About approval of the Regulations on safe transportation of radioactive materials

(as amended on 21-08-2024)

In pursuance of provisions of Item and) article 7 of the Law No. 132 of June 8, 2012 on safe implementation of nuclear and radiological activities (The official monitor of the Republic of Moldova, 2012, Art. No. 229-233, 739), the Government DECIDES:

1. Approve Regulations on safe transportation of radioactive materials it (is applied).

2. To the ministry of the environment through National agency on regulation of nuclear and radiological activities:

create system of cooperation with competent authorities of member countries of the European community and other countries;

request from the European commission transfer of addresses of competent authorities of member countries of the European community and all information necessary for operational cooperation with these bodies and applications of the Regulations on safe transportation of radioactive materials;

notify the European commission on the status of national competent authority in nuclear area and ask from the European commission support in receipt of the same data and for other countries outside the European community.

Regulations on safe transportation of radioactive materials

Chapter I. Basic rules of safe transportation of radioactive materials

Section 1. Purpose and field of application

The purpose of the Regulations on safe transportation of radioactive materials (further – the Provision) is accomplishment at the national level of the Vienna regulatory provisionss of International Atomic Energy Agency (IAEA) of safe transportation of the radioactive materials reviewed in 2012 (Regulations for the Safe Transport of Radioactive Material, Specific Safety Requirements No. SSR-6, 2012 Edition (Revised), published 22.10. 2012), and transpositions of some provisions of the Directive of the European Council 2013/59/Evratom of December 5, 2013 according to standards of safety for protection against ionizing radiation and about cancellation of the Directive 89/618/by Evrat, 90/641/Evrat, 96/29/Evrat, 97/43/Evrat and 2003/122/Evrat, and also the European agreement on the international road delivery of dangerous goods (ADR-2013, (European Agreement concerning the International Carriage of Dangerous Goods by Road), ECE/TRANS/202, Vol. I and II which the Republic of Moldova joined the Resolution of Parliament No. 44-XIV of June 4, 1998.

1. This Provision establishes necessary measures for ensuring protection and safety of transportation of radioactive materials for the purpose of deduction of level of radiation exposure below admissible values for persons, personnel, the population, property and the environment in time and owing to the radioactive materials of procedures accompanying transportation.

2. The this provision purpose – to provide protection of the population, personnel, property and the environment against impact of ionizing radiation in the course of all transportation of radioactive material. This protection is reached by obligatory application:

1) shelter (sealing) of radioactive content;

2) the control of external radiation levels proceeding from the surface of the shipping container;

3) measures for prevention of criticality;

4) measures for prevention of damage of container as a result of thermal impact.

3. Fulfillment of requirements of Item 2 this provision is provided by application of step approach to limits of content of packagings and ferrycrafts, and also to normative characteristics of designs of packagings depending on danger which is constituted by radioactive content. Accomplishment of these conditions is reached by establishment of requirements for design and operation of packagings, and also servicing of packaging sets, including taking into account nature of radioactive content, and also by obligatory application of measures of administrative control, including procedures of issue by competent authorities of authorizations.

4. Application of requirements of this provision to transportation of radioactive materials conducts to safety increase of the involved personnel and the population. Confidence in such observance is reached by means of quality assurance programs and ensuring compliance with this provision.

5. Requirements of this provision are applied to transportation of radioactive material by all types of land, water or air transport, including the transportation connected with use of radioactive material. Transportation includes all transactions and conditions which are connected with movements of radioactive material, and constitutes this process, in particular designing, production, servicing and repair of packaging set, preparation, processing, loading, sending, transportation, transit storage, unloading and acceptance in final destination of loads of radioactive materials and packagings.

In this Provision step approach to standards of the technical qualities which are characterized by three levels of severity is applied:

1) usual conditions of transportation (without any incidents);

2) normal condition of carriages (insignificant incidents);

3) transportation emergencies.

6. This Provision does not extend on:

1) the radioactive materials which are integral part of vehicles;

2) transportation of radioactive materials within the organization which is in the authorization mode when transportation does not assume use of the automobile or railroads public;

3) the radioactive materials implanted or entered into human body or animal for the purpose of diagnostics or treatment;

4) the radioactive materials which are in consumer goods after their sale to the end user;

5) the natural substances and ores containing natural radionuclides which are not supposed to be processed for the purpose of use of these radionuclides provided that specific activity of such substance does not exceed more than by 10 times of value specified in Items 22-27 of this provision.

7. This Provision does not establish such control measures as the choice of route or ensuring physical protection which can be caused by other reasons which are not connected with radiation safety. Any such control measures shall consider radiation and not radiation hazards without departure from the regulations of safety ordered by this Provision.

