About approval of Rules of provision (use, return) from the federal budget to budgets of subjects of the Russian Federation of budget credits for 2016

The government of the Russian Federation decides:

Approve the enclosed Rules of provision (use, return) from the federal budget to budgets of subjects of the Russian Federation of budget credits for 2016.

Rules of provision (use, return) from the federal budget to budgets of subjects of the Russian Federation of budget credits for 2016

1. These rules establish procedure for provision (use, return) from the federal budget to budgets of subjects of the Russian Federation of budget credits for 2016 (further - budget credits).

2. Budget credits are granted on the following purposes:

a) partial covering of budget deficit of the subject of the Russian Federation;

b) covering of the temporary cash gap arising in case of budget implementation of the subject of the Russian Federation;

c) implementation of the actions connected with natural disaster response and the technogenic accidents which happened in the territory of the subject of the Russian Federation.

3. The budget credit is granted to the budget of the subject of the Russian Federation:

a) for partial covering of deficit - if the predicted expenses of the consolidated budget of the subject of the Russian Federation in the current financial year exceed the income of the consolidated budget of the subject of the Russian Federation (taking into account budget deficit financing sources), and also for the purpose of repayment of debt obligations of the subject of the Russian Federation in obligation type on budget credits, government securities of the subject of the Russian Federation and the credits obtained by the subject of the Russian Federation from credit institutions, foreign banks and international financial institutions;

b) for covering of temporary cash gap - if the predicted expenses of the consolidated budget of the subject of the Russian Federation (except for expenses of capital nature and expenses on support of the organizations of the production sphere) planned in month in which issue of budget credit is supposed exceed the predicted income of the consolidated budget of the subject of the Russian Federation (without non-paid transfers to budget investments) this month (taking into account budget deficit financing sources);

c) for implementation of the actions connected with natural disaster response and technogenic accidents - in case of insufficiency of the available means of the consolidated budget of the subject of the Russian Federation.

4. The budget credit for partial covering of budget deficit of the subject of the Russian Federation for the purpose of repayment of debt obligations of the subject of the Russian Federation in obligation type on budget credits, government securities of the subject of the Russian Federation and the credits obtained by the subject of the Russian Federation from credit institutions, foreign banks and international financial institutions is provided on condition of adoption by the subject of the Russian Federation of the following obligations:

a) approval of the executive authority of the subject of the Russian Federation of debt policy of the subject of the Russian Federation by the supreme body for the next financial year and planning period;

b) non-admission of acceptance and execution of the payment commitments which are not carried by the Constitution of the Russian Federation and the Federal Laws to powers of public authorities of subjects of the Russian Federation, except for subjects of the Russian Federation in which budgets the share of grants from the federal budget during two of three last reporting financial years did not exceed 10 percent of amount of own income of the consolidated budget of the subject of the Russian Federation;

c) observance of the standard rates of forming of expenses on compensation of the government civil servants of the subject of the Russian Federation and (or) content of public authorities of the subject of the Russian Federation established by the Government of the Russian Federation, except for the subjects of the Russian Federation who are not in 2016 receivers of the grant for equalization of fiscal capacity of subjects of the Russian Federation;

d) annually, since January 1, 2017, ensuring budget deficit of the subject of the Russian Federation at the level of no more than 10 percent of the amount of budget receipts of the subject of the Russian Federation without amount of non-paid receipts for 2016;

e) step-by-step reducing share of total amount of debt obligations of the subject of the Russian Federation on government securities of the subject of the Russian Federation and the credits obtained by the subject of the Russian Federation from credit institutions, foreign banks and international financial institutions by January 1, 2017 to the level no more than 70 percent of the amount of budget receipts of the subject of the Russian Federation without non-paid receipts for 2016, by January 1, 2018 - to the level no more than 60 percent of the amount of budget receipts of the subject of the Russian Federation without non-paid receipts for 2017 and by January 1, 2019 - to the level no more than 50 percent of the amount of budget receipts of the subject of the Russian Federation without non-paid receipts for 2018;

e) annually, since January 1, 2017, providing for January 1, 2018 and for January 1, 2019 shares of total amount of public debt no more than 50 percent of the amount of budget receipts of the subject of the Russian Federation without non-paid receipts for 2017 and 2018 respectively - for subject of the Russian Federation which amount of public debt for January 1, 2017 will make no more than 50 percent of the amount of budget receipts of this subject of the Russian Federation without non-paid receipts for 2016;

g) annually, since January 1, 2017, providing for January 1, 2018 and for January 1, 2019 not increases in indicator of ratio of amount of public debt of the subject of the Russian Federation to amount of budget receipts of the subject of the Russian Federation without non-paid receipts for 2017 and 2018 respectively in comparison with indicator for January 1, 2017 - for subject of the Russian Federation which amount of public debt for January 1, 2017 will make more than 50 percent of the amount of budget receipts of this subject of the Russian Federation without non-paid receipts for 2016.
