About approval of Rules of forming of the Unified state register of new technologies in construction

According to subitem 35-2) of article 1 of the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan", PRIKAZYVAYU:

1. Approve the enclosed Rules of forming of the Unified state register of new technologies in construction.

2. To provide to committee on cases of construction, housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective on the expiration of ten calendar days after day of its first official publication.

Rules of forming of the Unified state register of new technologies in construction

1. General provisions

1. These rules of forming of the Unified state register of new technologies in construction (further - Rules) are developed according to subitem 35-2) of article 1 of the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan" and determine procedure for forming of the Unified state register of new technologies in construction.

2. In Rules the following basic concepts are used:

1) new technologies in construction - the new effective and progressive types and methods of building and construction works promoting upgrade, improvement of quality, performance and safety of construction works;

2) the Unified state register of new technologies in construction (further - the Register) - the list of the new effective technologies of construction production implemented in the Republic of Kazakhstan by subjects of architectural, town-planning and construction activities on which there are no regulations in the estimate regulatory base, created according to these rules;

3) subjects of building sector - the public institutions, the construction contract and project organizations performing activities in the field of construction, the manufacturers of construction materials, the organizations performing transfer of new technologies;

4) authorized body in the field of architecture, town planning and construction (further authorized body) the central state body of the Republic of Kazakhstan performing management in the field of public administration of architectural, town-planning and construction activities;

5) the expert organization - the organization which is under authority of department of authorized body and performing the analysis of new technologies in construction on the basis of information and supporting documents provided by subjects of building sector.

3. Maintaining the Register is performed for the purpose of enhancement of the estimate regulatory base of Kazakhstan, informing subjects of building sector on new progressive technologies in construction and their implementations in building sector.

4. Forming of the Register performs department of authorized body.

2. Procedure for forming of the register

5. Forming of the Register includes:

1) introduction of data on the name of new technology in construction;

2) introduction of information about subjects of building sector of the new construction methods which are engaged in implementation in Kazakhstan;

3) modification of the data containing in the Register, connected with changes on the applied construction resources with changes of the regulating documentation;

4) systematic updating of the Register in case of change of information provided by subjects of building sector;

5) carrying out monitoring of the Register regarding updating (updating) of its content.

6. For inclusion in the Register of data on new technologies, subjects of building sector submit the following documents to department of authorized body:

the statement for inclusion in the Register of the name of new technology in construction (in any form);

information on new technologies in construction in form according to appendix 1 to these rules.

7. Department of authorized body within three working days sends documents of the subject of building sector to the expert organization for carrying out the analysis regarding need of inclusion of the considered technologies in the Register.

8. The expert organization within thirty working days from the moment of receipt of documents sends results of the carried-out analysis to department of authorized body.

9. Department of authorized body within five working days from the moment of receipt of analysis results from the expert organization:

in the absence of notes includes data on new technology in construction in the Register;

sends to the subject of building sector the notification on inclusion of new technology in construction to the Register;

in case of refusal, sends to the subject of building sector the notification on refusal in inclusion of new technology in construction to the Register with indication of cause of failure.

10. The unified state Register of new technologies in construction is drawn up in form according to appendix 2 to these rules (further - appendix 2).

11. Updating of the Register is performed in case of changes of the data provided by subjects of building sector within ten working days from the date of their written address.

12. Following the results of activities the expert organization, annually till December 10 provides in department of authorized body the code of information on the carried-out analysis on new technologies in construction.

13. The exception of new technologies of the Register is performed by department of authorized body in the following cases:

1) at the initiative of subjects of building sector (with indication of the reasons);

2) changes of the data provided by subjects of building sector, resulting in discrepancy new technologies in construction to the data specified in appendix 2 to these rules.
