About approval of the Regulations on the organization and functioning of the State inspectorate for supervision of alcoholic products, its structure and extreme number of staff

1. Approve:

Regulations on the organization and functioning of the State inspectorate for supervision of alcoholic products, according to appendix No. 1;

structure of the State inspectorate for supervision of alcoholic products according to appendix No. 2.

2. Establish the extreme number of staff of the State inspectorate for supervision of alcoholic products in number of 8 units.

3. In Item 1 of the Order of the Government No. 363 of June 5, 1995. "About creation of the State inspectorate for supervision of alcoholic products" (The official monitor of the Republic of Moldova, 1995, Art. No. 38-39, 293), with subsequent changes and amendments, the text "with the number of staff of 8 units. Activities of Inspection are financed" to exclude from the government budget.

4. Recognize invalid some orders of the Government according to appendix No. 3.

Regulations on the organization and functioning of the State inspectorate for supervision of alcoholic products

Chapter I. Basic provisions

1. The regulations on the organization and functioning of the State inspectorate for supervision of alcoholic products (further – the Provision) establish mission, the main functions and powers, and also common laws of the State inspectorate for supervision of alcoholic products (further – Inspection), and also procedure for its organization and functioning.

2. Inspection is the administrative authority subordinated to the Ministry of Agriculture and the food industry, has the status of the legal entity of the public law, with the location in mun. Chisinau, has seal with the image of the State Emblem of the Republic of Moldova, treasurer accounts, and also other specific attributes of bodies of public management established by the legislation.

3. In the activities Inspection is guided by the Constitution of the Republic of Moldova, the laws and resolutions of Parliament, presidential decrees of the Republic of Moldova, ordinances, resolutions and orders of the Government, orders of the Ministry of Agriculture and food industry, this Provision and other regulations.

Chapter II. Mission, main functions and powers, and also common laws of Inspection

4. The mission of Inspectorate consists in providing by means of supervision and control of the compliance with law concerning ethyl alcohol, alcoholic products, grape and wine-making products, grape plantings and beer.

5. For the purpose of realization of the mission Inspection performs in the limits set by the law, functions of supervision and control of the activities connected with:

1) production and turnover of ethyl alcohol and alcoholic products;

2) production, storage and sale of grape and wine-making products;

3) production of wines with the protected name of the place of origin and wines with the protected geographical specifying;

4) production, storage and wholesale of beer;

5) labeling of alcoholic products, grape and wine-making products and beer;

6) bookmark and raskorchevka of grape plantings.

6. Inspection performs the following main powers:

Initiates 1) and performs activities for supervision and control in the areas entrusted to it according to the law;

2) exercises supervision of observance of the methods and technologies used in case of production of ethyl alcohol, alcoholic products, grape and wine-making products and beer;

Studies 3) and provides project proposals legislative and regulations in the areas entrusted to it;

4) participates in development of schemes on sealing of processing equipment on production of ethyl alcohol, strong alcoholic products and products on the basis of wine;

6) is constituted by the schedule of checks;

7) publishes instructions about elimination of the revealed violations in the areas entrusted to it;

9) is conducted by the Magazine of the capital processing equipment used for production of ethyl alcohol and/or strong alcoholic products and products on the basis of wine;

8. Inspection is given the following common laws:

1) to use open entry, according to the law, in production and storage facilities of the companies performing activities in the field of production and turnover of ethyl alcohol, alcoholic products, grape and wine-making products and beer;

2) to require and receive from controlled entities necessary documents and explanations on the problems connected with check;

4) to require judicially in the cases provided by the law, suspensions of operations of the companies, which are engaged in production or sale of ethyl alcohol, alcoholic products, grape and wine-making products and beer;
