About the Code of ethics of the government employee of the Republic of Tajikistan

(as amended of the Presidential decree of the Republic of Tajikistan of 11.08.2017 No. 916)

For the purpose of strengthening of responsibility of the government employee and management efficiency of public service, and also for increase in prestige of institute of public service, according to part 2 of article 7-1 of the Law of the Republic of Tajikistan "About public service" and article 51 of the Law of the Republic of Tajikistan "About regulatory legal acts" I decide:

1. Approve the Code of ethics of the government employee of the Republic of Tajikistan it (is applied).

2. To heads of the central and local executive bodies of the government, self-government institutions of settlements and villages, other state bodies:

- take necessary measures for application of this Code;

- bring the legal acts into accord with this decree.

3. To charge control of execution of this decree and coordination of activities of the commissions on ethics of the government employee of state bodies to the Agency of public service in case of the President of the Republic of Tajikistan.

4. Declare invalid the Presidential decree of the Republic of Tajikistan of September 15, 2010, No. 932 "About the Code of ethics of the government employee of the Republic of Tajikistan".

Code of ethics of the government employee of the Republic of Tajikistan

The code of ethics of the government employee of the Republic of Tajikistan (further - the Code) regulates set of the regulations, the principles and rules of office and off-duty behavior of the government employee expressing moral qualities of its professional activity and behavior at work and in society and the conventional moral human values, moral requirements of society to the government employee.

Chapter 1. General provisions

1. Provisions of this Code extend to the political and administrative government employees holding the state positions of public service in state bodies of system of public service and in self-government institutions of settlements and villages according to the Law of the Republic of Tajikistan "About public service" and other regulatory legal acts.

2. The citizen of the Republic of Tajikistan who arrived on public service gets acquainted with this Code and shall observe its requirements when implementing office and off-duty activities.

* Note: The office behavior is the behavior, action and the relation of the government employee made in arrival time for work and departure from work, accomplishment of job responsibilities, participation at meetings and meetings, stays on official journeys and other governmental activities.

** Note: The off-duty behavior is the behavior, action and the relation of the government employee which is not connected with execution of job responsibilities and the made off-duty hours in society.

Chapter 2. Principles of ethics of the government employee

3. This Code is based on the following principles of ethics of the government employee proceeding from the principles of public service and the government employee shall be guided by them in office and off-duty activities:

- legality - the correct observance and full implementation of regulations of the Constitution of the Republic of Tajikistan, the laws and other regulatory legal acts and the international legal acts recognized by Tajikistan;

- priority of rights and freedoms of man and citizen - the ensuring protection and assistance in realization of rights and freedoms of man and citizen which are the supreme value;

- commitment to the Homeland and the people of Tajikistan - manifestation of feeling of love for the country and to the people of Tajikistan, commitment to policy of the President of the Republic of Tajikistan and the Government of the Republic of Tajikistan to consider holy duty protection of the Homeland, right service to the Homeland and society of Tajikistan;

- humanity and social justice - respect for the person, its rights and freedoms which are the supreme value, to be effective fairly, fair, ensuring compliance with social justice in case of decision making;

- transparency in public service - transparent activities of the government employee and provision of information on her to society, including through mass media, except for activities and data, components state or other, protected by the law secrets;

- tolerance - respect and the correct understanding of various cultures, povedeniye, customs, beliefs, religions, manifestation of respect in case of communication with employees, visitors, subordinate and the public;

- honesty and disinterestedness - implementation of effective management, non-admission of conflict of interest, corruption actions, use of material money to destination and for the general benefit, manifestation of disinterestedness in case of decision making;

- persistence - the strict relation and manifestation of responsibility in realization of functions of state bodies and job responsibilities;

- professionalism and competence of the government employee - availability of specific professional knowledge, qualifications, abilities, skills, organizing, initsiatorsky, personal qualities, capability of management, skills of management and experience which are basis of successful execution of function of state bodies and job responsibilities;

- office promotion of the government employee on the basis of capabilities, talent, professional training and qualification requirements - appointment (election) to other position or to the highest position without assumption of domesticity, regionalism and protection, as manifestations of corruption acts.

4. This Code is based also on other principles and the established standards of behavior provided by regulatory legal acts.

Chapter 3. Rules of office and off-duty behavior of the government employee

5. The government employee shall:

- recognize, respect, observe and protect rights and freedoms of man and citizen, to treat history of the country, national customs, traditions and culture with respect, to put interests of the state above private interests and to be attentive and responsible concerning addresses of citizens;

- observe requirements of the Law of the Republic of Tajikistan "About streamlining of traditions, celebrations and ceremonies in the Republic of Tajikistan" and to provide its observance by family members and children;
