About approval of standards of the state services rendered by Committee of homeland security of the Republic of Kazakhstan

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve the enclosed standards of the state services:

1) "Licensing for occupation activities for development, production, repair and realization of the special technical means intended for conducting investigation and search operations" according to appendix 1 to this order;

2) "Licensing for development and realization (including other transfer) means of cryptographic information security", according to appendix 2 to this order;

3) "Licensing for rendering services in identification of technical channels of information leakage and the special technical means intended for conducting investigation and search operations" according to appendix 3 to this order;

4) "Issue of the conclusion (the allowing document) for import, export and transit of the special technical means intended for secret receipt of information to which measures of non-tariff regulation in trade with the third countries", according to appendix 4 to this order are applied;

5) "Issue of the conclusion (the allowing document) for import, export and transit of the cryptography (cryptographic) tools to which measures of non-tariff regulation in trade with the third countries", according to appendix 5 to this order are applied;

6) "Carrying out technical research regarding reference of goods to the means of cryptographic information security and special technical means intended for conducting investigation and search operations" according to appendix 6 to this order;

7) "Registration of notifications about characteristics of the goods (products) containing the cryptography (cryptographic) tools" according to appendix 7 to this order.

2. To provide to department on protection of the state secrets of Committee of homeland security of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication;

2) placement of this order on official Internet resource of Committee of homeland security of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-chairman of Committee of homeland security of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Appendix 1

to the Order of the Chairman of Committee of homeland security of April 28, 2015 No. 30

Standard of the state service "Licensing for Occupation Activities for Development, Production, Repair and Realization of the Special Technical Means Intended for Conducting Investigation and Search Operations"

Chapter 1. General provisions

1. The state service "Licensing for Occupation Activities for Development, Production, Repair and Realization of the Special Technical Means Intended for Conducting Investigation and Search Operations" (further - the state service).

2. The standard of the state service is developed by Committee of homeland security of the Republic of Kazakhstan (further - KNB).

3. The state service is rendered to KNB (further - the service provider).

Reception of an application and issue of result of rendering the state service is performed by the service provider, including through the web portal of "the electronic government": www.egov.kz, www.elicense.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the moment of delivery of document package to the service provider, and also in case of the address through the portal:

licensing - 15 working days;

renewal of the license - 3 working days;

issue of the duplicate of the license - 2 working days.

The service provider within two working days from the moment of delivery of document package checks their completeness.

In representation cases uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, and (or) documents with the expired effective period the service provider refuses reception of an application;

2) the most allowed time of expectation for delivery of document package - 20 minutes;

3) the most allowed time of servicing - 20 minutes.

5. Form of rendering the state service: electronic (partially automated).

6. Licensing, renewal of the license, issue of the duplicate of the license for occupation activities for development, production, repair and realization of the special technical means intended for conducting investigation and search operations or motivated refusal in rendering the state service in the bases provided in Item 10 of this standard are result of rendering the state service.

In case of the request for receipt of result of rendering the state service on paper the result of rendering the state service is drawn up electronically, unpacked and certified by seal (in case of its availability) and the authorized signature of the service provider.

In case of the address through the portal the result of rendering the state service goes to "private office" in electronic form, the authorized person of the service provider certified by means of the EDS.

Form of provision of result of the state service: electronic.

7. The state service is rendered on paid basis to physical persons and legal entities (further - uslugopoluchatel).

For rendering the state service the license fee for the occupation right by separate types of activity according to article 554 of the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget (Tax code)" which constitutes is levied: for licensing - 20 monthly settlement indicators (further - MRP);

for renewal of the license - 2 MRP;

for issue of the duplicate of the license - 20 MRP.

In case of the address through the portal, payment can be performed through payment gateway of "the electronic government" (further - PShEP).

8. Working schedule:

1) the service provider - Monday through Friday inclusive, from 09:00 till 19:00 o'clock, with lunch break from 13:00 till 15:00 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

Reception of an application and issue of result of rendering the state service is performed from 9:00 to 17:30 o'clock, with lunch break from 13:00 till 14:30 o'clock, in turn, without making an appointment and the accelerated servicing;

2) the portal - round the clock, except for the breaks connected with carrying out technical works (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service is performed the next working afternoon).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (or his representative by proxy):

to the service provider:

1) for receipt of the license:

the statement of the legal entity for receipt of the license in form, according to appendix 1 to this standard of the state service or the statement of physical person for receipt of the license in form, according to appendix 2 to this standard of the state service;

the copy of the document confirming payment in the budget of the license fee;

form of data on compliance of uslugopoluchatel to qualification requirements for occupation activities for development, production, repair and realization of the special technical means intended for conducting investigation and search operations according to appendix 3 to this standard of the state service (further - form of data).

2) for renewal of the license:

the statement of the legal entity for renewal of the license in form, according to appendix 4 to this standard of the state service or the statement of physical person for renewal of the license in form, according to appendix 5 to this standard of the state service;

the document, the license fee confirming payment in the budget;

copies of the documents containing information on changes, which formed the basis for renewal of the license, except for documents from which information contains in the state information systems.

