About international treaties of the Kyrgyz Republic

The international agreements are the legal basis of the international relations of the Kyrgyz Republic.

The international contracts and agreements which entered in the procedure established by the law which participant is the Kyrgyz Republic and also the conventional principles and rules of international law are component of system of law of the Kyrgyz Republic.

The Kyrgyz Republic supports strict respect for rules of international law and confirms the commitment to the fundamental principle of international law - to the principle of fair accomplishment of the international obligations.

I. General provisions

Article 1. Tasks and scope of this Law

1. This Law establishes procedure for the conclusion, execution, termination, suspension and denouncement of international treaties of the Kyrgyz Republic.

2. The procedure for the conclusion, execution, termination, suspension and denouncement of international treaties of the Kyrgyz Republic established by this Law is applied to all international treaties of the Kyrgyz Republic irrespective of their type, form and the name.

Article 2. Use of terms

For the purposes of this Law the following terms are used:

The INTERNATIONAL TREATY of the KYRGYZ REPUBLIC - the equitable and voluntary agreement of the Kyrgyz Republic with one or several states, the international organizations or with other subjects of international law concerning the rights and obligations in the field of the international relations;

The CONCLUSION means expression of consent of the Kyrgyz Republic to obligation for it the international treaty;

SIGNING means either stage of the conclusion of the agreement, or method of expression of consent of the Kyrgyz Republic to obligation for it the international treaty if further it is not subject to ratification or approval;

INTERSTATE PROCEDURES mean ratification or approval of the international treaty;

RATIFICATION, APPROVAL AND ACCESSION mean depending on case form of expression of consent of the Kyrgyz Republic to obligation for it the international treaty;

POWERS mean the document which proceeds from competent authority of the Kyrgyz Republic and by means of which one person or several persons are designated to represent the Kyrgyz Republic for the purpose of negotiating, adoption of the text of the agreement or establishment of its authenticity, expression of consent of the Kyrgyz Republic to obligation for it of the agreement or for the purpose of making of any other act relating to the agreement;

INITIALLING means the certificate of final approval of the text of the international treaty by the parties which is expressed in statement by representatives of contracting states of the initials on the text of the agreement;

AUTHENTIC TEXTS - mean the texts of the same international treaty constituted in different languages, but having identical legal force;

The CLAUSE means the unilateral statement of authorized persons or competent authorities of the state made during the signing, ratification, acceptance or approval of the agreement or accession to it by means of which desire to exclude or change legal act of certain provisions of the agreement in their application to this state is expressed;

The INTERNATIONAL ORGANIZATION means interstate, intergovernmental organization, and also the non-governmental, non-profit organization performing the authorized activities (the having official representations or the organizations founded by them) in the territory of at least two states;

The DEPOSITARY means the state, the international organization or its leading executive official who checks the original of the international treaty and who perform the functions provided by international law concerning this agreement;
