Some questions of the Single state information system in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction

According to the paragraph to the second "About prevention and counteraction of legalization (washing) of income gained in the criminal way to financing of terrorism and financing of distribution of weapons of mass destruction" the Cabinet of Ministers of Ukraine decides parts six of article 12 of the Law of Ukraine:

1. Approve:

Regulations on the Single state information system in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction which is applied;

the list of information resources of databases of the Single state information system in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction according to appendix.

2. Determine that ensuring functioning and development of the Single state information system in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction is performed by subjects of the specified system for the account and in the expense limits provided by it in the government budget for the corresponding year.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Regulations on the Single state information system in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction

1. This Provision regulates procedure for determination of the state information resources and procedure for provision of access to them for ensuring functioning of the Single state information system in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction (further - the Single system), and also bases of its functioning and development.

2. The terms used in this Provision have the following value:

subjects of the Single system - Gosfinmonitoring and other state bodies providing access of Gosfinmonitoring to the state information resources which are necessary for accomplishment of the tasks assigned to it;

information resources of databases - the part of the state information resources determined by Gosfinmonitoring and approved by other subjects of the Single system;

access to information resources of databases - the automated access of Gosfinmonitoring to information resources of databases or provision by their subject of the Single system for updating in storage of data;

storage of data - set of the structured and formalized data from the state information resources combined in the central subsystem of the Single system for carrying out the state financial monitoring by Gosfinmonitoring.

3. Single system - organizational and technical system which with use technical and software realizes technologies of the data collection and processing of the state information resources necessary for carrying out complex information analysis about financial transactions, identifications of the facts of masking of illegal origin of the income and the mechanism of their legalization, prevention of washing (legalization) of such income, to financing of terrorism and financing of distribution of weapons of mass destruction.

4. The single system is created for the benefit of homeland security, protection of the rights and legitimate interests of citizens, society and the state for the purpose of ensuring realization of state policy in the field of prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction according to the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction" and International standards on counteraction to laundering of the income and financing of terrorism and the distribution of weapons of mass destruction recommended by Group on development of financial measures of anti-money laundering (FATF).

5. Offers on forming of the list of information resources of databases of the Single system are developed by Gosfinmonitoring.

6. Information which is processed in the Single system are information with limited access which is secret of financial monitoring.

7. Subjects of the Single system provide maintaining and updating of information resources of databases of the Single system directly or through administrators of the state information resources.

8. The single system consists from:

central subsystem;

functional subsystems;

special telecommunication network;

complex system of information security.

9. The central subsystem which is created and serviced by Gosfinmonitoring provides access to information resources of databases of the Single system, their processing and administration.