3) in case of loss, spoil of the license granted in paper form, the uslugopoluchatel addresses the service provider for receipt of the duplicate of the license only in the absence of possibility of receipt of data on the license from the corresponding information systems on the portal:

the statement for issue of the duplicate of the license in any form;

the copy of the document confirming payment in the budget of the license fee.

In case of spoil of the license granted in paper form, the uslugopoluchatel before receipt of the duplicate of the license returns to the service provider earlier issued original of the license; on the portal:

1) for receipt of the license:

the request in electronic form certified by the EDS of uslugopoluchatel;

the electronic copy of the document confirming payment in the budget of the license fee, except as specified payments through PShEP; electronic form of data.

2) for renewal of the license:

the request in electronic form certified by the EDS of uslugopoluchatel;

the electronic copy of the document confirming payment in the budget of the license fee, except as specified payments through GShEP;

the electronic copies of documents containing information on the changes which formed the basis for renewal of the license, except for documents from which information contains in the state information systems.

3) in case of loss, spoil of the license granted in paper form, the uslugopoluchatel addresses the service provider for receipt of the duplicate of the license only in the absence of possibility of receipt of data on the license from the corresponding information systems on the portal:

the request in electronic form certified by the EDS of uslugopoluchatel;

the electronic copy of the document confirming payment in the budget of the license fee, except as specified payments through PShEP.

In case of spoil of the license granted in paper form, the uslugopoluchatel before receipt of the duplicate of the license returns to the service provider earlier issued original of the license.

Data on the identity document, on state registration (re-registration) of uslugopoluchatel as the legal entity, as the individual entrepreneur, about the license, about payment of the license fee (in case of payment through PShEP), containing in the state information systems, the service provider receives independently from the corresponding state information systems through lock of "the electronic government".

Confirmation of the request of uslugopoluchatel for the state service to the service provider is the mark in the copy of the application containing date, time, the signature, surname and initials of person which accepted document package. The documents submitted to the service provider for rendering the state service are accepted according to the inventory which copy is handed to uslugopoluchatel with mark about date of documents acceptance.

In case of the request for the state service through the portal to uslugopoluchatel the notification on acceptance of request for rendering the state service goes to "private office".

10. The bases for refusal in rendering the state service:

1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

2) discrepancy of uslugopoluchatel and (or) provided supplied and the information necessary for rendering the state service, to qualification requirements and the list of the documents confirming compliance to them for implementation of activities for development, production, repair and realization of the special technical means intended for conducting investigation and search operations, the approved order of the Chairman of Committee of homeland security of the Republic of Kazakhstan of January 30, 2015 to No. 4 (it is registered in the Register of state registration of regulatory legal acts No. 10473);

3) concerning uslugopoluchatel there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of the state service which took legal effect;

4) concerning uslugopoluchatel there is judgment which took legal effect based on which the uslugopoluchatel is deprived of the special right connected with receipt of the state service.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) their officials concerning rendering the state service 

11. In case of appeal of decisions, actions (failure to act) of the service provider and (or) his officials the claim is submitted addressed to the head of the service provider.

Claims are accepted in writing by mail service, purposely through office of the service provider, according to the working schedule of the service provider.

Confirmation of adoption of the claim is the mark in the copy of the claim containing date, time, the signature, surname and initials of person which accepted the claim.

The complaint can be made through the portal in electronic form, the uslugopoluchatel certified by the EDS. Information on procedure for appeal by means of the portal can be obtained by phone Single contact center concerning rendering the state services: 1414.

In case of the address through the portal information on the address which is updated during processing of the address by the service provider is available to uslugopoluchatel from "private office" (mark about delivery, registration, execution, the answer about consideration or refusal in consideration).

The claim of uslugopoluchatel concerning rendering the state service which arrived to the service provider is subject to consideration within 5 working days from the date of its registration.

The answer about results of consideration of the claim goes to uslugopoluchatel by means of mail service or is issued purposely in office of the service provider.

In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body by assessment and control of quality of rendering the state services.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 working days from the date of its registration.

12. In case of disagreement with results of rendering the state service the uslugopoluchatel can take a legal action according to the procedure, established by the legislation of the Republic of Kazakhstan.

Chapter 4. Other requirements taking into account features of rendering the state service

13. Powers of the representative of uslugopoluchatel shall be drawn up according to the civil legislation of the Republic of Kazakhstan.

14. Receipt of the state service through the portal requires EDS availability.

15. The address of the place of rendering the state service is placed on the KNB official Internet resource: www.knb.kz.

16. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access on the portal in "private office" of uslugopoluchatel, and also by phones of the service provider and Single contact center concerning rendering the state services.

17. Contact telephone numbers of the service provider concerning rendering the state service: 8 (7172) 76-49-49, 76-49-48, 76-49-47, 76-49-44, 76-49-43.
