1. Approve the enclosed Instruction about procedure for cost determination of state examination of town-planning projects, the architectural, construction projects allocated in them queues of construction, start-up complexes and estimates (estimate documentation).

Chapter 1. General provisions

1. This Instruction establishes procedure for cost determination of state examination of town-planning projects, the architectural, construction projects allocated in them queues of construction, start-up complexes and estimates (estimate documentation) (further - the cost of state examination of the town-planning and project documentation).

2. For the purposes of this Instruction terms in the values determined in article 1 of the Law of the Republic of Belarus of July 5, 2004 "About architectural, town-planning and construction activities in the Republic of Belarus" are used (The national register of legal acts of the Republic of Belarus, 2004, No. 109, 2/1049) and Item 3 of the Regulations on procedure for conducting state examination of the town-planning projects, architectural, construction projects allocated in them queues of the construction, start-up complexes and estimates (estimate documentation) approved by the resolution of Council of Ministers of the Republic of Belarus of September 30, 2016 No. 791 (The national legal Internet portal of the Republic of Belarus, 07.10. 2016, 5/42711).

3. The cost of state examination of the town-planning and project documentation determined according to this Instruction is confirmed by the parties in case of the conclusion of the contract for conducting state examination of the town-planning and project documentation.

4. The cost of state examination of the town-planning and project documentation is determined proceeding from the normative size of funds for development of the town-planning project, the project and prospecting works determined in accordance with the established procedure.

In case of change (increase, reduction) more than for 50 percent of cost (total costs of manpower) on development of the town-planning project, architectural or construction project according to the considered documentation in the course of its state examination the amount of the payment levied when conducting state examination is subject to refining. At the same time refining of the amount of payment is made according to Chapter 2 or 3 of this Instruction.

5. The cost of state examination of the project documentation of construction object providing availability in the project documentation of queues of construction of the objects which are part of construction object is determined by each queue of construction, the object which is part of construction object, separately with subsequent their summing.

6. The cost of state examination of the project documentation developed abroad constitutes no more than 10 percent from the cost of development of the project documentation and is determined according to terms of the contract on conducting state examination of the project documentation.

If terms of the contract of conducting state examination of the project documentation developed abroad determine application of quotations, work cost rates according to appendices 1, 2 and 4 to this Instruction, the cost of conducting state examination of this project documentation is determined using to them coefficient in the amount of 1,5, when carrying out adaptation of the project documentation, developed abroad, the project organization in the territory of the Republic of Belarus - 1,2.

7. The cost of state examination of the architectural and (or) construction projects provided by citizens without intention of commercial use of results of implementation of construction activities constitutes percent 1,5 from the cost of design and exploration work on object according to Item 9.1 of the list of the ministerial procedures performed by state bodies and other organizations for petitions from citizens, No. 200 approved by the Presidential decree of the Republic of Belarus of April 26, 2010 "About the ministerial procedures performed by state bodies and other organizations for petitions from citizens" (The national register of legal acts of the Republic of Belarus, 2010, No. 119, 1/11590).

8. The cost of expert maintenance of development of the town-planning, preproject and project documentation is determined at the rate to 10 percent of the cost (total costs of manpower) on development of the town-planning project, preproject documentation, architectural or construction project, their Sections and parts. In the absence of possibility of cost determination (costs of manpower) of development of the project documentation - based on calculation for the individual cost rates of manpower developed in the organization.

Expert maintenance is carried out on account of the cost of project and prospecting works or at the expense of additional resources of the customer, builder. Chapter 2. Procedure for cost determination of state examination of the town-planning and project documentation in case of cost determination of its development based on basic prices

9. The cost of state examination of the town-planning and project documentation in case of cost determination of its development based on basic prices is determined according to quotations on conducting state examination of the town-planning and project documentation according to appendices 1 and 2 to this Instruction.

10. The cost of state examination of the town-planning and project documentation is determined by formulas 1 and 2, provided in this Item, using for date of the conclusion of the contract for conducting state examination of the town-planning and project documentation of indexes of change in value of project works:

in case of development of the town-planning and project documentation in basic price level for January 1, 2006 on formula

where

 - the cost of conducting state examination of the town-planning and project documentation in basic price level for January 1, 2006;

- the size of funds for development of the town-planning project or the amount of funds for carrying out engineering-geological researches and development of the project documentation according to the executive estimates provided by developer or data of the works agreement on performance of works (if terms of the contract of the contract do not provide development of the executive estimate) in basic price level for January 1, 2006;
