Approve the enclosed Procedure for test of condition of the State fund of precious metals and gemstones of the Republic of Tajikistan.

Procedure for test of condition of the State fund of precious metals and gemstones of the Republic of Tajikistan

1. This Procedure establishes rules of conducting check of condition of the State fund of precious metals and gemstones of the Republic of Tajikistan, including check of condition of Diamond fund of the Republic of Tajikistan (further - State fund of Tajikistan).

2. The purpose of check of condition of State fund of Tajikistan is ensuring control over observance of procedure for transfer, accounting, storage and target use of precious metals and gemstones, and also products from them which are on accounting of State fund of Tajikistan (further - "values"), and uses of the received data for maintaining the register of property.

3. Check of condition of State fund of Tajikistan is performed at least once in 2 years.

If necessary according to the decision of the Government of the Republic of Tajikistan extraordinary inspections are carried out.

4. For conducting check of condition of State fund of Tajikistan the special commission of representatives of public authorities who are given authority on implementation of the state control over quality of sorting, assessment and realization of values is created.

The chairman of the special commission on check of condition of State fund of Tajikistan, its structure, and also the program and terms of conducting check affirm the Government of the Republic of Tajikistan.

5. During check the questions connected with functioning of State fund of Tajikistan and in particular are subject to consideration by the special commission:

a) compliance with law of the Republic of Tajikistan, accomplishment of decisions of the President of the Republic of Tajikistan and the Government of the Republic of Tajikistan about replenishment and expenditure of values of State fund of Tajikistan;

b) use of values of State fund of Tajikistan for providing production, financial, scientific, is social - cultural and other needs of the Republic of Tajikistan;

c) target use of the budgetary funds allocated for acquisition of values for replenishment of State fund of Tajikistan, and also the means received from realization of values from State fund of Tajikistan;

d) observance of procedure of payments in case of acquisition of values in State fund of Tajikistan and leave of values from State fund of Tajikistan;

e) observance of established procedure of acceptance, certification, examination, assessment, storage, issue, accounting and ensuring safety of values;

g) the indicators characterizing general condition of State fund of Tajikistan;

h) results financially - economic activity of the organization providing accounting and safety of values of State fund of Tajikistan;

i) accomplishment of the instructions directed by results of the inspections which are carried out earlier.

6. Members of the special commission according to the purposes of conducting check have the right to implementation of the following actions:

a) survey of values, rooms, workplaces, vehicles, places of permanent or temporary storage of values and also to seal them in cases of identification of violations of established procedure of obtaining, expenditure, accounting and storage of these values;

b) visit in accordance with the established procedure production administrative, rooms, places of permanent and temporary storage of values;

c) request of necessary documentation, references on the questions arising during conducting check, and also explanations of officials;

7. The chairman of the special commission shall send to the head of State fund of Tajikistan the obligatory instruction in writing about elimination of the revealed violations, and also about cessation of work with values before elimination of the violations interfering rational expenditure of these values and (or) excluding possibility of ensuring their safety.

8. By results of check of condition of State fund of Tajikistan the special commission represents the report to the Government of the Republic of Tajikistan in a month.
