About approval of Service regulations of radio-electronic means of radio amateur services
According to subitem 19-15) of Item 1 of article 8 of the Law of the Republic of Kazakhstan of July 5, 2004 "About communication" PRIKAZYVAYU:
1. Approve the enclosed Service regulations of radio-electronic means of radio amateur services.
2. To committee of communication, informatization and information of the Ministry for Investments and Development of the Republic of Kazakhstan (Kazangap T. B.) provide:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;
3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.
3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.
4. This order becomes effective after twenty one calendar days after day of its first official publication.

1. These rules of operation of radio-electronic means of radio amateur services (further – Rules) determine method of operation of radio-electronic means of radio amateur services in the territory of the Republic of Kazakhstan.
2. Radio amateur service - the radio service for the purposes of self-training, negotiation communication and technical researches performed by the physical persons which directed the adequate notice.
Provisions of Radio regulations of the International Telecommunication Union (International Telecommunication Union, ITU, Geneva 2012) and recommendations of the Interdepartmental commission on radio frequencies of the Republic of Kazakhstan are provided in Rules.
3. Radio-electronic means of radio amateur services (further - amateur radio stations) depending on the quantitative list of participants are divided into individual radio stations and radio stations of collective use, and also depending on classes are subdivided into the following categories:
1) coherent class:
category "extra";
first category;
second category;
third category;
2) technical class:
drives for sports radio direction finding;
radio stations for holding internal competitions;
repeaters, repeaters;
beacons;
radio control by models.
Amateur radio stations of coherent class are intended for carrying out radio communication between radio fans, between radio fans and automatic radio devices (the answering machines, repeaters, repeaters including established on space objects). Bands of frequencies, capacities and types of radiation permited amateur radio stations of coherent class are given in appendix 1 to these rules.
Amateur radio stations of technical class are intended for providing competitions in sports radio direction finding, radio amateur triathlon and all-round competitions, relaying of signals of amateur radio stations, the organization of radio beacons and radio control by models and systems of amateur telemechanics. Bands of frequencies, capacities and types of radiation permited amateur radio stations of technical class are given in appendix 2 to these rules.
4. Operation amateur radio stations is performed in bands of the frequencies selected in the Republic of Kazakhstan for amateur radio according to capacity depending on category of amateur radio station.
The category of amateur radio station is determined as follows:
the third category - from the moment of the notification;
the second category - not earlier than in year from the moment of the notification;
the first category - not earlier than in two years from the moment of the notification;
category extra - not earlier than in three years from the moment of the notification.
The call sign corresponding categories, is specified in the notification.
5. According to article 16-2 of the Law of the Republic of Kazakhstan of July 5, 2004 "About communication", physical persons before or the terminations of operation of radio-electronic means of radio amateur services, shall send the notification on the beginning or the termination of operation of radio-electronic means and high-frequency devices of radio amateur services (further - the notification) to territorial subdivisions of Committee of telecommunication of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan (further - territorial subdivisions) in the form approved by the order of the Minister of national economy of the Republic of Kazakhstan of January 6, 2015 No. 4 "About approval of forms of notifications and Regulations of Admission of notifications by state bodies and also of determination of the state bodies performing acceptance of notifications" (it is registered in the Register of state registration of regulatory legal acts for No. 10194).

7. Based on the notification radio fans build and operate amateur radio stations if technical parameters of the equipment correspond to bands of frequencies, capacities and types of radiation permited the amateur radio stations of coherent class specified in appendix 1 to these rules.

10. For collective use, the notification goes from her head.
11. In case of replacement of amateur radio station, and also change of its owner, change of the territory of operation, the owner of amateur radio station directs the notification according to the procedure, stipulated in Item 5 these rules.

14. For the radio fan the right to registration of individual radio station of that category which he had still to the residence remains.
15. The amateur radio station is placed to the address specified in the notification.
16. Collective radio stations are located in the room conforming to the requirements of fire safety excluding access for strangers to the transferring equipment.
17. The owner of individual amateur radio station allows for work on the radio station any person having the notification on operation of amateur radio station of individual use of the Republic of Kazakhstan. The specified user works with the call sign in the ranges of the frequencies, capacity, type of radiation permitted for its category.
The head of collective radio station allows to work on collective radio station of operators of this radio station and owners of individual radio stations. Work on collective radio station is conducted only by its call sign or personal call sign in the ranges of the frequencies, capacity, type of radiation permited the owner of this call sign.
18. Temporary transfer of radio station in other administrative and territorial unit is allowed for the term of no more than 12 months. In this case the radio fan notifies on it the relevant territorial authority no later than three months from the moment of transfer.
During the work of amateur radio station from other area, the call sign is supplemented with fractional part, for example: UN7AA/7.
19. In case of placement of amateur radio station on mobile objects, the call sign is supplemented with fractional part:
1) on overland objects-/M, for example: UN7AA/M;
2) on river, sea objects-/MM, for example: UN7AA/MM;
3) on air objects - / AM, for example: UN7AA/AM.
Work of amateur radio station from vessel board (river, sea, air) is allowed in coordination with the captain (commander) of the vessel.
20. During the work of radio station from the alternative location within area, fractional part is entered into call sign: / A, for example: UN7AA/A.
21. Depending on category and within the amateur ranges (bands) of frequencies the following types of radiations are applied:
1) CW - telegraphy with amplitude modulation with band width of 100 Hz (100HA1A);
2) SSB - telephony with the single-band modulation with band width 3 kHz (3K00J3E, 3K00R3E);
3) AM - telephony with amplitude modulation with band width 6 kHz (6K00AZE);
4) FM - telephony with frequency modulation with band width on KB 6 kHz (6K00F3E);
5) DIGIMODE - all permitted digital forms of communication;
6) SSTV - black-and-white or color television with slow development (J2F).
22. Accomplishment of regulations on band width of radiation and capacity are provided with transmitters of amateur radio stations and conform to the following requirements to stability of the frequency determined as absolute leaving of frequency within 15 minutes from the moment of entry into communication:
1) no more than 300 Hz (on the ranges it is lower than 30 MHz);
2) no more than 1 kHz (on the ranges it is higher than 30 MHz also of lower than 1300 MHz).
On the ranges higher than 1300 MHz capacity of collateral radiations is not regulated by these rules.
23. Are part of amateur radio station:
1) transmit equipment;
2) antenna arrangements;
3) auxiliary devices for control of parameters of the radio-transmitting equipment.
24. Installation of exterior antennas of amateur radio station on roofs of buildings is approved with persons in whose introduction there are these buildings. Responsibility for safety of works on installation, repair and setup of antenna constructions of amateur radio station the owner (chief) carries her. Owners of amateur radio stations are responsible for safety of roof of buildings in the locations of the masts, support and fixtures belonging to them antenna constructions and for safety of these constructions for people around.
25. In the presence of noises from amateur radio station, the owner of radio station takes measures for their elimination. Availability of noises from the radio amateur equipment is instrumentalno established and documented by territorial authority.
26. The amateur radio station of each of category is operated strictly within the ranges (bands) of the frequencies, power levels and types of radiation permitted for this category of stations, specified in appendix 1 to these rules.
27. The amateur radio stations working at the frequencies selected to radio amateur service on secondary basis shall not create noises to the radio stations using, these frequencies on primary basis and upon the demand of the last immediately change working frequency, or stop work on transfer.
28. Within the selected ranges of frequencies operators of amateur radio stations establish radio communications only with operators of amateur radio stations. Radio communications with radio stations of other services are allowed only in case of transfer of distress signals by the last (SOS; MAYDAY) at frequencies of the amateur ranges. The owner (the head of collective) of amateur radio station notifies territorial authority on each such radio communication.
29. Operators of amateur radio stations call call sign of the radio station at the beginning and in case of the complete end of each session of radio communication, and in case of long communication sessions to repeat the call sign at least once 5 minutes.
30. The call sign of amateur radio station is transmitted completely, without reducing.
31. When carrying out radiophone transmission it is recommended to transfer letters of call sign by means of words of the phonetic alphabet, according to appendix 7 to these rules. When carrying out radio communication by telegraph amateur radio stations are allowed to use only code (alphabet) of Morse, according to appendix 8 to these rules.
32. Information exchange during radio communication by amateur radio stations is limited by questions of radio amateurism, computer subject and the software, radio sport, discussion of distribution of radio waves, technical data of the equipment of amateur radio stations, antennas and weather conditions.
33. Radio exchange within the specified subject is conducted by clear text assessment of signals of amateur radio stations, according to appendix 9 to these rules, using expressions of Q-code according to appendix 10 to these rules and radio amateur code according to appendix 11 to these rules.
34. It is not allowed to owners of amateur radio stations:
1) work in the ranges of frequencies radiation types, capacity, unforeseen category of amateur radio station;
2) work as not appropriated call signs;
3) the admission to work on transfer from collective or individual radio station of persons which did not direct the notification not being members of collective radio station;
4) use of rough, swear, offensive words and expressions;
5) relaying of television, broadcasting and other programs (except radio amateur);
6) carrying out radio communication with professional radio stations (except giving of distress signals) and the radio stations working without call signs;
7) work on transfer in sections of the amateur ranges selected for signal pick-up from companions;
8) installation of amateur radio stations on air and ocean ships, without approval of responsible persons for these objects;
9) intentional creation of noises to the amateur stations incoming the emergency communication service and to office radio stations in the amateur ranges of secondary basis;
10) extraction of the income from amateur radio.
35. Call signs according to requirements of Radio regulations of the International Telecommunication Union are appropriated to amateur radio stations.
36. Only one Kazakhstan call sign for radio station of individual use on permanent basis is issued to the radio fan of the Republic of Kazakhstan.
