About approval of form, Rules of maintaining and storage of service records

According to the subitem 25) Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015 PRIKAZYVAYU:

1. Approve:

1) form of the service record according to appendix 1 to this order;

2) Rules of maintaining and storage of service records according to appendix 2 to this order.

2. To provide to department of work and social partnership of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.

4. This order becomes effective since January 1, 2016 and is subject to official publication.

Rules of maintaining and storage of service records

1. General provisions

1. These rules of maintaining and storage of service records (further - Rules) are developed according to the subitem 25) of Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015 (further - the Code) and determine procedure for maintaining and storage of service records.

2. In these rules the following concepts are used:

1) the service record - the document containing data on labor activity of the worker;

2) acts of the employer - orders, orders, instructions, provisions, rules of the labor schedule published by the employer;

3) employer - physical person or legal entity with which the worker consists in employment relationships;

4) the insert - integral part of the service record which is drawn up and conducted by the employer in the same order, as the service record.

2. Procedure for maintaining and storage of service records

3. The service record (in case of its availability) is kept by the employer for confirmation of labor activity of the worker and consists of two Sections "Data on Work" and "Data on Rewardings and Encouragement".

4. Are brought in the service record:

1) information about the worker: surname, name, middle name (in case of its availability), birth date, education, qualification, specialty;

2) data on work: employment, transfer to other work, termination of the employment contract;

3) data on rewardings and encouragement.

Records about application of authority punishments concerning the worker in the service record are not made.

5. All employment records about dates of execution of an employment agreement or its termination, transfer to other work, and also about rewardings and encouragement are made by the Arab figures (number and month in two-digit figures, year is specified completely) and introduced by the first head or the official authorized by it after the publication of the relevant act of the employer and correspond to its text. In case of the termination of the employment contract the employment records are made no later than day of the termination of the employment contract.

6. The information about the worker registers on the first page of the service record and is certified by the first head or the official authorized by it, seal of the organization (in case of its availability).

The surname, name, middle name (in case of its availability) (completely without reducings) and birth date are specified based on identity documents.

Education, specialty and qualification are specified based on education documents.

7. In the Section "Data on Work" separately in the form of heading full name of the employer is specified.

8. Records about the name of position to which the worker is accepted are made based on the employment contract, the act of the employer, the staff list of the organization.

9. If for operating time of the worker the name of the employer changes, then in column 3 of the Section "Data on Work" the corresponding record is separately made, and in column 4 of the Section "Data on Work" the basis of change of the name is specified (date and number of the certificate of state registration (re-registration) of the legal entity or the identity certificate of physical person - employer).

10. The following data are made to the section "Data on Rewardings and Encouragement":

1) about rewardings with the state awards of the Republic of Kazakhstan and assignment of honorary titles;

2) about rewardings with certificates of honor, breastplates, diplomas;

3) about encouragement for progress in work, according to labor, collective agreements and acts of the employer.

11. In case of identification in the service record of the wrong or inexact record of data on labor activity of the worker of correction are made by the employer who made the corresponding record.

12. If the employer - the legal entity, made the wrong or inexact record, is reorganized, corrections are made by his legal successor.
