by the legislation, or by a court decision.

8. Implementation of educational activities by higher education institutions according to programs of the academic mobility which do not provide issue of separate education documents of the state sample is not subject to licensing.

9. The beginning of implementation of educational activities in the field of the higher education by educational institution on new specialty, other levels of the higher education, for the purpose of training of foreigners and stateless persons in the specialty and increase in licensed amount is expansion of implementation of educational activities in the field of the higher education and is subject to licensing in accordance with the established procedure.

The beginning of implementation of educational activities in the field of the higher education by the isolated structural division (branch) of organization of education on new specialty, other levels of the higher education, for the purpose of training of foreigners and stateless persons in the specialty and increase in licensed amount is expansion of implementation of educational activities in the field of the higher education and is subject to licensing in accordance with the established procedure.

The termination of implementation of part of educational activities for certain specialty, certain levels in certain place of implementation of educational activities (the isolated structural division (branch), on training of foreigners and stateless persons in the specialty and reduction of licensed amount is narrowing of implementation of educational activities in the field of the higher education. The decision on narrowing of implementation of educational activities is made by body of licensing based on the statement of educational institution without submission of other documents.

10. The beginning of implementation of educational activities in the field of professional prehigher education by educational institution on new specialty, for the purpose of training of foreigners and stateless persons in the specialty and increase in licensed amount is expansion of implementation of educational activities in the field of professional prehigher education and is subject to licensing in accordance with the established procedure.

The beginning of implementation of educational activities in the field of professional prehigher education by the isolated structural division (branch) of organization of education on new specialty, for the purpose of training of foreigners and stateless persons in the specialty and increase in licensed amount is expansion of implementation of educational activities in the field of professional prehigher education and is subject to licensing in accordance with the established procedure.

The termination of implementation of part of educational activities for certain specialty, in certain place of implementation of educational activities (the isolated structural division (branch), on training of foreigners and stateless persons and reduction of licensed amount is narrowing of implementation of educational activities in the field of professional prehigher education. The decision on narrowing of implementation of educational activities is made by body of licensing based on the statement of educational institution without submission of other documents.

11. The beginning of implementation of educational activities by institution of professional (professional) education by new profession, preparation types, classes (subclasses, groups) of classification groups of professions, other levels of professional (professional) education, for the purpose of training of foreigners and stateless persons and increase in licensed amount is expansion of implementation of educational activities in the field of professional (vocational training) and is subject to licensing in accordance with the established procedure.
