About system of broadcasting to foreign countries of Ukraine

(as amended on 19-05-2020)

This Law creates the legal basis of the organization and determines tasks and functions of the state broadcasting to foreign countries of Ukraine, basis of activities of subjects of the state broadcasting to foreign countries for the purpose of protection of national interests of Ukraine abroad, forming and maintenance of positive image of Ukraine in the world by operational, objective informing on events in Ukraine, official domestic and foreign policy and line item of the state, activities of public authorities and local government bodies.

Article 1. Determination of terms

1. In this Law the terms below are used in such value:

the state broadcasting to foreign countries of Ukraine - the broadcasting directed to informing on events in Ukraine which is performed in the form of information messages, news, programs (transfers) with use of technical means of teleradiokomunikation, and also other forms of activities provided by this Law;

subjects of the state broadcasting to foreign countries of Ukraine - the legal entities constituting system of the state broadcasting to foreign countries.

2. Other terms are used in the value given in the laws of Ukraine "About information", "About television and broadcasting" and other legal acts of Ukraine.

Article 2. Legal basis of activities of system of the state broadcasting to foreign countries of Ukraine

1. System of the state broadcasting to foreign countries of Ukraine constitute the state company "Multimedia Platform of Broadcasting to Foreign Countries of Ukraine" and the Ukrainian national news agency "Ukrinform".

The legal entities who are logging in the state broadcasting to foreign countries of Ukraine can create in the structure separate divisions - the state correspondent offices for realization of the tasks assigned to the state broadcasting to foreign countries, and also for the purpose of provision of consulting and other types of service to representatives of foreign mass media which are in the territory of Ukraine on legal causes for the purpose of implementation of professional activity in the field of mass information.

2. For the purpose of protection of national interests of Ukraine abroad, forming and maintenance of positive image of Ukraine in the world by operational, objective informing on events in Ukraine, official domestic and foreign policy and line item of the state, activities of public authorities and local government bodies the state company "Multimedia Platform of Broadcasting to Foreign Countries of Ukraine" is formed (further - MPIU).

3. Formation of MPIU is performed according to the decision of the central executive body which provides forming and realizes state policy in the field of ensuring information sovereignty of Ukraine, according to the legislation taking into account the features determined by this Law.

4. MPIU is formed in the form of the state company based on the state broadcasting company "The world service "Ukrainian Television and Broadcasting" and submits to the central executive body which provides forming and realizes state policy in the field of ensuring information sovereignty of Ukraine (further - Authorized body).

5. MPIU determines the structure, creates the principles of personnel policy, determines the program concept and procedure for partner relations based on the Charter.

6. MPIU is object of nation-wide value. Alienation, transfer (except short-term lease), privatization of real estate, objects of construction in progress and the parcels of land on which they are located, the provided MPIU on the right of economic maintaining are prohibited.

7. For the purpose of ensuring compliance with liberty principles of the word and international standards of information activities by subjects of the state broadcasting to foreign countries the Authorized body forms the Supervisory board.

Article 3. The basic principles of management and state regulation in the field of the state broadcasting to foreign countries

1. The Cabinet of Ministers of Ukraine directs and coordinates activities of the ministries and other central executive bodies in the field of the state broadcasting to foreign countries.

2. The authorized body provides forming and realizes state policy in the field of the state broadcasting to foreign countries.

3. Powers of other public authorities and local government bodies in the field of the state broadcasting to foreign countries are determined according to the legislation.

4. The authorized body performs:

1) forming and realization of state policy in the field of the state broadcasting to foreign countries;

2) methodological promotion and coordination of activities of subjects of the state broadcasting to foreign countries;

3) supervision of observance by subjects of the state broadcasting to foreign countries of requirements of the legislation in the field of television and broadcasting;

4) assistance to inclusion of subjects of the state broadcasting to foreign countries of Ukraine in world information space and to implementation of activities by them according to international standards;

5) generalization of practice of application of the legislation in the field of the state broadcasting to foreign countries, suggestions for improvement of the legislation in this sphere;

6) cooperation concerning the state broadcasting to foreign countries with the international organizations, public authorities and non-governmental organizations of other states.

Article 4. The legislation of Ukraine in the field of activities of the state broadcasting to foreign countries

1. The legislation of Ukraine in the field of the state broadcasting to foreign countries consists of the Constitution of Ukraine, the laws of Ukraine "About information", "About television and broadcasting", "About telecommunications", "About access to public information", "About news agencies", "About National council of Ukraine concerning television and broadcasting", this Law, international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, and other regulatory legal acts.

Article 5. Principles of the state broadcasting to foreign countries and guarantee of independence of subjects of the state broadcasting to foreign countries of Ukraine

1. Subjects of the state broadcasting to foreign countries perform the activities with respect for the following principles:

1) free expression of views, opinions and beliefs;

2) approvals of common goals of foreign policy of Ukraine, international standards and contractual commitments of Ukraine;
