About some questions connected with accession of the Republic of Kazakhstan to the World Trade Organization
According to Item 3 of Article 1 and article 2 of the Agreement on functioning of the Customs union within multilateral trade system of the May 19, 2011 applied according to the Protocol on functioning of the Eurasian Economic Union within multilateral trade system (appendix No. 31 to the Agreement on the Eurasian Economic Union of May 29, 2014), taking into account Item 3 of the Protocol on accession of the Republic of Kazakhstan to the Marrakesh agreement on organization of the World Trade Organization of the April 15, 1994 signed on July 27, 2015 the Supreme Euroasian economic council solved:
1. Appendix No. 1 to the Regulations of work of the Euroasian economic commission approved by the Decision of the Supreme Euroasian economic council of December 23, 2014 No. 98, to add with Item 132 following of content:
"132. Approval of the inventory to which the state member according to obligations assumed as condition of its accession to the World Trade Organization after entry into force of the Agreement on the Eurasian Economic Union applies rates of import customs duties, lower in comparison with rates of duties of the Common customs tariff of the Eurasian Economic Union, and the sizes of such rates of duties.".
2. Euroasian economic commission:
approve the inventory concerning which the Republic of Kazakhstan in accordance with the terms, provided by paragraph 307 of the Report of the Working group on accession of the Republic of Kazakhstan to the World Trade Organization as condition of accession to the World Trade Organization, applies rates of import customs duties, lower in comparison with rates of duties of the Common customs tariff of the Eurasian Economic Union, and the sizes of such rates of duties (further - the list), and also to perform maintaining the list, including its updating and reduction in compliance with the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union;
together with the governments of state members of the Eurasian Economic Union (further - state members) till March 31, 2016 to handle issue of feasibility of modification of the Common customs tariff of the Eurasian Economic Union (further - ETT EEU) for the purpose of establishment concerning separate types of goods of rates of import customs duties taking into account obligations of the Republic of Kazakhstan assumed as condition of accession to the World Trade Organization.
3. Provide to the Republic of Kazakhstan use of the goods imported on the territory of the Republic of Kazakhstan from the territories of the third countries and placed under customs procedure of release for internal consumption with payment of import customs duties at the rates according to the list only within the territory and take measures for non-admission of export of such goods in the territory of other state members.
4. To provide to the governments of state members together with the Euroasian economic commission:
development in the I quarter 2016 within interaction of Customs Services of the approved economically reasonable cost indicators of risk and measures for risk minimization, and also forming on their basis of profiles of risk concerning the goods included in appendix to this Decision;
application of the risk profiles created according to the paragraph the second this Item in case of practical carrying out customs control of customs value of goods since April 1, 2016;
monitoring of practice of customs declaration of goods concerning which the risk profiles created according to the paragraph the second this Item, and representation by results of the specified monitoring quarterly of reports will be applied to Council of the Euroasian economic commission and times in half a year of reports for the Euroasian intergovernmental council;
preparation taking into account the Decision of the Supreme Euroasian economic council of October 10, 2014 No. 88 "About development of the system of marking of separate types of products of light industry in the territories of state members of the Customs union and the Common economic space" in the IV quarter 2016 of offers on introduction of mechanisms of marking concerning the separate light industrial goods and household appliances included in the list;
introduction on meeting of the Supreme Euroasian economic council in December, 2015 of offers on refining of standard rates of distribution of import customs duties, proceeding from offers of the Republic of Armenia concerning single approach to accounting of the withdrawals applied by state members from ETT EEU;
