About the Procedure for enforcement of technical regulations of the Customs union in the Kyrgyz Republic

According to Item 52 of appendix № 1 to the Protocol of May 8, 2015 on conditions and transitional provisions on application by the Kyrgyz Republic of the Agreement on the Eurasian Economic Union of May 29, 2014, the separate international treaties entering the right of the Eurasian Economic Union, and acts of bodies of the Eurasian Economic Union in connection with accession of the Kyrgyz Republic to the Agreement on the Eurasian Economic Union of May 29, 2014, Item 2 of article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 11 of appendix №2 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Board of the Eurasian economic commission decided:

1. Approve the enclosed Procedure for enforcement of technical regulations of the Customs union in the Kyrgyz Republic.

2. This Decision becomes effective after 30 calendar days from the date of its official publication and extends to the legal relationship arising since February 12, 2016.

Procedure for enforcement of technical regulations of the Customs union in the Kyrgyz Republic

I. The technical regulations of the Customs union specified in paragraph one of Item 50 of appendix №1 to the Protocol of May 8, 2015 on conditions and transitional provisions on application by the Kyrgyz Republic of the Agreement on the Eurasian Economic Union of May 29, 2014, the separate international treaties entering the right of the Eurasian Economic Union, and acts of bodies of the Eurasian Economic Union in connection with accession of the Kyrgyz Republic to the Agreement on the Eurasian Economic Union of May 29, 2014

Establish the following procedure for application for technical regulations of the Customs union:

"About safety of high-speed rail transport" (TR CU 002/2011) accepted by the Decision of the Commission of the Customs union of July 15, 2011 №710;

"About safety of the low-voltage equipment" (TR CU 004/2011) accepted by the Decision of the Commission of the Customs union of August 16, 2011 № 768;

"About safety of perfumery and cosmetic products" (TR CU 009/2011) accepted by the Decision of the Commission of the Customs union of September 23, 2011 №799;

"Safety of highways" (TR CU 014/2011) accepted by the Decision of the Commission of the Customs union of October 18, 2011 №827;

"About safety of grain" (TR CU 015/2011) accepted by the Decision of the Commission of the Customs union of December 9, 2011 №874;

"About safety of the devices using gaseous fuel" (TR CU 016/2011) accepted by the Decision of the Commission of the Customs union of December 9, 2011 № 875;

"About safety of wheel vehicles" (TR CU 018/2011) accepted by the Decision of the Commission of the Customs union of December 9, 2011 № 877;

"About safety of the equipment working under excessive pressure" (TR CU 032/2013) accepted by the Decision of Council of the Eurasian economic commission of July 2, 2013 №41:

the documents on assessment of conformity to the mandatory requirements established by the legislation of the Kyrgyz Republic issued or accepted concerning products which are object of technical regulation of the specified technical regulations of the Customs union till February 12, 2016 are valid before the termination of term of their action, but no later than February 12, 2018.

Since February 12, 2016 issue or adoption of documents on assessment of conformity of products to the mandatory requirements which are earlier established by the legislation of the Kyrgyz Republic is not allowed;

till February 12, 2018 production and release into the stream of commerce of products which are object of technical regulation of the specified technical regulations according to the mandatory requirements established by the legislation of the Kyrgyz Republic in the presence of the documents on assessment of conformity specified in the paragraph the fourteenth this Section are allowed.

till February 12, 2017 production and release into the stream of commerce in the territory of the Kyrgyz Republic of products which are object of technical regulation of the specified technical regulations, the obligatory assessment of conformity which was not subject till February 12, 2016 to the mandatory requirements established by the legislation of the Kyrgyz Republic without documents on obligatory assessment of conformity and not marked national mark of conformity are allowed;
