1. Approve the enclosed Rules of forming and maintaining national bank of construction projects, and also provisions of feasibility statements, standard projects and project (project and estimate) documentation.

2. To committee on cases of construction, housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan to provide in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of national economy.

4. This order becomes effective on the expiration of ten calendar days after day of its first official publication.

Rules of forming and maintaining national bank of construction projects, and also provisions of feasibility statements, standard projects and project (project and estimate) documentation

Chapter 1. General provisions

1. These rules of forming and maintaining national bank of construction projects, and also provisions of feasibility statements, standard projects and project (project and estimate) documentation (further – Rules) are developed according to Item 6-4) of article 20 of the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan".

2. Rules determine:

procedure for forming and maintaining national bank of construction projects (further – National bank);

procedure for provision of feasibility statements (further – the feasibility study), standard projects (further – TP) and project (project and estimate) documentation (further – the design and estimate documentation) from National bank.

3. In Rules the following concepts are used:

1) the author – physical person, the author of the architectural work or the legal entity who acquired exclusive right for use of the architectural work (the office work) under the agreement or other basis provided by the laws of the Republic of Kazakhstan;

2) the accredited expert organization – the legal entity accredited according to the procedure, established by authorized body for architecture, town planning and construction, performing the complex non-departmental examination of construction projects of objects (feasibility statements and the design estimates) which is not referred by the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities to the state monopoly;

3) private investments – the non-state financial resources of physical persons or legal entities allocated for development of the feasibility study and design and estimate documentation;

4) the client – the physical person or legal entity which addressed to National bank behind obtaining available in the feasibility study, TP and design and Estimate Documentation electronic archive;

5) national bank of construction projects – the feasibility study, TP and design and Estimate Documentation electronic archive on construction of the new objects which received the positive decision of complex non-departmental examination;

6) the operator of National bank – the state expert organization performing forming and maintaining National bank, and also provision from National bank of the feasibility study, TP and the design and estimate documentation;

7) the state expert organization – the legal entity created according to the decision of the Government of the Republic of Kazakhstan in form of business of the republican state company on the right of economic maintaining and performing the activities for conducting complex non-departmental examination of construction projects of objects (feasibility statements and the design estimates), forming and maintaining national bank of construction projects, and also provision of feasibility statements, standard projects and project (project and estimate) documentation referred to the state monopoly from national bank of construction projects;

8) the customer – the physical person or legal entity acting as the investor of the project (program), the owner or their authorized persons according to the feasibility study, TP and the design and estimate documentation who passed the complex non-departmental examination of construction projects;

9) electronic archive – storage set of electronic documents feasibility studies, TP and design and Estimate Documentation;

10) the electronic register – the feasibility study, TP and design and Estimate Documentation catalog.

4. The purpose of forming and maintaining National bank is provision to clients available in the feasibility study, TP and design and Estimate Documentation electronic archive.

5. The main directions of functioning of National bank are:

forming, maintaining and ensuring general availability of the electronic register;

forming and maintaining regularly updated and filled up feasibility study, TP and design and Estimate Documentation electronic archive;

provision of the feasibility study, TP and design and estimate documentation.

6. Relations of clients, customers, the author of the project and the operator of National bank are performed by means of the single portal for the organization of conducting complex non-departmental examination of construction projects for the principle of "one window" (further - the Portal).
