About approval of the Regulations on councils on ethics of the Agency of the Republic of Kazakhstan for public service in areas, the cities of republican value, the capital

According to article 5 of the Law of the Republic of Kazakhstan of November 23, 2015 "About public service of the Republic of Kazakhstan" POSTANOVLYAYU:

1. Approve the enclosed Regulations on councils on ethics of the Agency of the Republic of Kazakhstan for public service in areas, the cities of republican value, the capital.

2. Recognize invalid some presidential decrees of the Republic of Kazakhstan according to appendix to this Decree.

3. This Decree becomes effective since January 1, 2016.

Regulations on councils on ethics of the Agency of the Republic of Kazakhstan for public service in areas, the cities of republican value, the capital

This Provision determines the status, powers and the organization of activities of councils on ethics of the Agency of the Republic of Kazakhstan for public service in areas, the cities of republican value, the capital.

Chapter 1. General provisions

1. Councils on ethics of the Agency of the Republic of Kazakhstan for public service (further - the Agency) in areas, the cities of republican value, the capital (further - Council for ethics) are collegiate organs of the Agency.

2. Council on ethics performs the activities according to the laws of the Republic of Kazakhstan of November 23, 2015 "About public service of the Republic of Kazakhstan", of November 18, 2015 "About anti-corruption", and is guided this Provision, other regulatory legal acts by the principles of legality, objectivity and justice, ethics, accounting of public opinion and publicity, application of measures of the prevention of corruption.

3. Working body of Council for ethics is the secretariat which is determined by the chief of staff of the Agency from among structural divisions of territorial authority of the Agency.

4. The regulations of work of Council for ethics affirm the chairman of the Agency.

Chapter 2. Main objectives, functions and powers of Council for ethics

5. The main objectives of Council for ethics are:

1) development of the measures directed to the prevention of corruption and prevention of violations of regulations of office ethics, including the minor offenses discrediting public service;

2) taking measures to ensuring increase in level of responsibility of government employees in respect for office ethics;

3) development of recommendations and offers on coordination of activities of representatives for ethics and interactions with the disciplinary commissions of state bodies.

6. According to the main objectives Council for ethics performs the following functions:

1) consideration of results of the analysis of corruption risks;

2) consideration of results of work of state bodies on prevention of violations of the law about public service and to anti-corruption;

3) consideration of results of activities of representatives for ethics when implementing monitoring and control of respect for office ethics;

4) consideration of results of activities of the disciplinary commissions of state bodies on the basis of results of the analysis of disciplinary practice;

5) development of recommendations and offers on enhancement of forms and methods of the prevention of corruption;

6) consideration of recommendations of the Commission in case of the President of the Republic of Kazakhstan concerning anti-corruption, the National commission on personnel policy, the Agencies;

7) consideration of disciplinary cases in the relation of administrative government employees of the categories C-O-1, C-O-2, C-R-l, C-R-2, D-l, D-2, D-O-l, D-O-2, D-R-1, D-R-2, E-1, E-2, E-R-l, E-R-2, and also representatives for ethics holding independent positions in the offices of akims of areas, cities of republican value, the capital (further - employees) which allowed violation of the regulations of office ethics including which made the minor offenses discrediting public service. 

7. Council on ethics within the competence has the right:

To hear 1) at the meetings heads and other officials of local executive bodies and territorial subdivisions of the central state bodies, representatives for ethics;

To request 2) from state bodies and the organizations the documents, materials and information necessary for accomplishment of the tasks facing it;

3) to request from explanations at the employees specified in the subitem 7) of Item 6 of this provision and other persons;

4) to make offers to officials, the given right of appointment to positions and releases from positions of the employees specified in the subitem 7) of Item 6 of this provision about conducting office investigations on the facts of violation by employees of regulations of office ethics, including on the minor offenses discrediting public service;

To bring 5) to akims of areas, cities of republican value, the capital, other administrative and territorial units, heads of the executive bodies financed from the local budget, and the territorial subdivisions of the central state bodies of the recommendation and the offer on strengthening of office discipline, implementation of measures directed to the prevention of corruption and prevention of violations of regulations of office ethics;

To submit 6) for consideration to officials, the given right of appointment to positions and releases from positions of the employees specified in the subitem 7) of Item 6 of this provision, the recommendation of attraction them to disciplinary responsibility for violation of regulations of office ethics, including for making of the minor offenses discrediting public service;

To bring 7) to higher state bodies or officials of the offer on consideration of responsibility of the officials who unreasonably did not perform the recommendation of Council for ethics;

8) to attract to making expert opinions and specialists, employees of state bodies.

Chapter 3. Organization of activities of Council for ethics

8. The chairman of the board on ethics is on position the head of territorial authority of the Agency appointed to position and dismissed by the chairman of the Agency.
