Procedure for maintaining the state town-planning inventory and monitoring of objects of town-planning activities

1. General provisions

1. The procedure for maintaining the state town-planning inventory and monitoring of objects of town-planning activities (further - the Procedure) is developed for the purpose of implementation of article 12 of the Town-planning code of the Republic of Tajikistan.

2. The state town-planning inventory and monitoring of objects of town-planning activities (further - the town-planning inventory and monitoring) is performed according to the Town-planning code of the Republic of Tajikistan, this Procedure and other regulatory legal acts of the Republic of Tajikistan.

The purpose of maintaining the town-planning inventory and monitoring is providing relevant organs, physical persons and legal entities with reliable information about living environment, its expected changes, including about restrictions of use of the territories and real estate objects in town planning, the other information necessary for town-planning, investing, land management and other economic activity, assessment and the taxation of real estate objects.

2. Functions of the bodies providing maintaining the town-planning inventory

4. The committee on architecture and construction under the Government of the Republic of Tajikistan is the state customer of works on maintaining single system of the town-planning inventory and performs:

a) development and approval of normative and methodical documents on single system of maintaining the town-planning inventory, including collection, processing, registration, storage and updating of information resources, and also provision of data to users;

- single technique of conducting monitoring - observation, assessment and forecasting of condition of objects of town-planning activities;

b) ensuring development and program implementation of the town-planning inventory and projects of creation and operation of its automated system;

c) preparation of suggestions for improvement of the legislation on maintaining the town-planning inventory;

d) the organization of exchange of information, containing in the town-planning inventory, and also in the land state cadastre and other information systems on the basis of the agreements signed with relevant organs of the executive authority and determination of rules of submission of initial documents for inclusion in the town-planning inventory;

e) the organization of provision of data of the town-planning inventory to users, including the information on objects of state-owned property provided free of charge to public authorities;

e) determine it agrees the legislation of the Republic of Tajikistan of the amount of payment for rendering services in provision of data of the town-planning inventory and procedure for use of the means arriving for rendering such services;

g) control of observance of maintaining single system of the town-planning inventory and monitoring;

h) the organization of preparation and retraining of specialists for maintaining the state town-planning inventory and monitoring;

i) realization of the rights of the order and use of information resources, technologies and program technical means of the town-planning inventory and monitoring within the requirements established by the legislation of the Republic of Tajikistan.

5. Executive bodies of the government of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, cities and areas, self-government institutions of settlements and villages, and also local authorities of architecture and town planning within the powers provide:

a) financing of works and execution of functions of the state customer on maintaining the town-planning inventory and monitoring concerning the territory;

b) creation in accordance with the established procedure structures of the town-planning inventory of local government as divisions of local authorities of architecture and town planning and (or) the independent organization under this body;

c) provision in the procedure established by them to users of data of the town-planning inventory of the respective area;

d) determination in accordance with the established procedure amount of payment for rendering services in provision of data of the town-planning inventory of the respective area and procedure for use of means;

e) control of observance of maintaining on single system of the town-planning inventory in local executive body of the government;

i) the organization of preparation and retraining of specialists for maintaining the town-planning inventory;

j) realization of the rights of the order and use of information resources, technologies and program technical means of the town-planning inventory of the local executive authority within the requirements established by the legislation of the Republic of Tajikistan.

7. The town-planning inventory of each level contains data on the following objects of town-planning activities, in the corresponding territory: the territories in general, parts of the territory, zones, objects of engineering, transport and social infrastructures, other real estate objects, including objects of town-planning activities of special regulation.

8. The town-planning inventory of each level includes the following data:
