According to the subitem 12) Item 1 of article 5 of the Law of the Republic of Kazakhstan of January 7, 2003 "About the electronic document and the electronic digital signature" (further - the Law) and the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve enclosed:

1) Rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of public key of the electronic digital signature by root certification center of the Republic of Kazakhstan, according to appendix 1 to this order;

2) Rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of public key of the electronic digital signature by certification center of state bodies of the Republic of Kazakhstan, according to appendix 2 to this order;

3) Rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of public key of the electronic digital signature by national certification center of the Republic of Kazakhstan, according to appendix 3 to this order.

2. Declare invalid the order of the Minister of Communications and information of the Republic of Kazakhstan of December 10, 2010 No. 348 "About approval of Rules of activities of root certification center of the Republic of Kazakhstan, certification center of state bodies of the Republic of Kazakhstan and national certification center of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts for No. 6716, No. 92-93 published in the Kazakhstanskaya Pravda newspaper of March 15, 2011 (26513-26514).

3. To committee of communication, informatization and information of the Ministry for Investments and Development of the Republic of Kazakhstan (Kazangap T. B.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 3 of this order.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of public key of the electronic digital signature by root certification center of the Republic of Kazakhstan (further - Rules) are developed according to the subitem 12) of Item 1 of article 5 of the Law of the Republic of Kazakhstan of January 7, 2003 "About the electronic document and the electronic digital signature" (further - the Law), and determine procedure for issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of public key of the electronic digital signature by root certification center of the Republic of Kazakhstan.

2. In these rules the following basic concepts are used:

1) means of cryptographic information protection (further - SKZI) - the software or the hardware and software realizing algorithms of cryptographic conversions, generation, forming, distribution or management of encrypting keys;

2) the list of the withdrawn registration certificates (further - SORS) - the part of the register of registration certificates containing data on registration certificates which are terminated their serial numbers, date and the reason of recall;

3) certification center - the legal entity certifying compliance of public key of the electronic digital signature to private key of the electronic digital signature, and also confirming reliability of the registration certificate;

4) root certification center of the Republic of Kazakhstan (further - KUTs RK) - the certification center performing confirmation of accessory and reality of public keys of the electronic digital signature of certification centers;

5) the applicant - certification center, except for KUTs RK;

6) the user - the owner of the registration certificate of certification center except for KUTs RK;

7) the registration certificate - the electronic document issued by the certification center for confirmation of conformity of the electronic digital signature to requirements established by the Law;

8) withdrawal of the registration certificate - the procedure of recognition of the registration certificate invalid in KUTs RK;

9) the owner of the registration certificate - physical person or legal entity addressed to which the registration certificate legally owning the private key corresponding to the public key specified in the registration certificate is granted;

10) the electronic digital signature (further - the EDS) - set of electronic digital characters created by means of the electronic digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

Chapter 2. Procedure for issue of the registration certificate to certification center

3. For issue of the registration certificate to certification center, the applicant represents to KUTs RK by means of mail or special mail service, or purposely the following documents:

1) the statement on issue of the registration certificate to certification center in form, according to appendix 1 to these rules;

2) copy of the certificate on accreditation of certification center;

3) the registration certificate of certification center in electronic form.

4. Issue of the registration certificate to certification center is performed by means of mail or special mail service, or purposely within fifteen working days, after submission of documents specified in Item 3 of these rules.

5. KUTs RK and the applicant if necessary for cases of the accelerated release or withdrawal of the registration certificate can sign among themselves the agreement on issue and withdrawal of the registration certificate.

6. After consideration of documents KUTs RK makes issue of the registration certificate to certification center in electronic form, and also its copy on paper in form, according to appendix 2 to these rules and registers it in the register of registration certificates.

7. Issue of the registration certificate to certification center is registered in special register of issue of registration certificates in form, according to appendix 3 to these rules.

8. KUTs RK refuses to certification center issue of the registration certificate in the following cases:

1) incompleteness of the submitted documents;

2) submissions of false information;

3) according to the judgment which took legal effect;

4) not achievements of sixteen-year age by person.

The written motivated answer about failure in issue of the registration certificate to certification center is issued to the applicant by means of mail or special mail service, or purposely within fifteen working days from the date of the address of the applicant to KUTs RK.

9. Effective period of the registration certificate of certification center constitutes five years from the moment of its issue.

Chapter 3. Procedure for storage of the registration certificates granted by KUTs RK

10. The storage duration of documents on creation and withdrawal of the EDS constitutes fifteen years according to the List of the standard documents which are formed in activities of the state and non-state organizations, with indication of storage duration, to the deputy approved by the order. The Minister for Culture and Sports of the Republic of Kazakhstan of September 29, 2017 No. 263 (it is registered in the Register of state registration of regulatory legal acts for No. 15997).

11. After the term specified in Item 10 of these rules, the withdrawn registration certificates arrive on archive storage according to Regulations of Admission, storages, accounting and use of documents of National Archive Fund and other archive documents by the departmental and private archives approved by the order of the Government of the Republic of Kazakhstan of September 19, 2018 No. 575.

Chapter 4. Procedure for withdrawal of the registration certificate of certification center

12. The withdrawal of the registration certificate of certification center, is performed in the following cases:

1) upon the demand of the owner of the registration certificate, or his representative based on the statement on withdrawal of the registration certificate in form, according to appendix 4 to these rules;

2) in case of factual determination of submission of false information or incomplete document package in case of receipt of the registration certificate;

3) death of the owner of the registration certificate;

4) change of surname, name or middle name (if it is specified in the identity document) the owner of the registration certificate;

5) changes of the name, reorganization, liquidation of the legal entity - the owner of the registration certificate, change of the head of the legal entity;

6) provided by the agreement between certification center and the owner of the registration certificate;

7) on the judgment which took legal effect.

13. For withdrawal of the registration certificate of certification center, the applicant represents to KUTs RK by means of mail or special mail service, or purposely the official letter with the supporting document of approach of one of cases, stipulated in Item 12 these rules.

14. The withdrawal of the registration certificate of certification center is performed within one working day from the moment of registration of the official letter for withdrawal of the registration certificate.

15. After consideration of documents KUTs RK makes records in the register of registration certificates on cancellation of the registration certificate with indication of date, the reason and time of withdrawal of the registration certificate of certification center within one working day from the date of receipt of the relevant information.

16. KUTs RK in day of withdrawal of the registration certificate sends to the applicant by means of mail or special mail service, or purposely the written notice of withdrawal of the registration certificate and publishes this fact in SORS KUTs RK on Internet resource to the address www.root.gov.kz.

The SORS updating is made with frequency at least once a month.

Chapter 5. Procedure for confirmation of accessory and reality of public key of the electronic digital signature

17. The user of certification center in case of receipt of the electronic document containing the registration certificate performs its check on confirmation of accessory and reality of public key of the EDS with use of SKZI of certification center, by accomplishment of the following checks:

1) resubordinations of the registration certificate of the KUTs RK EDS certification center;

2) effective period of the registration certificate of certification center;

3) otozvannost of the registration certificate of certification center.
