About cooperation

The national academy of Sciences of Belarus, the Belarusian republican fund of basic researches, National academy of Sciences of Azerbaijan, Fund of development of science in case of the President of the Azerbaijan Republic which are hereinafter referred to as "Party"

being guided by mutual desire to strengthen the comprehensive relations and to develop traditional friendly ties between the people of two states,

proceeding from interests of development of science in the Republic of Belarus and in the Azerbaijan Republic,

considering mutual interest of the Parties in implementation of joint scientific and scientific and technical programs and projects, agreed as follows:

Article 1

Subject of this agreement is assistance to development of cooperation between research teams and researchers of the Republic of Belarus and the Azerbaijan Republic for the purpose of support of joint scientific research in the areas which are of interest to both Parties.

Article 2

2.1. Within the Agreement of the Party perform cooperation in the form of accomplishment:

– initiative research and innovative projects which will be carried out together with groups of the Belarusian and Azerbaijani scientists and researchers;

– joint Belarusian-Azerbaijani mutual projects of fundamental, applied and innovative nature within joint tenders of the Belarusian republican fund of basic researches and Fund of development of science in case of the President of the Azerbaijan Republic;

– the organizations and holding joint Belarusian-Azerbaijani scientific actions (congresses, conferences, the seminars, etc.) held in the territory of the Republic of Belarus and the Azerbaijan Republic.

2.2. Other forms of scientific cooperation can be by agreement of the parties used.

2.3. Each Party also has the right to give support to scientific cooperation between scientists and collectives of the Republic of Belarus and the Azerbaijan Republic unilaterally.

Article 3

The parties assist each other in exchange of scientific materials and the literature including published by means of one of the Parties, at the same time their mutual transfer will be made according to the legislation of the states of the Parties.

Article 4

The parties assist each other in conducting examination of scientific projects and involvement of competent Belarusian and Azerbaijani scientists as experts.

Article 5

5.1. The parties according to the national legal system and international agreements in which they participate shall take measures for ensuring implementation of procedures for use of the protection of intellectual property rights (copyright, the related rights, topology of integrated circuits, data collection, inventions, useful models, industrial designs, trademarks and the rights to geographical instructions, technical processes, the company name, "know-how", etc.) created within this agreement.

5.2. The parties shall provide exchange of information, created in the field of intellectual property within this agreement and about the legal acts adopted in the field.

5.3. Within this agreement exclusive rights on use of intellectual property and results jointly of the performed researches, will be in joint tenancy of the Parties. Between the relevant organizations which are responsible for accomplishment of this Agreement the written protocols and agreements regulating use of the intellectual property created within the Agreement can be signed.

5.4. During the term of this agreement the intellectual property created on initiative and as a result of activities only by one of the Parties, and also the rights to use results of researches will belong to this Party.

5.5. The parties assist creating favorable conditions for the purpose of implementation of provisions of this Article in the states taking into account requirements of national legal systems.

Article 6

The parties have the right to regularly publish data of information nature on accomplishment of certain provisions of this agreement in the periodicals.

Article 7

7.1. This agreement does not affect the rights and obligations of the Parties following from other international treaties which participants are the states of the Parties.

7.2. The contradictions arising during implementation of this Agreement are solved by negotiations and consultations between the Parties.

Article 8

By mutual consent of the Parties, changes and additions which are drawn up by the separate protocols which are its integral part can be made to this agreement.

Article 9

9.1. This agreement becomes effective from the date of its signing.

9.2. This agreement is signed for a period of 5 (five) years and automatically prolonged for subsequent the fifth anniversary if any of the Parties in writing not later than 6 (six) months before the expiration of the above-stated term does not notify other Party through diplomatic channels about the intention to terminate this agreement.

Signed in the city of Minsk on November 28, 2015 in two authentic copies, everyone in the Russian and Azerbaijani languages, and both texts have identical legal force. In case of disagreements in case of interpretation of provisions of this agreement of the Party will be guided by the text in Russian.
