being guided by Article 125 (part 4) Constitutions of the Russian Federation, Item 3 parts one, parts three and the fourth Article 3, Article part one 21, Articles 36, 47.1, 74, 86, 96, 97 and 99 Federal constitutional Laws "About the Constitutional Court of the Russian Federation",

considered in meeting without carrying out hearing case on check of constitutionality of Item 5 of article 33 of the Federal law "About Basic Guarantees of the Voting Rights and the Participation Rights in Referendum of Citizens of the Russian Federation" and part 8 of article 32 of the Electoral code of the city of Moscow.

Reason for consideration of the case was the claim of the citizen K. S. Jankauskas. The basis to consideration of the case was the found uncertainty in question of whether there correspond the Constitutions of the Russian Federation disputed by the applicant of legislative provision.

Having heard the message of the judge-speaker A. N. Kokotov, having researched the submitted documents and other materials, the Constitutional Court of the Russian Federation

established:

1. According to Item 5 of article 33 of the Federal Law of June 12, 2002 No. 67-FZ "About basic guarantees of the voting rights and the participation rights in referendum of citizens of the Russian Federation" shall provide the documents specified in Items 2, 2.2, 3 and 3.1 of this Article, the candidate (except the candidate proposed in the candidate list) personally; these documents can be submitted at the request of the candidate by other persons in cases if the candidate is sick, contains in places of detention of suspects and persons accused (at the same time authenticity of the signature of the candidate on the statement in writing shall be certified notarially or administration of stationary treatment and prevention facility in which the candidate is on treatment, administration of organization in which suspects and persons accused are held in custody), other cases established by the Federal Law.
