Article 1

This agreement determines obligations of the Parties in case of accidents in case of missiles launches from the Baikonur spaceport, procedure for reduction in ready state of forces and means of the Parties by the time of missiles launch from the Baikonur spaceport, the procedure of the mutual notification of the Parties about preparation for missiles launch and in case of accident, and also procedure for attraction of necessary forces and means of the Parties for recovery from the accident.

For the purposes of this agreement:

- "rocket" means any rocket of space appointment (including the spacecraft, the accelerating block and other components) or the ballistic missile with equipment elements;

- "accident" means fall of the rocket or its parts on the territory of the Republic of Kazakhstan outside the territories leased by the Russian Side from the Kazakhstan Side.

Article 2

The Russian side for recovery from the accident can raise the following forces and funds:

- rescue group for elimination of emergencies on objects of the Baikonur spaceport and carrying out wrecking;

- specialized laboratories for carrying out monitoring of influence of raketnokosmichesky activities on the environment and hygienic control on the Baikonur complex and on trasses of flight of rockets;

- forces and means of aerospace search and rescue;

- specialized medicobiological rapid response crews;

- specialized services of operational forecasting of possible levels of pollution of the environment in emergencies;

- not reduced inventory of devices and chemical reactants for recovery from the accident;

- other forces and means.

Article 3

The Kazakhstan Side for recovery from the accident can raise the following forces and funds:

- special rescue and search and rescue divisions;

- fire, sanitary and epidemiologic, health, nature protection and other services, and also law enforcement agencies;

- inventories of food and material resources for the device of the temporary accommodation and the organization of Items of food when carrying out, in case of need, evacuation actions and acceptance of persons which are evacuated from the settlements which got to accident zone;

- other forces and means.

The specific structure of forces and the funds of the Kazakhstan Side raised for recovery from the accident is determined proceeding from operational information of the Russian Side about the expected area of accident, its possible scales and effects, necessary forces and means.

Article 4

For the purpose of providing the analysis of possible effects of accident the Russian Side provides to the Kazakhstan Side necessary specifications on types of rockets, trasses of their flight and possible areas of fall in case of accident.

The Russian side according to requests of the Kazakhstan Side performs according to the mutual arrangement training of specialists of the Republic of Kazakhstan in actions in case of recovery from the accident and provides to the Kazakhstan Side necessary methodical providing.

Article 5

In case of accident the Russian Side stops missiles launches of that type to which the rocket which crashed before clarification of causes of accident belongs what informs the Kazakhstan Side on.

The Russian side notifies the Kazakhstan Side on causes of accident, accomplishment of actions for safety of the subsequent missiles launches of this type and in coordination with the Kazakhstan Side resumes their start-up.

Article 6

For the purpose of timely reduction of rescue divisions of the Kazakhstan Side in ready state, the Russian Side notifies the Kazakhstan Side on the forthcoming missile launch according to collateral order. In case of transfer of date and/or time of missile launch, the notification is made at least in 24 hours prior to again planned start-up time. In case of transfer of time of start-up less than for 24 hours, the notification is made without delay on operational communication channels.

The Russian side attracts on compensation basis rescue divisions of the Republic of Kazakhstan to safety when implementing missiles launches. The procedure for involvement of these divisions is determined by the relevant agreements between authorized bodies of the Parties.

Article 7

In 8 hours prior to the planned missile launch time authorized bodies of the Parties communicate about readiness of rescue divisions of the Parties.

In case of accident authorized bodies of the Russian Side notify authorized bodies of the Kazakhstan Side on the current situation.

The procedure for mutual exchange of information is determined by the agreement between authorized bodies of the Parties.

Article 8

In case of accident authorized bodies of the Russian Side without delay create and no later than 12 hours from the moment of accident send task force of the Russian specialists to the area of accident for assessment of situation, the organization of interaction with authorities of the Republic of Kazakhstan and accomplishment of priority actions on recovery from the accident.

In case of need in the terms coordinated with the Kazakhstan Side authorized bodies of the Russian Side create and send to the area of accident group of specialists for recovery from the accident.

The parties create government commissions on investigation of the reasons and assessment of effects of accident which form the joint headquarters on liquidation of its effects, and approve procedure for further collateral actions.

By results of work of government commissions the joint protocol is signed.
