About Regulations on single rules and conditions of putting down of apostille on official documents of state bodies of the Republic of Tajikistan

According to article 21 of the Constitutional law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" the Government of the Republic of Tajikistan decides:

1. Approve Regulations on single rules and conditions of putting down of apostille on official documents of state bodies of the Republic of Tajikistan (are applied).

2. Determine as the state bodies having powers on putting down of apostille, the following state bodies:

- Ministry of Justice of the Republic of Tajikistan;

- Ministry of Foreign Affairs of the Republic of Tajikistan.

3. To the Ministry of Justice of the Republic of Tajikistan and the Ministry of Foreign Affairs of the Republic of Tajikistan to bring the interdepartmental acts into accord with this resolution.

Regulations on single rules and conditions of putting down of apostille on official documents, state bodies of the Republic of Tajikistan

1. General provisions

1. The regulations on single rules and conditions of putting down of apostille on official documents of state bodies of the Republic of Tajikistan (further - the Provision) are developed for the purpose of implementation of the Convention canceling the requirement of the legalization of foreign official documents made in the Hague of October 5, 1961 (further - the Convention). This Provision determines procedure and conditions of putting down of apostille by the authorized state bodies given the right of putting down of apostille on the official documents made in the territory of the Republic of Tajikistan.

2. The purpose of the procedure of putting down of apostille is providing guarantee of authenticity and proper execution of the apostilled documents intended for representation in the territory of member countries of the Convention.

3. The basic concepts used in this Provision:

apostille - the apostille issued in the unpacked format under seal and the signature of the official of authorized body with it is unique the generated number of system of the unified register of accounting of Apostilles;

apostilization - the authentication of the signature, seal or stamp of the original document by putting down of apostille. Putting down of apostille is performed by its printing with seal and the signature of the official of authorized body with assignment is unique the generated number of system of the unified register of accounting of Apostilles;

authorized state bodies - the state bodies having rights of putting down of apostille;

the official document - the document (the original or notarially certified copy) created by body, the organization, the official within the powers and which is drawn up in accordance with the established procedure;

The register of specimen signatures, prints of stamps and seals - electronic base of the specimen signatures, prints of stamps and seals of public authorities of the Republic of Tajikistan and the organizations issuing the official documents which are subject to apostilization;

Single, the register of accounting of apostille - the electronic register on accounting of apostilles which conducting is assigned to the Ministry of Justice of the Republic of Tajikistan and the Ministry of Foreign Affairs of the Republic of Tajikistan.

4. The official documents made in the territory of the State Parties of the Convention on which the apostille in accordance with the terms is put down, established by the Convention, are recognized in the territory of the Republic of Tajikistan without additional legalization.

5. The documents intended for the representation in the territory of the state, not being the participant of the Convention, or in the territory of the State Party of the Convention but which pushed objection against accession of the Republic of Tajikistan to it undergo the regular procedure of consular legalization in accordance with the established procedure.

6. In the activities authorized state bodies on putting down of apostille are guided by the legislation of the Republic of Tajikistan, the Convention and this Provision.

7. For putting down of apostille in the established stipulated by the legislation procedure for the Republic of Tajikistan the state fee and collection is collected.

2. The documents which are subject to apostilization

8. Official documents which are made in the territory of the Republic of Tajikistan are subject to apostilization and are subject to use in the territory of another the states of the participant of the Convention.

9. Originals of the official documents issued by bodies of the Tajik Soviet Socialist Republic and the former republics of the Union of Soviet Socialist Republics cannot be apostilled in the territory of the Republic of Tajikistan. The apostille can be put down on copies of such documents, notarized in the territory of the Republic of Tajikistan.

10. The apostille is not put down:

- on the documents signed by diplomatic representations and consular establishments of the Republic of Tajikistan;

- on the documents having a direct bearing on commercial or customs transactions;

- on the documents which are not subject to export and transfer abroad (military IDs, the identity certificate, passports).

11. The Ministry of Justice of the Republic of Tajikistan is responsible for putting down of apostille on the following official documents:

- the official documents proceeding from bodies of civil registration;

- the official documents proceeding from notaries public;

- official documents, judicial authorities and bodies of enforcement proceeding;

- official documents, bodies of prosecutor's office.

12. The Ministry of Foreign Affairs of the Republic of Tajikistan is responsible for putting down of apostille on other other documents, except for the documents specified in Item 11 of this provision.

3. Apostilization terms

13. The documents submitted for apostilization are issued to the applicant with the put-down apostille within 5 working days from the date of submission of documents. The documents submitted for apostilization quickly are issued in terms from one to three days of the working days.

14. In case of need shall not exceed reclamations of the specimen signature and confirmation of powers on right to sign of the official who signed the official document submitted on putting down of apostille, and\or reclamation of sample of impress of a seal or stamp, term of apostilization 30 working days.
