Based on subitems 8.4 and 8.10 of Item 8 of the Regulations on National Statistical Committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of August 26, 2008 No. 445, National Statistical Committee of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure for representation of primary statistical data it (is applied).

2. This resolution becomes effective since January 1, 2016.

The instruction about procedure for representation of primary statistical data

Chapter 1. General provisions

1. This Instruction establishes procedure for representation of primary statistical data in forms of the state statistical reporting.

The state statistical reporting is represented included in the statistical register as respondents:

legal entities of the Republic of Belarus (further – legal entities);

separate divisions of legal entities;

the individual entrepreneurs registered in the Republic of Belarus (further – individual entrepreneurs).

2. In this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus of November 28, 2004 No. 345-Z "About the state statistics", the Law of the Republic of Belarus of December 28, 2009 No. 113-Z "About the electronic document and the digital signature" and also the following terms and their determinations are used:

misstatement of data of the state statistical reporting – the wrong creation of the state statistical reporting owing to non-compliance with instructions for its filling and (or) the discrepancy of primary statistical data to data of source accounting and other documents revealed after fixed term of representation of primary statistical data;

person responsible for creation and representation of primary statistical data, – the respondent's head (person fulfilling its duties, the individual entrepreneur) or the other person authorized on creation and representation of primary statistical data;

separate division of the legal entity – branch, the representation or other separate division of the legal entity located out of the place of its stay, performing according to accounting policy of this legal entity financial accounting with determination of financial result on the activities and for which for making of transactions by the legal entity the current (settlement) bank account with provision of the right to dispose of money on the account to officials of this separate division based on the power of attorney is opened.

Chapter 2. Procedure for representation of primary statistical data

3. Respondents represent primary statistical data from the moment of their creation and until their liquidation (the activities termination).

4. Newly created legal entities (except created as a result of reorganization) represent primary statistical data in the forms of the state statistical reporting specified in the list according to appendix 1.

The legal entities who are in process of liquidation, the liquidated debtors (legal entities on whom the decision on liquidation is made before initiation of proceeedings on its bankruptcy) represent primary statistical data in the forms of the state statistical reporting specified in the list according to appendix 2.

Primary statistical data are represented by the respondents specified in parts one and the second this Item according to the criteria established in forms of the state statistical reporting and (or) instructions for their filling.

The individual entrepreneurs who are in process of the termination of activities do not represent primary statistical data.

Primary statistical data for the periods which expired before acceptance date in the procedure for the decision on liquidation of the legal entity established by the legislation, the termination of activities of the individual entrepreneur are represented according to the procedure, acting to decision date about liquidation of the legal entity, the termination of activities of the individual entrepreneur.

Primary statistical data when carrying out selective, combined (for the sample method of observation) the state statistical observations are represented by respondents whose lists are created by bodies of the state statistics, the state organizations authorized on maintaining the state statistics.

5. Primary statistical data in forms of the state statistical reporting are presented in the form of the electronic document if other is not established in Item 7 of this Instruction.

6. Representation by the respondent of primary statistical data in forms of the state statistical reporting in the form of the electronic document is performed by means of the specialized software with use of the certificate of the open key published in the State management system by open keys of verification of the digital signature of the Republic of Belarus.

In case of receipt of the state statistics by bodies and state organizations authorized on maintaining the state statistics of primary statistical data in forms of the state statistical reporting in the form of the electronic document to the respondent the message on results of their acceptance goes.

7. Primary statistical data in forms of the state statistical reporting can be provided on paper in cases:

if their representation in the form of the electronic document is impossible in view of unavailability or mistakes in work of the specialized software, and also for other reasons including which are not depending on the respondent;

representations of primary statistical data including corrected after the termination of term of their collection in form of the state statistical reporting for the corresponding accounting period.

8. Primary statistical data in forms of the state statistical reporting are on paper represented by mail or the courier.

9. Respondents represent primary statistical data in amount, the terms and addresses specified in forms of the state statistical reporting behind signatures of persons responsible for creation and representation of primary statistical data.

Primary statistical data are considered unpresented in case of lack of the signature of person responsible for their creation and representation.

If the last day of term of representation of primary statistical data falls on the Saturday, Sunday, the public holidays and holidays established and announced according to the procedure, stipulated by the legislation, non-working in the afternoon of the termination of term of representation of primary statistical data the working day following it is considered.