8. In transit the radioactive materials connected with additional risk, and also in transit radioactive materials together with other dangerous goods in addition to requirements of this provision the corresponding rules of transportation of dangerous goods for the corresponding classes of dangerous goods according to the European agreement on the International road delivery of dangerous goods (ADR) of September 30, 1957 existing for the Republic of Moldova since August 14, 1998 shall be applied.

Section 3. General provisions

10. The program of radioactivity protection meeting the Main standards of radiation safety, hygienic requirements and rules will be developed for transportation of radioactive materials (the order No. 06.05.3.34 of February 27, 2001 the Ministries of Health (ONRB-2000). Nature and scales of the measures provided in the program depend on size and probability of radiation. The program will meet the requirements provided in Items 12-13 and 15-19. All documents of the program shall be provided on demand in NARYaRD for assessment and receipt of radiological authorization.

11. During transportation physical protection and radiological safety shall be optimized so that the size of individual doses, number of persons which are exposed to radiation and probability of radiation kept at reasonably achievable low level taking into account economic and social factors and did not exceed the corresponding limits of the doses specified in ONRB-2000. The interrelation of transportation with other types of activity shall be considered.

12. Persons participating in transportation of radioactive materials shall be prepared by the owner of radioactive permission, according to article 20 of the Law No. 132 of June 8, 2012 on safe implementation of nuclear and radiological activities and have the corresponding preparation on radioactivity protection, including precautionary measures which need to be observed to reduce professional radiation to which they are exposed and radiation of other persons who could suffer as a result of their actions.

The training program specified in the first paragraph will be performed responsible for transportation of radioactive material with annual reassessment and amendment.

Persons participating in transportation of radioactive materials shall have the corresponding preparation, according to requirements of this provision.

Requirements for training of personnel are specified in Chapter III of this provision.

13. Accredited public medical and sanitary organizations will make medical observation of the personnel participating in activities for transportation of radioactive materials. The service of the State supervision of public health of the Ministry of Health carries out monitoring and assessment of impact of ionizing radiation with periodic assessment of individual doses.

The central body of public management in the field of health care informs the National agency on cases of overexposure of the personnel involved in transportation of radioactive materials and the populations.

14. In case of professional radiation of person as a result of performance of works, connected with transportation when dose, according to assessment:

Does not exceed 1) 1mzv in year when are not required approval of the special working procedure, major radiation monitoring, the program of assessment of doses by means of radiation monitoring of the corresponding workplaces or individual radiation monitoring;

2) will be within 1-5 mzv in year when the program of assessment of doses by means of radiation monitoring of the corresponding workplaces or individual radiation monitoring is entered;

Does not exceed 3) 5 mzv in year when individual radiation monitoring is entered. Individual radiation monitoring and radiation monitoring of workplaces will be followed by dosimetric accounting, according to ONRB-2000 and other regulating documents.

15. Radioactive materials shall be located at sufficient distance from personnel or the population. For calculation of distance or radiation level the following indicative levels of effective doses are used:

1) for workers in working areas of permanent stay peak value of dose criterion 5 mzv in year;

2) for the population in places of general open access peak value of dose criterion of the corresponding group 1 mzv in year is allowed.

16. Radioactive materials shall be located at sufficient distance from not shown films. For determination of distance criteria of atomic irradiation of not shown 0,1 films mzv on consignment are used.

17. For the purpose of ensuring protection of people, property and the environment in case of accidents or the fires during transportation of radioactive materials shall the provisions established on case of accidents approved by NARYaRD and Service of emergency situations and corresponding the competent other countries of the organization involved in international delivery will be applied. Plans of reaction in case of accident shall be established according to the provisions ONRB-2000 and other existing rules.

18. Plans of reaction in case of accident shall consider possibility of formation of other dangerous substances, as a result of interaction of transportation of radioactive materials with the environment.

19. For the purpose of ensuring compliance of this provision the quality assurance programs based on the national and international standards, at all levels of transportation, designing, production, testing, documentation, use, servicing, storage and control of all radioactive materials of special type, radioactive materials with low capability to dispersion, transport transactions and transit storage will be developed and implemented. Confirmation about full compliance of the specification of design is enclosed to the application on receipt of the safety certificate. The manufacturer, the consignor or the user of any model of packaging shall give opportunity to inspection during production or use and to show to any representative according to the Law No. 132 of June 8, 2012 on safe implementation of nuclear and radiological activities, to competent authority that:

1) the applied methods of production and materials meet specifications of the approved design, according to this Provision;

2) all packaging sets are periodically inspected and if necessary are repaired and contain orderly to continue to meet all relevant requirements of this provision even after reuse.

20. NARYaRD bears responsibility for observance of compliance of packagings to requirements of this provision. Observance and control of compliance implies establishment and implementation of the program of observance of designing, production, testing, inspection and conditions of keeping of packaging, radioactive materials with low extent of dispersion, and also preparation, approval of documentation, processing and stacking of packagings by senders and carriers for the proof of application of requirements of this Provision.
