About some questions of passing of public service

For the purpose of implementation of the Law of the Republic of Kazakhstan "About public service of the Republic of Kazakhstan" POSTANOVLYAYU:

1. Approve enclosed:

1) ceased to be valid according to the Presidential decree of the Republic of Kazakhstan of 16.08.2017 No. 532;

2) Rules and terms of evaluating activities of government employees;

3) ceased to be valid according to the Presidential decree of the Republic of Kazakhstan of 05.05.2018 No. 681;

4) Rules and terms of carrying out rotation, category and position of the government employees who are subject to rotation;

5) Rules of imposing of authority punishment on government employees;

6) Rules of occupation of vacant or temporarily vacant managerial state positions of the case "B" according to the procedure of the translation without carrying out tender.

7) ceased to be valid according to the Presidential decree of the Republic of Kazakhstan of 05.05.2018 No. 681.

2. Recognize invalid some presidential decrees of the Republic of Kazakhstan according to appendix to this Decree.

3. This Decree becomes effective since January 1, 2016 and is subject to official publication.

Rules and terms of evaluating activities of government employees

1. These rules and terms of evaluating activities of government employees (further – Rules) are developed according to Item 1 of article 33 of the Law of the Republic of Kazakhstan "About public service of the Republic of Kazakhstan" and determine procedure and terms of evaluating activities of government employees.

2. Assessment of activities of government employees is carried out for the purpose of determination of efficiency and quality of their work.

3. Results of assessment of activities of government employees are the basis for decision making on payment of bonuses, encouragement, training, rotation, lowering in the state position or to dismissal.

Chapter 1. Assessment of activities of political government employees

4. Assessment of activities of political government employees is carried out according to the procedure, determined by Administration of the President of the Republic of Kazakhstan.

Chapter 2. Assessment of activities of administrative government employees of the case "A"

5. Assessment of activities of administrative government employees of the case "A" (further - the serving cases "A") is carried out by results of their activities on specific position following the results of year (annual assessment) no later than January 20 of the year following for estimated year.

Assessment of the serving case "A" is not carried out in cases if the term of its stay on specific position constitutes less than three months.

6. The serving cases "A" being on social vacation pass assessment of activities of employees of the case "A" according to the procedure, determined by the Technique of assessment of the activities of administrative government employees of the case "A" approved by authorized body.

7. Assessment of activities of the serving case "A" is carried out by the official (body) having the right of appointment to the state position and releases from the state position of the serving case "A" (further – the authorized person), based on the Technique of assessment of the activities of administrative government employees of the case "A" approved by authorized body.

8. No. 570 is excluded according to the Presidential decree of the Republic of Kazakhstan of 13.06.2024

9. Preparation for evaluating activities of employees of the case "A" is performed by service of personnel management of state body (personnel service).

10. Preparation for evaluating activities of employees of the case "A" is performed within fifteen working days before the term specified in Item 5 of these rules and includes preparation of required materials for evaluating activities of employees of the case "A" and determination of the schedule of evaluating activities of employees of the case "A".

11. For evaluating activities of employees of the case "A" treat required materials:

1) information on activities of structural divisions of state bodies, their subordinated organizations or state bodies which activities supervise serving cases "A";

2) the data characterizing activities of the serving case "A" in the estimated period.

12. The serving cases "A" before evaluating can provide the additional information concerning their professional level and personal qualities in state body.

13. No. 817 is excluded according to the Presidential decree of the Republic of Kazakhstan of 17.03.2025

14. For fixing of results of assessment of activities of employees of the case "A" the estimative leaf in the form approved by authorized body for public service is used.

15. Results of assessment of activities of employees of the case "A" are exposed on scale with the following values: "unsatisfactorily", "well", "effectively".

16. No. 77 is excluded according to the Presidential decree of the Republic of Kazakhstan of 31.12.2022

17. The estimated employee of the case "A" receives results of the assessment in information system, and also in the E-Kyzmet mobile application.

Acquaintance of the dismissed persons with results of assessment is performed within a month, following the accounting period, by means of the direction of the registered mail with the notification on its delivery of either the telephone message, or the telegram, or the text message on subscriber number of cellular communication or on the e-mail address or with use of other means of communication providing fixing of the notice or challenge.

18. The state body within three working days from the date of completion of assessment sends to authorized body for public service:

1) copies of the following documents of the estimated employees of the case "A":

annual agreements of employees of the case "A";

estimative sheets;

responses about activities of employees of the case "A";

2) information on employees of the case "A" concerning whom assessment, with indication of the reasons is not carried out.

19. The response about activities of the serving case "A" is signed by the authorized person.

20. No. 495 is excluded according to the Presidential decree of the Republic of Kazakhstan of 18.01.2021

21. The authorized body for public service performs the analysis of annual assessment of employees of the case "A" and no later than March 1 brings them in working body of the National commission on personnel policy in case of the President of the Republic of Kazakhstan (further - the National commission).

22. In case of disagreement with results of assessment of activities the employee of the case "A" can file the corresponding petition in the National commission within ten working days from the date of acquaintance with results of assessment of its activities.

23. The working body of the National commission submits materials of annual assessment for consideration of the National commission.

24. The national commission following the results of consideration of the materials provided by working body, and, in case of need, holding interview with the employee of the case "A" accepts one of the following decisions:

1) corresponds to post;

2) does not correspond to post.
