Procedure for provision of the status of state member of the Shanghai Cooperation Organization

This Procedure establishes legal, financial and ministerial procedures of acceptance of new members in the Shanghai Cooperation Organization (further - SCO or the Organization), taking into account relevant provisions of Article 13 of the Charter of the Shanghai Cooperation Organization of June 7, 2002, and also the regulations established in Regulations on the procedure for acceptance of new members in SCO approved by the Decision No. 1 of Council of Chapters of state members of SCO of June 11, 2010 (further - the Provision), the Standard Memorandum of obligations of the state applicant for the purpose of receipt of the status of state member of SCO approved by the Decision No. 1 of Council of Chapters of state members of SCO of September 12, 2014 (further - the Standard Memorandum).

I. Legal procedures

1. According to Provision Item 2.1 the official appeal of the state applicant signed by the head of the state applicant with request for provision of membership in SCO in coordination with Ministers of Foreign Affairs of state members of SCO is transferred by the acting chairman of the board of Ministers of Foreign Affairs of state members of SCO (further - SMID) to study of Council of national coordinators of state members of SCO (further - SNK) and the Secretariat of SCO (further - the Secretariat). The state applicant in the official address with request for provision of organizational membership, according to Provision Item 1.1, gives the obligation about observance of the purposes and the principles of the Charter of SCO, and also the international treaties and documents accepted within SCO. The secretariat informs the state applicant on acceptance to consideration of its official address.

2. SNK with assistance of the Secretariat considers at the regular meeting the official appeal of the state applicant according to the procedure established by Rules of procedure of SCO. The conclusion of SNK, including about compliance of the state applicant to criteria of membership, is submitted in accordance with the established procedure for consideration of the regular meeting of SMID. The conclusion of SNK contains the developed analysis of compliance of the state applicant to the criteria and conditions stated in Item 1.2 of the Provision, political, economic and other effects of acceptance of this state in SCO and also level and nature of its relations with state members, the states observers and partners of SCO in dialogue.

3. SMID considers the conclusion of SNK and in case of its approval submits for consideration of Council of Chapters of state members of SCO (further - SGG).

4. SGG on representation of SMID makes the relevant decision on the beginning of the procedure of admission to membership of SCO what the acting chairman of SGG notifies the head of the state applicant on.

5. At the request of SNK the Secretariat after the notification of the state applicant on the solution of SGG to begin the procedure of its admission to membership of SCO based on Item 2.3 of the Provision starts approval and preparation together with authorized representatives of the state applicant of the draft of the Memorandum of obligations of the state applicant for the purpose of receipt of the status of state member of SCO (further - the Memorandum). The secretariat on regular basis informs SNK on the course of negotiations with the state applicant concerning terms of its accession to international treaties within SCO, financial aspects of the accession to SCO and substitutions of quota vacancies in permanent bodies of SCO.

6. The secretariat submits SNK the report on results of negotiations and the agreed project of the Memorandum.

7. SNK in accordance with the established procedure submits the report on results of negotiations and the draft of the Memorandum for consideration of SMID. SGG on representation of SMID makes the decision on signing by the Secretary general of the Memorandum of obligations of the state - the applicant for the purpose of receipt of the status of state member of SCO. On behalf of state members of SCO the Memorandum is signed by Ministers of Foreign Affairs or other authorized officers.

8. According to Item 3.6 of the Standard Memorandum the appeal of the state applicant about review of terms of accession to international treaties within SCO is drawn up in the form of the letter of the Minister of Foreign Affairs of this state directed to the Secretary general of SCO. The similar address can be made only once for the period actions of the corresponding Memorandum. At the same time new terms of accession of the state applicant to international treaties within SCO shall not exceed the initial terms specified in Items 3. 2, 3.3 and 3.5 Memorandums.

9. After accomplishment by the state applicant of the obligations provided by Items 3.2 and 3.3 of the Standard Memorandum and in case of the commencement provision of the Memorandum the state applicant acquires the right to join the international treaties specified in Appendix No. 2 to the Standard Memorandum.

10. After completion of accession of the state applicant to international treaties within SCO of SGG according to Item 2.5 of the Provision and Item 3.5 of the Standard Memorandum makes the decision on provision to the state applicant of the status of state member of SCO.

II. Financial conditions

1. The size of annual fee of new state member is calculated taking into account line items of state members of SCO and the offer of the state applicant. Parameters of the budget of ShchOS increase in absolute expression by the size of fee of at least new state member.

2. The secretariat according to Item 4.2 of the Standard Memorandum and article 3 of the Agreement on procedure for forming and budget implementation of SCO prepares offers on change of the sizes of contributions of state members which affirm SGG in accordance with the established procedure.
