About approval of Rules of the edition of socially significant literature

According to subitem 9-2) of article 7 of the Law of the Republic of Kazakhstan of December 15, 2006 "About culture" I ORDER:

1. Approve the enclosed Rules of the edition of socially significant literature.

2. To provide to administrative department of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after its state registration of this order the direction of copies of this order for official publication in information system of law of Ad_let and the periodic printing edition on the electronic medium with appendix of the paper copy certified by official stamp for entering into reference control bank of the regulatory legal acts of the Republic of Kazakhstan in electronic form certified by the digital signature of person, representative to sign this order, with appendix of the paper copy certified by official stamp;

3) placement of this order on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan after official publication;

4) submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of the actions provided by this Item within ten working days from the date of execution of actions.

3. To impose control of execution of this order on the supervising vice-Minister for Culture and Sports of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2016 and is subject to official publication.

Rules of the edition of socially significant literature

1. General provision

1. These rules of the edition of socially significant literature (further - Rules) are developed for the purpose of ensuring realization of tasks on release and distribution of socially significant types of literature and determine procedure for the edition of socially significant literature which includes the following stages:

1) acceptance and consideration of requests for the edition of socially significant literature;

2) approval of the Thematic plan of the edition of socially significant literature.

2. Acceptance and consideration of requests for the edition of socially significant literature

2. The request for the edition of socially significant literature (further - the request), in form according to appendix to these rules, moves in the Ministry of Culture and sport of the Republic of Kazakhstan (further - authorized body) physical persons and legal entities.

3. The request is accepted within year till October 1 inclusive.

4. Are applied to the request:

1) the review of the Writers' Union of Kazakhstan or Institute of literature and art of M. Auezov (for the edition of art, children's literature and journalism);

the expert opinion of the profile research institution corresponding on subject (for the edition of scientific literature);

approval of Administration of the President of the Republic of Kazakhstan (for the edition of literature on the President of the Republic of Kazakhstan);

the expert opinion of authorized body in the field of religious activities (for the edition of religious literature);

the review of the relevant creative union (for the edition of literature on art, including photo albums, books albums, pieces of music and so on);

2) electronic version of the manuscript on CD disk;

3) notarially attested copy of the prisoner according to article 31 of the Law of the Republic of Kazakhstan of June 10, 1996 "About copyright and the related rights" the author's agreement on transfer of exclusive rights;

4) written consent of the author, on placement by authorized body of the provided work on Internet resources (in case of lack of such consent in the author's agreement or lack of the author's agreement);

5) the written consent of the author to the conclusion of the author's contract with the publishing house determined following the results of the carried-out public procurements (in case of absence at the author of the signed author's agreement).

6. The authorized body till December 1 submits for consideration of Arts council on literature and book publishing under authorized body (further - Arts council) all arrived requests with the enclosed documents.

7. The arts council till December 31 of the current year considers the arrived requests with the enclosed documents regarding availability in the work of art value, relevance and feasibility of the edition of the work taking into account the allocated budgetary funds for the corresponding financial year.

3. Approval of the Thematic plan of the edition of socially significant literature

8. After consideration of the arrived requests the Arts council makes the decision on inclusion or not inclusion of the work in the Thematic plan of the edition of socially significant literature (further - the Thematic plan).

9. The decision of Arts council is drawn up by the protocol which has advisory nature.

10. The protocol is signed by the chairman, the secretary, members of Arts council.

11. Based on the decision of Arts council the authorized body within thirty calendar days sends the adequate written notice to physical persons and legal entities.

12. The thematic plan for the corresponding year affirms authorized body.
